BUSINESS MEETING
FEBRUARY 2, 2010

1. Roll Call
Present:
Council: Mayor Micah Cawley, presiding, Council Members Maureen Adkison,
Dave Edler, Rick Ensey, Dave Ettl and Bill Lover
Staff: City Manager Zais, City Attorney Cutter and City Clerk Kloster
Absent: Assistant Mayor Kathy Coffey
2. Invocation /Pledge of Allegiance
Council Member Edler gave an invocation and led the Pledge of Allegiance.
3. Open Discussion for the Good of the Order

C. Status reports on prior meeting's citizen service requests
• Response to Kevin Larson regarding tax impacts upon newly- annexed
properties (see report from Supervising Planner Bruce Benson)
Bruce Benson reviewed a memo supplied to Council regarding real property
taxes during the annexation process.
Tom Holbrook with the Yakima Airport Board gave a report of recent activities:
• Union Gap finished Valley Mall Boulevard and the reconditioning of 16
Avenue has also been completed.
• Horizon Air meeting was held sharing information about their and airport
needs.
• Airport Manager and Board Chairman are going to the Allegiant Air
conference to try to bring them to Yakima.
• Airport safety overlay is moving forward.
• Main runway will have new asphalt put over the top by the end of the summer
(using FAA money).
• Security updates in the terminal are finished.
• The taxiway markings and signage were redone (using FAA money).
• Two ecology projects are going on: the Richardson site was just completed;
and wells on buried fuel tanks around the airport are being monitored.
• Master plan update project to begin soon. The City Council will be solicited
for input during the process.
• February 10 -12 the FAA is coming to do a safety check.
• Passenger load factors with Horizon Air are holding steady from last year -
about 56 % -62% load.
• Looking into the possibility of putting a grass strip in at airport for landing
smaller craft.

• Looking into moving the administration office into the restaurant area.
• The Board retreat is scheduled for April 3 at Port of Sunnyside — Council is
invited.
• Invited Council members for a free airplane ride with Les Flue.
D. Appointments to Boards, Commissions and Council Committees - None
4. Consent Agenda
Mayor Cawley referred to the items placed on the Consent Agenda, questioning
whether there were any additions or deletions from either Council members or
citizens present. There were no changes. The City read the Consent Agenda
items, including resolutions and ordinances by title. EDLER MOVED AND ADKISON
SECONDED TO ADOPT THE CONSENT AGENDA AS READ. The motion carried
by unanimous roll call vote; Coffey absent. (Subsequent paragraphs preceded by an
asterisk ( *) indicate items on the Consent Agenda handled under one motion without
further discussion.)
*A. Consideration of approval of Council Minutes
• Special Meeting /Study Session — January 6, 2010
The minutes of the Special Meeting /Study Session of January 6, 2010 were
approved, having been duly certified accurate by two Council members and no one
present wishing to have said minutes read publicly.
*B. Consideration of approval of Council Committee Meeting Minutes
• Public Safety Committee — January 20, 2010
The Council committee meeting minutes were approved.
5. Audience Participation
Lawrence Breer, 2911 Shelton Avenue, expressed concerns about background
checks not being required for individuals purchasing weapons at gun shows. Any
felon can purchase a weapon at a show. City Manager Zais explained that this issue
must be addressed at the state level. The Association of Washington Cities has
attempted to focus on this "loophole." Mr. Breer was urged to contact his state
representative.
7:00 P.M. — PUBLIC HEARING
6. Public Hearing and Consideration of an Ordinance approving the final
assessment roll for the Simpson Lane Sewer Local Improvement District (LID)
No. 1061
Council members were questioned on whether they had had any ex -parte contact to
which they all answered no.

