Dear Council Members,
Although we are disappointed that our request for annexation moratorium was not enacted, we will
continue to cooperate in addressing our mutual concerns regarding city annexation practices and
obligations.
The mayor s letter dated I'd arch a 2010 makes further reference to the 'four -party at reemenC' and
provision of wastewater.outside city limits. We have provided advanced copies of Yakima County's
'four -party agreement documentation for vour review These copies have been provided to ascertain if
the city may have any additional documentation that the county may not.possess.
Capon city review we recornmend that the'four -party entities direct their respective staff to review and
report their findings to each of their respective boards/councils. Upon coriipletion.of those independent
reports, the four parties would then jointiv implement a collective task force to create a new foul -partv
agreement as allowed within the existing agreement.
Although the 'four -patty agreement- is an integral component of City of Yakima arinezation.practices;
Yakima County, believes it is an independent and stand -alone issue. Therefore, we recommend that the
Intergovernmental Committee continue to work.and fulfill GMA annexation and UGA guidelines which
serve the best interests of our respective communities.

Water Treatment Plant Staff Change Sodium Hypochlorite Tank
The cost of chemicals and services relating to production of drinking water continues to increase The
City utilizes two 4,500 gallon high density polyethylene tanks at the Water Treatment
Plant to store sodium hypochlorite (bleach) used as part of the disinfection process Two years
ago during regular inspection, it was discovered that one of the tanks had cracked and was leaking
The Water Treatment Plant (WTP) crew took immediate actions to take the tank off -line and make
repairs Unfortunately due to the properties of the contents, those repairs were not entirely successful
As a result the City contracted with a private company to install a new tank at a cost of approximately
$10000
In January of this year the second tank developed a small crack and started leaking From the
previous experience, the WTP crew knew the tank was not repairable and that purchasing a
replacement tank was in order In that the WTP crew had assisted the contractor in replacing the first
tank, they, along with some preplanning, could fit the tank replacement into our schedule While the
tank was being shipped we constructed the platform and lifting rigs we would need and reserved the
equipment that was used to do the lifting A couple of dry runs were performed
The tank was successfully replaced during the week of March 15 while keeping the WTP in full
operation Taking into account the cost of preparation for the operation and staff time for the dry-runs
and operations, the savings realized by this crew taking the initiative to perform this operation in -house
rather than contracting the work out was on the order of $8500

Chapter 5.56 PEDDLERS
5.56.010 Definitions.
The following words, terms and phrases, and their derivations, when used in this chapter, shall have
the meanings ascribed to them in this section, except where the context clearly indicates a different
meaning
(a) "Charitable" means- and: includes-the-words patriotic, philanthropic, social. service,. health,_.welfare,
benevolent; educational; civic; cultural, religious or fraternal, either actual-or purported:
(b) "Contributions" means and includes the words alms, money, subscription, property or any
donations under the guise of a loan of money or property
(c) "Department" means the city of Yakima code administration division
(d) "Director" means the code administration manager of the city of Yakima of his designee
(e) "Peddler" means any person who goes upon the premises of any private residence in the city, not
having been invited by the occupant thereof, carrying or transporting goods, wares, merchandise or
personal property of any nature and offering the same for sale This definition also includes any
person who solicits orders and as a separate transaction makes deliveries to purchasers
(f) "Peddling" means and includes all activities ordinarily performed by a peddler as indicated under
subsection (e) of this section.
(g) "Person" means a natural person or any firm, corporation, association, club, society or other
organization
(h) "Solicitor ;means any person who goes upon the premises of any private residence in the city, not
having been invited by the occupant thereof, for the purpose-of taking or attempting to -take orders--for
the sale of goods, merchandise, wares, or other personal property of any nature for future delivery, or
for - services to be performed in the future This definition. also includes any person who, without
.invitation, goes upon private property, to request, contribution-of -funds or anything of value, or sell
goods or services for political, charitable, religious—,or-other noncommercial -purposes:
_(i)-"Solicitation" means and includes all activities ordinarily performed by a solicitor as indicated under
subsection (h) of this section
0) "Street sales" and "street selling" mean sales, offering for sale or attempted sale of goods, wares,
merchandise or services upon the streets, alleys or public thoroughfares of the city of Yakima, but
shall not include sales from lawfully placed vending machines (Ord 96 -26 § 1, 1996 Ord. 2534 § 1,
1981 Ord B -875 § 1, 1948)

5.56.020 Permit requirements and exemptions.
It-shall be unlawful for any person to engage in peddling, solicitation, or street sales activities.within-
the city of Yakima without-first obtaining a permit issued-by the-department; provided; however; that,E
the following are exempted -from the -provisions•- ofthis�sectibrrk
(a) Any solicitation made upon premises owned or occupied by an organization upon whose behalf the
solicitation is made,
(b) Any communication by an organization soliciting contributions solely from persons who are
members of the organization at the time of such solicitation,
(c) Any solicitation in the form of a collection at a regular meeting, assembly or service of a charitable
person, or
(d) Any solicitation,for thearelief of any individual specified,b.y..name.at.the time of the solicitation where
the solicitor-represents in each, case4hat the entire amount collected shall be turned over to the named!
beneficiary;
(e) Sidewalk cafes operating with a lawfully issued permit under Chapter 5 80 of this code,
(0 Persons who are the holder of a valid permit under the provisions of Section 8 52.070 of this code
when engaged in peddling or street selling of the services of curb number painting,
(g) Street sales as part of a parade or special event when such sales are explicitly authorized by a
permit issued pursuant to the provisions of Chapter 9 70 of this code (Ord 96 -26 § 2, 1996 Ord 2534

5.56.026 Fees
At the time the application is filed with the department, the applicant shall pay a fee to cover the cost to
the city of processing the application and investigating -the facts stated therein The permit fee shall.be-

`twenty -ve dollars for each solicitor, peddler or street seller This fee shall be waived-'for-'charitabfe�
groups or organizations and. public or private educational institutions, provided-,-however,-that the
charitable group, organization- or-educational institution maintains a permanent business address in
