ITEM TITLE: Resolution adopting the City Council's Findings of Fact denying
the Yakima Planning Commission's recommendation regarding text
amendments to YMC Title 15 modifying the definitions and
classification for Congregate Living Facility and Motel/Hotel

SUMMARY EXPLANATION:
On May 1, 2018, staff presented the Planning Commission's recommendation to approve certain
text amendments to YMC Title 15. After public hearing and deliberation, a motion was made a
seconded to deny the proposed Ordinance - the motion carried 6-1. In accordance with YMC
16.10.090(3), the planning division has prepared written findings based on the May 1, 2018
Council decision.

denying the recommendation of the Yakima Planning Commission related to a
text amendment to the Yakima Municipal Code, Title 15, Zoning Ordinance,
regarding definitions and classifications for Congregate Living Facility and
Motel/Hotel,
WHEREAS, a written request to the City Hearing Examiner in 2017 for a zoning use
interpretation resulted in a formal determination (INT#001-17) that the City of Yakima did not have an
appropriate use category to address Temporary Worker Housing and directed staff to forward the
issue to the Yakima City Planning Commission for deliberation; and
WHEREAS, the Yakima City Planning Commission conducted study sessions on January 24,
2018, February 14, 2018, and February 28, 2018 as well as an Open Record Hearing on March 28,
2018 all of which had appropriate public notice, robust discussion and public testimony; and
WHEREAS, the City Planning Commission forwarded an Ordinance including the
recommended amendment to the Yakima City Council for consideration as a result of the required
legislative process; and
WHEREAS, the Yakima City Council conducted an open record hearing on May 1, 2018 to
review the public record, receive testimony and deliberate the recommendation of the Yakima City
Planning Commission regarding an amendment to the Municipal Code YMC 15.02.020 Zoning
Ordinance Definitions, YMC 15.04.030 Land Use Table 4-1 amendments , and YMC 15.06.040
Parking Table 6-1 amendments; and
WHEREAS, at the Yakima City Council Public Hearing on May 1, 2018, the Yakima City
Council expressed support for the agricultural industry in the Yakima Valley, but noted an overall
concern for affordable housing, the amount of housing available for residents and farmworkers, and
locational issues related to special housing; and
WHEREAS, the Council expressed concern regarding how development of congregate living
facilities fit into the strategic plan for arterial entrances to the City of Yakima, such as North 1St Street,
and how business development would be impacted in zones where both congregate living facilities
and commercial business would be allowed; and
WHEREAS, the Yakima City Council after due consideration of public testimony, review of the
record and deliberation, determined that additional review and alternative approaches were desirable;
therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The Yakima City Council denied the recommendation of the Yakima City Planning
Commission on May 1, 2018 related to the matter of an amendment to the Municipal Code regarding
this issue and directed the City Manager to refer the record to a Yakima City Council study session
to include various experts on this topic.
