the City of Yakima's Critical Areas Ordinance update

SUMMARY EXPLANATION
In order to ensure the City Clerk is able to meet the twenty (20) day public hearing notice
requirement, the City Council must approve the public hearing set date on January 15 to hold
the public meeting on February 19
Background Since February 2004, Councilmembers together with the Code Administration
and Planning Division and legal staff have participated in the county -wide Critical Area's
Ordinances (CAO) review /update process. The City of Yakima's approach to this required
Growth Management Act (GMA) update is to provide a clear, concise and minimum set of
development regulations for the CAO, using Yakima County's draft CAO as the base
document.
Yakima County is also updating their Shoreline Mater Plan (SMP) program at this time
® However, Washington State law does not require the SMP to be updated until 2013 At
Council's direction (i e October 17, 2007 study session), the City's proposed CAO update
does not address any part of the SMP
As previously explained to the Council, the City of Yakima was mandated by the state to
complete the Critical Areas Ordinance update by December 1, 2007, in order to be in
compliance with the GMA. Although the City did not meet the compliance deadline, with the
present schedule, the City should be in GMA compliance the first full week in April 2008,
which will be in time to submit applications to the state Public Works Trust Fund
