I, Cliff Moore, being of full and lawful age, hereby accept the offer made by Yakima County, to
pay the City of Yakima Two Thousand Fifty -Five Dollars and Eighty Cents ($2,055.80) to settle Claim No.
18-2018. Claim No. 18-2018 was filed to seek reimbursement for the cost to repair fencing at the Yakima
Airport after it was damaged by a recycling bin on April 16, 2018, (the "Incident").
I understand that Yakima County, Washington Counties Risk Pool and all persons or parties
released by this Agreement deny liability regarding the Incident, and that Yakima County's offer to
settle the City of Yakima's claim and Yakima County's offer and payment of Two Thousand Fifty -Five
Dollars and Eighty Cents ($2,055.80) to the City of Yakima according to this Agreement is not an
admission of liability by Yakima County, Washington Counties Risk Pool or by any other person or
party released by this Agreement, and the settlement and release established by this Agreement is an
agreed compromise between Yakima County, Washington Counties Risk Pool and the City of Yakima
regarding the Incident. This Agreement shall not, to any extent, be admissible against Yakima County,
Washington Counties Risk Pool or any person or party as an admission of any liability and/or fault
regarding the Incident.
The City of Yakima shall become entitled to Yakima County's payment of Two Thousand Fifty -
Five Dollars and Eighty Cents ($2,055.80) after I return this Agreement, signed by me and by a witness to
my signature, to Yakima County.
In exchange for and in consideration of Yakima County's payment of Two Thousand Fifty -Five
Dollars and Eighty Cents ($2,055.80) according to this Agreement, the City of Yakima hereby releases
and forever discharges Yakima County, Washington Counties Risk Pool and all employees, agents, and
officials, their heirs, successors, administrators, or assigns, from any and all actions, causes of actions,
liability, claims, demands or damages, known or unknown, which have been or may in the future be
sustained by the City of Yakima as a result of the Incident.
I further acknowledge and agree that after Yakima County pays the City of Yakima Two
Thousand Fifty -Five Dollars and Eighty Cents ($2,055.80) according to this Agreement, the City of
Yakima shall stand in full accord with Yakima County, Washington Counties Risk Pool and all persons
or parties released by this Agreement, and the City of Yakima's claim related to the Incident shall be
fully satisfied and forever settled, and the City of Yakima shall never seek any additional compensation
for the Incident from Yakima County, Washington Counties Risk Pool or any person or party released by
this Agreement.
By signing this Settlement and Release Agreement, I certify under penalty of perjury under the
laws of the State of Washington that I have thoroughly read and understand this Settlement and Release
Agreement, and have signed it as my free and voluntary act and deed for the uses and purposes stated.
