Invocation /Pledge of Allegiance Council Member Dave Edler gave an invocation and led the Pledge of Allegiance 3. Open Discussion for the Good of the Order A. Proclamations Al Pineda, from Conover Insurance, accepted a proclamation that declared the week of ® September 19th as National Truck Driver Appreciation week. B. Presentations /recognitions /introductions • Yakima Police Explorers Achievements and Awards Police Officers Ira Cavin and bolce Diaz, co- advisors for the Explorers, gave an overview of the Explorer program and summarized the members' duties and accomplishments Eleven explorers were present. C Status reports on prior meeting's citizen service requests • Response to Jim Evans regarding weedy lots EDLER MOVED AND LOVER SECONDED TO ACCEPT THE REPORT The motion carried by unanimous voice vote D Appointments to Boards, Commissions and Council Committees - None 4 Consent Agenda Mayor Cawley referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from either Council members or citizens present. Items 7 and 8 were added to the Consent Agenda. The City Clerk read the Consent Agenda items, including resolutions and ordinances by title ENSEY MOVED AND ADKISON SECONDED TO ADOPT THE CONSENT AGENDA AS READ The motion carried by unanimous roll call vote (Subsequent paragraphs preceded by an asterisk ( *) indicate items on the Consent Agenda handled under one motion without further discussion ) SEPTEMBER 21, 2010 *A. Consideration of approval of City Council Meeting Minutes 1 Business Meeting —September 7, 2010 2 Adjourned Meeting /Study Session —September 8, 2010 The minutes of the September 7, 2010 Business meeting and the September 8, 2010 Adjourned meeting were approved, having been duly certified accurate by two Council members and no one present wishing to have said minutes read publicly B. Consideration of approval of Council Committee Meeting Minutes *1 Council Public Safety Committee —August 18, 2010 *2. Transit/Transportation Planning Committee —August 19, 2010 *3 Gang Free Initiative Steering Committee —August 26 and September 8, 2010 *4 City /County Intergovernmental Committee — August 31 and Sept. 14, 2010 *5 Council Economic Development Committee — September 1, 2010 *6 Neighborhood Development Committee — September 1, 2010 7 Rules and Procedures Committee — August 26, 2010 (reinserted) • Recommendation to address issues raised by citizens during Audience Participation through standard City procedures instead of giving precedence because they were presented during a business meeting, recommendation that response to issues that cannot be addressed through standard procedures be extended to four weeks rather than the currently established two -week time period Michael Morales, Community and Economic Development Director, explained that this mainly is related to code complaints He noted that the timing of meetings and Council packet preparation actually results in a one -week time 0 period to prepare a response That is not enough time and it negatively impacts issues being handled by the standard procedure They would like to be allowed to skip the next meeting and respond at the one after This would give them more like three weeks to research and respond LOVER MOVED AND ENSEY SECONDED TO ADOPT THE RECOMMENDED PROCESS. The motion carried by unanimous roll call vote, Coffey absent. 5. Audience Participation No one came forward to speak. 7 00 P M. — PUBLIC HEARINGS 6 Public hearing to consider an ordinance amendment to modify the Yakima County Tourist Promotion Area John Cooper, President/CEO of the Yakima Valley Visitors and Convention Bureau, gave background on the formation and membership of the Tourist Promotion Area He explained there are 27 hotels that contribute to the TPA fund The way it is currently set up, Union Gap, with one hotel and one voting seat, has 100% representation, Selah has 3 hotels, 2 seats for 67 %, compared to Yakima with 23 hotels and 2 seats for 9% representation The petition asked to add two more voting seats from hotels in Zone B (outlying) in Yakima This change requires an amendment of the ordinance Council Member Adkison raised the issue of a recent request from Union Gap to withdraw and waive the one -year requirement to do so City Attorney Cutter advised there is no authority in the interlocal agreement to waive the withdrawal provision 2 SEPTEMBER 21, 2010 0 • Mayor Cawley opened the public hearing Jay Wildgen, 804 S 57" Avenue, said he originally