Doug Mayo, City Engineer, described the location that consists of 82 parcels. The
LID was initiated by area residents. Public meetings were held in early 2007, and
the LID was officially formed. They were billed at the original estimate, although it
was under costs by approximately $14,000. Mr. Mayo described the payment
methods and how costs can be assigned to participants. In this case it was by equal
distribution with all parcels paying the same amount.
• Mayor Cawley opened the public hearing.
Reverend John Everhart, 1416 E. Viola, requested an investigation into the conduct
of the individual overseeing the project. He was not satisfied with the removal and
replacement of his fencing. He stated it wasn't of the same quality and the property
owners had to pay extra money to bring it back to the original quality.
• Mayor Cawley closed the public hearing.
The City Clerk read the ordinance by title; EDLER MOVED AND LOVER
SECONDED TO PASS THE ORDINANCE. The motion carried by unanimous roll
call vote; Coffey seconded.
ORDINANCE NO. 2010 -05, AN ORDINANCE of the City of Yakima,
Washington, approving and confirming the final assessment roll for Local
Improvement District No. 1061, which has been created and established for
the purpose of paying the cost of certain sewer system improvements; and
levying and assessing the amount thereof against the lots, tracts, parcels of
land and other property shown on said roll.
CITY MANAGER'S REPORTS
7. Consideration of a report from City Legal Department regarding options to
regulate panhandling
Cynthia Martinez, Senior Assistant City Attorney, reviewed information regarding
options to regulate panhandling. If the problem is well defined, the City could move
toward regulation of panhandling. One way to find out if there is a problem is to hold
a public hearing or have crime reports supporting the need for that legislation.
Another option would be to criminalize aggressive panhandling; currently the penalty
is only an infraction. There are not many police reports for aggressive panhandling
and it is the only type that can be regulated.
Lynn Hardin, 913 Pleasant Avenue, said that many of the panhandlers are trying to
impersonate valid agencies, e.g. the Salvation Army. He commented on their
unsafe actions of weaving in and out of the traffic. He suggested they be required to
have picture identification.
Another citizen came forward and said panhandling doesn't appear in police reports
because people don't call the police, wait for them to show up and go through the
reporting process. He claimed this is a feature of downtown living and working. He
agreed that a public hearing is a good way to get people to come and talk about the
problem. He referred to the free speech argument and commented that this doesn't
compare to the deep right of someone to tell you about their religion or political
ideas, but is commercial free speech. That is much more limited and easier to work
with in terms of licensing.

EDLER MOVED AND ENSEY SECONDED TO ACCEPT THE REPORT. The
motion carried by unanimous voice vote; Coffey absent. CAWLEY MOVED AND
ETTL SECONDED TO HOLD A PUBLIC HEARING ON PAN HANDLING. The
motion carried 5 -1; Edler voting no and Coffey absent. •
8. Consideration of 2010 deferred policy issue regarding the Crime and
Intelligence Analyst Supervisor position
City Manager Zais supplied background information on the creation and intent of the
position. He also described the process it went through with Civil Service and
budgeting. Chief Granato also supplied information on the process. Following the
discussions, EDLER MOVED AND ENSEY SECONDED TO RETAIN THE CRIME
ANALYST SUPERVISOR. The motion carried by unanimous roll call vote; Coffey
absent.
*9. Consideration of a Resolution authorizing execution of an intergovernmental
cooperative purchasing agreement with Western Washington University

Intergovernmental Cooperative Purchasing Agreement with Western Washington
University.
*10. Consideration of a Resolution ratifying declaration of an emergency and
authorizing execution of contracts to repair and install a trickling filter clarifier
drive unit

RESOLUTION NO. R- 2010 -21, A RESOLUTION ratifying the declaration of an
emergency and authorizing the City Manager to execute all applicable contracts to
repair and install a Trickling Filter Clarifier drive unit
ORDINANCES
*11. Second reading of an Ordinance amending the 2010 budget and making an
appropriation of $10,000 in the 000 - General Fund for local public records
management and preservation efforts
• ORDINANCE NO. 2010 -06, AN ORDINANCE amending the 2010 budget for the
City of Yakima; and making appropriations of $10,000 within the 000 - General
Fund for expenditure during 2010 to support local public records management and
preservation efforts.
12. Other Business
• Discussion regarding rescheduling the March 16 Council meeting to March
9 or March 23
Due to conflicting schedules with the Washington D.C. trip, EDLER MOVED
AND LOVER SECONDED TO RESCHEDULE THE SECOND MEETING IN
MARCH TO MARCH 23 The motion carried by unanimous voice vote; Coffey
absent.

Council Member Ettl stated he is annoyed with the letters to the Herald- Republic
editor and statements in blogs, etc. claiming the Council only deals with
insignificant issues like baristas and panhandlers. He wants the public to know
the Council focuses on many more important matters beyond those that make
the news.
Mayor Cawley reported that the recent trip to Olympia and testimony on various
bills in the legislature was very effective.
13. Adjournment
EDLER MOVED AND ENSEY SECONDED TO ADJOURN. The motion carried by
unanimous voice vote; Coffey absent. The meeting adjourned at 7:25 p.m.
