For Meeting of: July 10, 2018 ITEM TITLE: Resolution ratifying the declaration by the City Manager of an emergency and authorizing execution of all applicable contracts for the repair of stormwater infrastructure at 6600 West Nob Hill Boulevard SUBMITTED BY: Mike Price, Stormwater/Wastewater Manager 249-6815 Scott Schafer, Director of Public Works SUMMARY EXPLANATION: In May of this year, water from a broken and blocked underground City of Yakima (City) stormwater pipe at the northwest entrance to the Walmart Shopping Center at 6600 Nob Hill Boulevard, created an emergency situation with threats to public safety and property damage by undermining a traffic signal pole, sidewalk, and roadway. The blockage was also putting private and public property at risk by causing intermittent flooding at stormwater manholes located further upstream. The pipe was a former Yakima County drainage improvement district (DID) pipe that has been incorporated into the City's stormwater conveyance system. The Stormwater Division followed the City's Emergency Purchasing Policy in immediately contracting for the emergency repair of the stormwater pipe to restore normal drainage and preserve the integrity of the signal pole, sidewalk, and roadway. The City originally obtained $1.4 million from Yakima County upon transfer of ownership of the DID system to the City from Yakima County. Funds recognized from this transfer will be utilized to cover the cost for this emergency repair and is available in the Stormwater Capital Fund (442). R -2018 - ratifying the declaration by the City Manager of an emergency and authorizing the City Manager to execute all applicable contracts for the repair of stormwater infrastructure at 6600 West Nob Hill Boulevard. WHEREAS, Article VI, section 6 of the City of Yakima Charter and the Yakima Municipal Code Chapter 1.80 provide that the City Council may declare an emergency dispensing with the necessity for bidding for services, material, and equipment and supplies costing more than $25,000; and WHEREAS, water from a broken and blocked city underground stormwater pipe was causing intermittent flooding and had undermined a traffic signal pole, sidewalk, and roadway at the northwest entrance to the shopping center at 6600 West Nob Hill Boulevard; and WHEREAS, an emergency existed because the flooding and undermined infrastructure created an immediate threat to public safety and failure to repair the stormwater pipe and restore normal drainage would have further increased the risk to public safety, flooding, and material damage to the signal pole, roadway, and sidewalk if immediate action was not taken; and WHEREAS, an emergency was declared by the City manager on May 15, 2018 in order to expeditiously repair the stormwater pipe and restore the undermined infrastructure; and WHEREAS, the formal bid process would have taken approximately three months, which would continue to put property and the public at risk; and WHEREAS, the City Council deems it to be in the best interest of the City and its residents to ratify the City Manager's declaration of an emergency and authorize the execution of all necessary documents and contracts for the labor and materials for the repair of the stormwater infrastructure at 6600 Nob Hill Boulevard, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The emergency is hereby ratified, the City Council resolves that there is an emergency, and the City Manager's execution of all appropriate documents for the labor and materials for the repair of stormwater infrastructure at 6600 Nob Hill Boulevard without calling for bids, is hereby ratified and approved.
