For Meeting of: July 10, 2018 Resolution of the Yakima City Council providing for the submission to the qualified voters of the City of Yakima on the regular general election to be held November 6, 2018, a ballot measure seeking an advisory vote on the question of whether the City should construct a community plaza on Parking Lot No. 2 directly west of the Capitol Theater SUBMITTED BY: Jeff Cutter, City Attorney SUMMARY EXPLANATION: During the June 19, 2018 City Council meeting, the City Council approved a motion to submit the question of whether the City should construct a community plaza on Parking Lot No. 2 directly west of the Capitol Theater to an Advisory Vote of the qualified voters of the City during the November 6, 2018 general election. The Council further directed staff to prepare an advisory vote ballot measure consistent with that direction for Council consideration. The attached resolution, if approved by the City Council, will be submitted to the Yakima County Auditor on or before August 7, 2018. The Auditor will then submit the attached Advisory Vote No. 1 to the qualified voters of the City on the November 6, 2018 general election ballot. R -2018- A RESOLUTION of the City Council of the City of Yakima, Washington, providing for the submission to the voters of the City of Yakima a ballot measure seeking an advisory vote asking whether the qualified voters of the City of Yakima support the development of a community plaza on City Parking Lot No. 2 directly west of the Capital Theater; and requesting the Yakima County Auditor to submit the ballot measure to the voters at the regular general election to be held November 6, 2018. WHEREAS, an advisory ballot measure may be initiated by the City Council through the approval of a resolution requesting that the Yakima County Auditor submit the ballot measure to the qualified voters in the City to decide whether the City should construct a community plaza on the property currently identified as Parking Lot No. 2 directly west of the Capital Theater; and WHEREAS, the City Council desires to hold an election in the City of Yakima on the regular general election date of November 6, 2018, for the purpose of submitting to the qualified voters of the City a ballot measure seeking an advisory vote on the question of whether or not the City should construct a community plaza on City Parking Lot No. 2 directly across from the Capital Theater; and WHEREAS, the City Council finds and determines that the best interests and general welfare of the City of Yakima would be served by submitting to the qualified voters in the City the ballot measure seeking an advisory vote as described above and as set forth below; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: 1. The ballot measure to be submitted at the November 6, 2018 general election shall be in the form of a ballot title as follows: ADVISORY VOTE NO. 1 ADVISORY VOTE REGARDING CONSTRUCTION OF A COMMUNITY PLAZA ON PARKING LOT NO. 2 DIRECTLY WEST OF THE CAPITAL THEATER ADVISORY VOTE NO. 1 submits a question to the qualified voters of the City of Yakima asking whether the City of Yakima should construct a community plaza on the City's Parking Lot No. 2 directly west of the Capital Theater. Should the City of Yakima construct a community plaza on City Parking Lot No. 2 directly west of the Capital Theater? 2. The City Clerk is authorized and directed to file a certified copy of this resolution with the Yakima County Auditor. 3. The Yakima County Auditor is requested to call and conduct an election to be held in the City of Yakima on the regular general election day of November 6, 2018, for the 1 4 purpose of submitting to the qualified voters of the City of Yakima the Advisory Vote set forth in Section 1 above. 4. Severability. If any section, sentence, clause or phrase of this resolution should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this resolution.