supported this motion but changed his mind after hearing that the properties in Selah and Union Gap desired to withdraw from the TPA as a result of the request. He would like to see the cities of Toppenish and Zillah participate and increase this fund to a larger marketing force If we ignore Selah and Union Gap's withdrawal, we may never be able to add -more cities Velrynn Best, 3711 S 46th Avenue, emphasized that Union Gap and Selah elected to withdraw on their own figuring they could do abetter job themselves Basically they didn't want the two additional positions She reiterated that Yakima would be contributing $600,000 yet would have less than a 9% vote as to how that money was spent. Penny Baker, 1701 E Yakima Avenue, said they met with Union Gap and Selah and discussed the pros and cons of adding two members and increasing the TPA dollars After that meeting, they decided we did not stand behind what we said in the meeting She believes by being in a Zone B hotel that her voice isn't represented as well as it could be She strongly believes we need two more votes • Mayor Cawley closed the public hearing The City Clerk read the ordinance by title, EDLER MOVED AND ADKISON • SECONDED TO APPROVE THE ORDINANCE. The motion carried by unanimous roll call vote, Coffey absent. • ORDINANCE NO 2010 -37, AN ORDINANCE relating to the Tourism Promotion Area for the City of Yakima, amending Chapter 5 99 entitled "Tourism Promotion Area" of the City of Yakima Municipal Code, specifically section 5 99 060, entitled "Establishment of Yakima hotel and motel commission" and specifically amending Section 5 99 060 A and C regarding the provisions on voting members CITY MANAGER'S REPORTS *7 Consideration of a Resolution authorizing execution of an agreement with Conley Engineering for fixture upgrades RESOLUTION NO R- 2010 -106, A RESOLUTION authorizing the City Manager to execute a Professional Services Agreement with Conley Engineering, Inc, a Washington Corporation in an amount not to exceed $9,900 00 to assess existing electrical fixtures, determine if existing fixtures will allow for recommended energy efficient upgrades, and produce a fixture schedule and specifications to use in preparing a bid package for said fixture upgrades per the Energy Efficiency and Conservation Block Grant EECBG) and the American Recovery and Reinvestment Act (ARRA) 3 SEPTEMBER 21, 2010 *8. Consideration of a Resolution authorizing execution of an agreement with Akel Engineering Group, Inc. to provide wastewater /stormwater engineering services for the Wastewater Division RESOLUTION NO R- 2010 -107, A RESOLUTION authorizing the City manager to execute an agreement with Akel Engineering Group and the City of Yakima to provide wastewater /stormwater engineering services for the Wastewater Division, a copy of which is attached hereto *9 Consideration of a Resolution authorizing execution of a mutual aid agreement between Joint Base Lewis- McChord/Yakima Training Center Police Department and the City of Yakima Police Department RESOLUTION NO R- 2010 -108, A RESOLUTION authorizing the City Manager and Chief of Police to enter into a mutual aid agreement with the Yakima Training Center Police Department - *10 Consideration of Resolutions authorizing execution of 2010 agreements with A. Greater Yakima Chamber of Commerce RESOLUTION NO R- 2010 -109, A RESOLUTION authorizing the City Manager to execute an Agreement with the Greater Yakima Chamber of Commerce, Inc. for the purpose of fostering community economic development, citizen participation in City government, and improvement in the quality of life in Yakima 0 B. Hispanic Chamber of Commerce of Yakima County RESOLUTION NO R- 2010 -110, A RESOLUTION authorizing the City Manager to execute an Agreement with the Hispanic Chamber of Commerce of Yakima County for the purpose of fostering community economic development, citizen participation in City government, and improvement in the quality of life in Yakima. C Yakima Sunfair Festival Association for tourist promotion services RESOLUTION NO R- 2010 -111, A RESOLUTION authorizing the City Manager of the City of Yakima to execute an agreement between the City of Yakima and the Yakima Sunfair Festival Association for the arrangement of tourist promotion services *11 Consideration of a Resolution setting the date of a public hearing before the City of Yakima Hearing Examiner for October 28, 2010 to consider two right -of -way vacation