HomeMy WebLinkAbout05-27-15 YPC MinutesCity of Yakima Planning Commission (YPC) City Hall Council Chambers Meeting Minutes of May 27, 2015 Call to Order Chairman Dave Fonfara called the meeting to order at 3:30 p.m. Roll Call YPC Members Present: Chairman Dave Fonfara, Al Rose, Patricia Byers, Ron Anderson, Carmen Mendez YPC Members Absent: Vice -chair Scott Clark, Bill Cook Staff Present: Robbie Aaron, Assistant Planner; Jeff Peters, Supervising Planner; Mark Kunkler, Senior Assistant City Attorney Others: Bev Luby Bartz, Phyllis Musgrove, Dennis Macias Staff Announcements Supervising Planner Jeff Peters announced that packets have been provided to the Planning Commission containing information about the 2015 Comprehensive Plan Map Amendment applications. Approval of the A ril. 29 2015 and Mqy 11 201.5 Meeting Minutes Commissioner Ron Anderson made a motion to approve the minutes of the two meetings and Commissioner Carmen Mendez seconded the motion. The motion carried unanimously. Update on Council's Remand of Mission Uses in CBD GC and M-1 Zoning Districts (TXT#001-1.5) Senior Assistant City Attorney Mark Kunkler briefed the commission on issues brought up at the City Council hearing on May 19, 2015 on the topic of mission issues in the CBD, GC, and M-1 zoning districts. He explained a concern presented by the Yakima Gateway Organization (YGO) at the hearing relating to a settlement agreement between YGO and the Union Gospel Mission. Kunkler explained City Council's decision to remand the mission use and definition issue back to the Planning Commission. At the request of Chairman Dave Fonfara, Mark Kunkler provided an explanation of levels of review for planning applications and the Planning Division's concerns regarding establishing mission uses as a Class 3 use. Commissioner Patricia Byers requested a copy of the settlement agreement between the Yakima Gateway Organization and the Union Gospel Mission but it was discovered that Planning Commission members may already have the settlement agreement in their possession. Jeff Peters provided a recap on the issue surrounding the Union Gospel Mission, highlighting the settlement agreement dispute. Commissioner Al Rose asked for clarification on the difference between a classification of use and a type of review. -1- The Commission discussed inviting members of the Yakima Gateway Organization to the next study session. Peters provided a tentative schedule of having another Planning Commission study session on this topic on June 10th, a Planning Commission public hearing on June 24th, approving staff's findings of fact on July 8th, and returning the matter back to City Council on July 21St. Audience member Dennis Macias pointed out that the legal ads for these public hearings are placed on the back page of the newspaper where not as many people will see them. He also mentioned that the concerns brought up by the Yakima Gateway Organization were actually complaints that need to be addressed. Study Session - Airport Safe Overlay Assistant Planner Robbie Aaron informed the commission that this is the last study session regarding the Airport Safety Overlay (ASO) before the public hearing. Aaron went over the parts of the ASO that have been edited since the last Planning Commission meeting on this subject. Commissioner Rose asked who created the original ASO that staff has been working to modify to which Jeff Peters answered that it was written primarily by Jerry Kilpatrick, the Assistant Airport Manager at the time, with the help of City staff. Yakima Airport Manager Rob Peterson expanded on why changes were made to the ASO. Robbie Aaron announced that staff is planning to schedule the public hearing on this matter for July 8th. Chairman Dave Fonfara asked who the notice of the public hearing goes to, to which Peters answered that the notice will be published in the newspaper and will be publicized on YPAC. Commissioner Byers included that other parties of record could be added as well including citizens who signed in at Planning Commission meetings when this subject was discussed. Fonfara added that the Planning staff could work with the local media to run a story on the public hearing. Rob Peterson reported on the meeting with Union Gap relating to the ASO, adding that the presentation was well received by Union Gap's staff and commission members. Other Business Jeff Peters announced to the commission a tentative schedule of having the first study session on the Comprehensive Plan Map Amendments (CPAs) on June 10th, and then having two more study sessions, one on June 24th and one on July 8th in which the rest of the CPAs would be discussed along with any other items on the agenda for those meetings. Peters reported that Chelminar Association Inc. (Chapter H) and Cottonwood Partners (Chapter G), with the possibility of one other CPA to be determined, will be discussed at the next Planning Commission meeting on June 10th. i A motion to adjourn to June 10, 2015 was passed with unanimous vote.
