SUMMARY EXPLANATION:
The City of Yakima Urban Area Comprehensive Plan 2040 and Transportation Systems Plan
2040 (adopted June 6, 2017), include language that promotes the establishment of truck routes.
Under state law, RCW 46.44.080 provides local jurisdictions the authority to, by Ordinance,
impose restrictions, limitations, or prohibitions on motor trucks or other vehicles on certain streets,
which shall not become effective until adequate signage is erected and maintained.
On September 17, 2017 the City Council authorized staff to create an ad-hoc committee to
review potential truck routes, gain feedback from effective parties, and make recommendation to
City Council. The ad-hoc committee met on November 2, 2017 which consisted of several
members of the community, interested parties, and staff. On May 24, 2018, the Council
Economic Development Committee reviewed a draft of the Ordinance and recommended it be
forwarded to the full Council for consideration. On July 17, 2018, Council directed staff to
prepare the Ordinance for consideration at a public hearing on August 6, 2018.
The Ordinance establishes definitions, applicability of the Ordinance, Exceptions to the
Ordinance, designates truck routes, identifies how truck traffic is regulated, designates the
establishment of maps and signage, and establishes penalties for violation. Per RCW 46.44.080,
the Ordinance will become effective after the appropriate signs are posted and maintained.

ORDINANCE NO. 2018 -
AN ORDINANCE amending the City of Yakima Municipal Code to add Chapter 8.40 — Truck
Routes
WHEREAS, the City Council adopted the Yakima Urban Area Comprehensive Plan
2040 and Transportation Systems Plan 2040 on June 6, 2017, which includes language specific
to the establishment of truck routes; and,
WHEREAS, RCW 46.44.080 provides local jurisdictions the authority to, by Ordinance,
impose restrictions, limitations, or prohibitions on motor trucks or other vehicles on certain
streets, which shall be not become effective until adequate signage is erected and maintained.
WHEREAS, on September 17, 2017, the City Council authorized staff to create an ad-

recommendation to the City Council; and,
WHEREAS, on November 2, 2017, the ad-hoc committee met which consisted of

Council; and,
WHEREAS, the draft ordinance and map was re -distributed to the ad-hoc committee for
final review; and,
WHEREAS, on August 6, 2018, after holding a public hearing and considering public
testimony, the City Council finds that it is in the best interest of the City and its residents to
create truck routes within the City of Yakima; now, therefore
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. Chapter 8.40 of the Yakima Municipal Code is hereby added to read as
set forth in Exhibit "A" attached hereto and incorporated herein.
Section 2. Validity. If any section, subsection, paragraph, sentence, clause or
phrase of this ordinance is declared invalid or unconstitutional for any reason, such decision
shall not affect the validity of the remaining portions of this ordinance.
Section 3. This ordinance shall be in full force and effect 30 days after its passage,
approval, and publication as provided by law and by the City Charter, and after the required
signage is erected and maintained.

8.40.010 Definitions
For the purposes of this chapter, the following terms, phrases, words, and their derivations shall
have the meaning given in this section. When not inconsistent with the context, words used in
the present tense include the future, words in the plural number include the singular number,
and words in the singular number include the plural number. "Shall" is always mandatory and
not merely directory:
A. "City" is the City of Yakima.
B. "Deviating truck" is a truck which leaves and departs from a truck route while traveling
inside the City.
C. "Person" is any person, firm, partnership, association, corporation, company, or
organization of any kind.
D. "Truck" is any vehicle designed or operated for the transportation of property, and whose
body weight or whose combined body and load weight or whose rated capacity exceeds
15,000 pounds.
E. "Truck route" is a way over certain streets, as designated in this chapter, over and along
which trucks coming into and going out of the City must operate.
8.40.020 Application of Regulation
All trucks operating within the City only shall be operated over and along the truck routes
established in this chapter unless falling under an exception.
8.40.030 Exceptions
This chapter shall not prohibit:
A. Operation on Street of Destination. The operation of trucks upon any street where
necessary to conduct the business at a destination point, provided streets upon which
such traffic is permitted are used until reaching the intersection nearest the destination
point;
B. Emergency Vehicles. The operation of emergency vehicles upon any street in the City;
C. Public Utilities. The operation of trucks owned or operated by the City, public utilities,
any contractor or materialman, while engaged in the repair, maintenance or construction
of streets, street improvements, or street utilities within the City;
D. Detoured Trucks. The operation of trucks upon any officially established detour in any
case where such truck could lawfully be operated upon the street for which the detour is
established.

