HomeMy WebLinkAbout04-12-17 YPC MinutesCity of Yakima Planning Commission (YPC) City Hall Council Chambers Meeting Minutes of April 12, 2017 Call to Order Chairman Scott Clark called the meeting to order at 3:00 p.m. Roll Call YPC Members Present: Chairman Scott Clark, Vice -Chair Patricia Byers, Bill Cook, Al Rose, Peter Marinace, Gavin Keefe, Jacob Liddicoat YPC Members Absent: Staff Present: Joseph Calhoun, Planning Manager; Jeff Peters, Senior Planner; Lisa Maxey, Planning Specialist Others: Sign -in sheet in file New YPC Member Introduction Chairman Scott Clark introduced the newest Planning Commission member, Jacob Liddicoat. Liddicoat expressed his interest in serving on the Commission. Staff Announcements Senior Planner Jeff Peters announced that he will be leaving his job at the City of Yakima with his last day being April 21st. Commission members expressed their thanks to Peters for his work. Audience Participation None noted. Approval of Meeting Minutes of March 22 2017 Commissioner Byers motioned to approve the meeting minutes of March 22, 2017. The motion was seconded by Commissioner Rose and carried unanimously. Public Hearin - "Apple Tree Development Phase 4" PLP#002-13 & SEPA#024-13 Jeff Peters provided a summary of the staff report. He corrected the first condition listed in the staff report to change the wording from "barrier curb" to "rolled curb," and added to the end of the condition, "...street design as ap_prowed by the City Engineer." Mike Heit of HLA Engineering & Land Surveying, Inc., applicant for this project, voiced that he would like the recommendation to City Council to include that private gated roads will be allowed once a development agreement has been approved by the city. Commissioner Rose inquired about access to Ahtanum Road from the plat, to which Mike Heit answered that there is an existing connection through Ridge Way which will be improved. Discussion ensued regarding the proposed emergency access road, the applicant's intent to have public streets in the preliminary plat and then change it to private streets on the final plat after a development agreement has been approved, and the maintenance of water and sewer for the plat. After allowing the opportunity for public comment and receiving none, Chairman Clark closed the public testimony. Peters requested that the Commission consider amending the 17th condition listed in the staff report to say, "the developer shall submit and record a city -approved development agreement to provide for the rivate streets within this development prior to submittal of the final plat," in order to further establish the intent of the applicant to ultimately have -1- the streets be private. Peters went on to describe what a development agreement is and that it is needed in order to allow private streets. Bob Desgrosellier, Senior Engineer for the city, provided further clarification of the requirements in Title 12 of the Yakima Municipal Code as it relates to barrier curb vs. rolled curb. Commissioner Marinace recused himself from the vote. Vice -Chair Byers motioned to approve the findings of fact and recommendation with the changes to condition 1 and condition 17 as discussed at this meeting and forward it to the City Council for consideration. The motion was seconded by Commissioner Rose and carried unanimously. Comprehensive Plan 2040 Update Process Follow-up Discussion on Critical Area/Shoreline Regulations Update: Best Available Science Recommendations Planning Manager Joseph Calhoun presented the revised language to the Floodway Fringe Uses section regarding new encroachments. The Commission requested that the Floodplains map be revised to say "floodway fringe" next to zones AE and A in the legend for better clarification. Audience member Joe Walsh of the Central Washington Home Builders Association made the suggestion to strike out the last sentence in the definition of "fish and wildlife habitat conservation" from the draft document, to which Calhoun and the Commission members agreed. Walsh then expressed his concerns with requiring a study to be conducted for new encroachments on the floodway fringe areas to which Calhoun responded by explaining the purpose of that requirement. Discussion ensued pertaining to the process for nominating new species and habitats of local importance, the comments in the draft document about the city's current water -typing system, questions regarding stream designation, the inclusion of comments in the draft document concerning vegetative buffers that are based on a study not yet finalized, the option to leave out the language regarding the development of a Public Agency and Utility Exception (PAVE), and the suggestion from Walsh to include in the definitions section a detailed definition of Best Available Science. To wrap up this item, Calhoun gave a reminder that the Planning Commission public hearing for the Comprehensive Plan 2040 update is scheduled for May 10th, and informed the Commission that all the draft documents they have reviewed will be combined into one binder for the hearing. The Commission requested a study session on the Transportation Systems Plan at the next meeting.