petitions and Yakima Valley Memorial Hospital's associated Master Development Plan RESOLUTION NO R- 2010 -112, A RESOLUTION setting October 28, 2010, as the date for a combined public hearing before the Hearing Examiner to consider the vacation of portions of S 29th and 30th Avenues, and YVMH's associated Master Development Plan application The public right -of -ways for these streets were created by the plats of NOB HILL ORCHARD HEIGHTS ADJOINING NORTH YAKIMA, according to the official plat thereof recorded in Volume 'E' Page 25, GRANDVIEW SUBURBAN HOMES, according to the official plat thereof recorded in Volume 'H', Page 15, GRANDVIEW HALF -ACRE is TRACTS, according to the official plat thereof recorded in Volume `G', Page 12, and DE FOE QUARTER ACRES, according to the official plat thereof recorded in Volume 'H', Page 2, records of Yakima County, Washington 4 SEPTEMBER 21, 2010 *12. Set date of Closed Record public hearing for October 5, 2010 to consider the preliminary plat of Mountain View Estates October 5, 2010 was set as the date of public hearing to consider the preliminary plat of Mountain View Estates located in the vicinity of West Chestnut and 67 t Avenues ORDINANCES *13. First reading of an Ordinance amending the 2010 budget and making an appropriation in the Economic Development budget and authorizing grant funding from SIED for North 1St Street corridor revitalization study services (no action required at this meeting; second reading scheduled 10 -5 -10) An Ordinance amending the 2010 budget and appropriating funds for North 1St Street corridor revitalization study services, was read by title only, and laid on the table until October 5, 2010 for a second reading *14. Second reading of an Ordinance amending the 2010 budget and making an appropriation in the 462 — Transit Operating Fund for extended services ORDINANCE NO 2010 -38, SECOND READING OF AN ORDINANCE amending the 2010 budget for the City of Yakima, and making appropriations of $223,000 within the 462 - Transit Operating Fund for expenditure during 2010 to provide additional fixed - route and paratransit services *15. Second reading of an Ordinance amending the 2010 Refuse budget for unanticipated landfill and fuel expenditures services ORDINANCE NO 2010 -39, SECOND READING OF AN ORDINANCE amending the 2010 budget for the City of Yakima, and making appropriations of $49,000 within the 471 - Refuse Fund for expenditure during 2010 to provide for increased costs in landfill and fuel charges 16. Other Business Council Member Ensey noted that staff time is considerably pressed because of furloughs and workload and requested Council look at how much staff time is involved with boards and commissions and determine whether all of them are still necessary Staff was directed to provide a report on the amount of time they spend on each committee The consensus of the Council was to review the report in 30 days at a regular business meeting Council Member Ettl asked Council if they would be interested in using Elway to poll the community regarding issues and concerns the Council is discussing He said they are here to do the will of the people but many times get no input or conflicting information Council decided they would like to think about this more and bring it back for discussion at a future time Staff was directed to contact Eisenhower High School to determine if the statistics class would be interested in doing a survey of the community, which had been done in the past. 9 SEPTEMBER 21, 2010 Mayor Cawley brought up the forms -of- government issue discussed from previous meetings and said he still had questions he would like answered It was pointed out that it was difficult to study the issue without having it better defined Discussion ensued on how to further pursue the subject. LOVER MOVED AND CAWLEY SECONDED TO ESTABLISH A THREE - PERSON COMMITTEE TO BRING BACK IN THIRTY DAYS OR LESS AN OUTLINE AND ANSWERS TO FREQUENTLYASKED QUESTIONS FOR DISCUSSION AT A STUDY SESSION OR REGULAR BUSINESS MEETING. The motion carried by unanimous roll call vote, Coffey absent. CAWLEY MOVED AND ADKISON SECONDED TO ASSIGN COUNCIL MEMBERS EDLER, ENSEYAND LOVER TO THE COMMITTEE. The motion carried by unanimous roll call vote, Coffey absent. 17 Adjournment CAWLEY MOVED AND ENSEY SECONDED TO ADJOURN TO 10:00 A.M. SEPTEMBER 28, 2010 FOR A JOINT PUBLIC MEETING WITH YAKIMA COUNTY IN THE COUNCIL CHAMBERS ON THE WEST VALLEY NEIGHBORHOOD PLAN.