8.40.040 Truck routes established
A. There is established within the City the following truck routes
1. N/S 1St St — From the I-82/Hwy 12 Interchange south to the City Limits.
2. N 5th Ave — Between Fruitvale Blvd and MLK Blvd
3. N/S 16th Ave — From Hwy 12 south to Ahtanum Rd
4. N/S 40th Ave — From Hwy 12 south to W Washington Ave
5. S 64th Ave — Between Tieton Drive and Ahtanum Rd
6. W "I" St — Between N 1St St and N 6th Ave
7. Fruitvale Blvd — Between N 5th Ave and N 40th Ave
8. Summitview Ave — From N 40th Ave west to the City Limits
9. E/W Nob Hill Blvd — Between the east City Limits and S 72nd Ave
10. E/W Washington Ave — Between S 1St St and S 64th Ave
11. E Lincoln Ave — Between Fair Ave and N 5th Ave
12. E MLK Blvd — Between Fair Ave and N 5th Ave
13. Fair Ave — Between Lincoln/MLK Couplet and Nob Hill Blvd
14. Tieton Drive — From 40th Ave west to the City Limits

B. All trucks entering the City for destination points outside the City shall operate only over and
along the route designated in this section.
8.40.050 Truck traffic in the City
A. All trucks entering the City for a destination point or multiple destination points in the City
shall proceed only over an established truck route and shall deviate only at the intersection with
the street nearest to the destination point. Upon leaving the destination point, a deviating truck
shall return to the truck route by the shortest permissible route to proceed to the next destination
point or to leave the City.
B. All trucks, on a trip originating in the City, shall proceed by the shortest direction to an
established truck route.
8.40.060 Maps
The Public Works Director shall keep, maintain, and make available to the public accurate maps
setting out truck routes and streets upon which truck traffic is permitted.
8.40.070 Signage
The Public Works Director shall cause all truck routes to be clearly sign -posted to give notice
that this chapter is in effect.
8.40.080 Violation — Penalty
Violation of or failure to comply with any of the provisions of this chapter shall be punishable as
follows:

1. First violation is an infraction not to exceed $250.00
2. Second violation is an infraction not to exceed $500.00
3. Third and subsequent violations are punishable as a misdemeanor, with a fine not to
exceed $1,000.00, or by imprisonment for up to 90 days, or by both such fine and
imprisonment.

Dear Yakima Business Community Member:
On behalf of the Yakima City Council, your company's attendance is requested as part of a
discussion on the potential establishment of truck routes within the City of Yakima. The meeting
will be held on Thursday, November 2, 2017 at 3:00 p.m. in the Second Floor Conference
Room at City Hall in Yakima at 129 North Second Street. The City is inviting a wide variety of
business community members to discuss this topic and the meeting will not be televised.
At the September 20, 2017 Yakima City Council meeting, the Council authorized City staff to
create an Ad -Hoc Committee to review potential truck routes, gain feedback from effected
parties, and make final recommendations to the full City Council. The intent of this effort is to
ensure that City Council has an opportunity to hear from stakeholders as they are asked make
policy decision related to public safety, investments in streets and comprehensive planning.
The proposed agenda for the meeting is below. We anticipate a follow up meeting will be
scheduled based on your feedback within two weeks of the November 2nd meeting.

2. Review of Yakima Municipal Code as it relates to trucks and truck routes
3. Proposed truck route options
4. Truck route enforcement and signage
5. Feedback from participants

packet a week in advance of the meeting. The Yakima City Council has made it very clear that
they want feedback from the business community before advancing any proposal on truck
routes. We hope you or a company representative can attend.

With the language in the draft, 96th would be allowed as the route to access your warehouses. The language below
Is from the draft:
A. All trucks entering the City for a destination point or multiple destination points in the City
shall proceed only over an established truck route and shall deviate only at the intersection

deviating truck shall return to the truck route by the shortest permissible route to proceed to

Thanks for the opportunity to give input.
Borton Fruit has trucks hauling fruit East on Summitview and turn south on 96th to Wide Hollow rd.
Could 96th be included as a truck route? Or is it Ok for Borton trucks to use that route on the way to
our warehouse? It does not appear to be OK for Borton trucks to use 96th the way the ordinance
currently reads.
Also it appears to me that, Yakima Ave east to terrace heights and Nob hill to Highway 24 probably
should be included as truck routes on the map for clarity.

Thanks for the nfo Sean, t doesnt appear that Rver Rd, between 16th and 6tH ave. s desJgnated as
a truck route, This section of River Rd. is used daily by trucks delivering bins of fruit to our facility,
and trucks picking up packed product. As you may remember, Washington Fruit partnered with the
City of Yakima to wideri and recoristruct tbis stretcb of River Rd, to accommodate iricreased truck
traffic As such, it should be definitely be designated as a truck route in the municipal code. Please
advise what action, if any, Washington Fruit needs to pursue to make this happen.
