R-2018-026 A RESOLUTION authorizing extension of policy regarding temporary emergency cold weather shelters to temporary shelters falling under RCW 35.21.915, and providing that such policy shall be valid only from March 15, 2018 through June 30, 2018 WHEREAS, the City of Yakima, in conjunction with a non-profit faith -based entity and Yakima Valley Conference of Governments, is aware that there is within the City of Yakima a population of homeless persons who continue to require temporary shelter; and WHEREAS, owners of various buildings, which may include churches or buildings owned or controlled by faith -based organizations, located within the City of Yakima have indicated that they are willing and able to provide temporary shelter to homeless persons and families, and WHEREAS, the City of Yakima currently has no municipal code provisions, whether under the zoning, buildings, fire or other codes, expressly allowing, authorizing, or regulating the use of such structures by religious organizations as temporary shelters, and WHEREAS, RCW 35.21 915 may apply to temporary homeless shelters and/or encampments if owned or controlled by a religious organization, and WHEREAS, the City of Yakima Community Department of Community Development has endeavored to create interim policy guidelines to address and regulate temporary emergency shelters and health and safety issues that may arise in their operation which also can be applied to temporary shelters occurring during other periods of the year when necessary and appropriate, and WHEREAS, this policy extension applies to the current temporary shelter located at 1702 Englewood Avenue, operated by Transform Yakima Together and the youth shelters currently operating at two churches and facilitated by Rod's House, and WHEREAS, the Yakima City Council finds and determines that it is in the public interest, and the best interest of the City and its residents, to adopt the resolution and policy guidelines set forth herein BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City of Yakima Department of Community Development is hereby authorized and directed to implement the policies listed herein and require all operators of temporary shelters through June 30, 2018. Policies shall include the following, and must be re -certified by the owner or legal occupier of each building on or before March 15, 2018 by the Fire Marshal. 1 Sleeping areas shall be located on the ground floor of the building or on other floors with approved exiting, 2 Smoke detectors shall be located in all sleeping areas and connected to a central station monitor; 3 No cooking is allowed on the premises, unless done in an approved commercial kitchen, 4 The on-site staff ratio shall be one staff member per eight overnight guests, 5 If there is no adequate fire suppression system, staff members must remain awake and alert throughout the night, serving as a night fire watch, 6 The owner or legal occupier of the building shall provide an updated floor plan showing the dimensions of the building, including exits and door swing, more than 72 hours before the first night of occupation, and shall update that floor plan if changes are made, 7 Organizations not falling under RCW 35 21 915 shall provide proof of adequate insurance, 8 Any other health and safety requirements determined necessary by the fire marshal or building code officials based on the building(s) to be used as temporary homeless shelters under this resolution, and 9 Access shall be granted to the Fire Marshal at all times the facility is open to homeless persons ADOPTED BY THE CITY COUNCIL this 6th day of March, 2018 ATTEST Sonya r Tee, City Cler BUSINESS OF THE CITY COUNCIL YAKIMA, WASHINGTON AGENDA STATEMENT 1 Item No. 12. Transform Yakima Together seeks to extend these interim policy guidelines through June 30, 2018, which is the date through which it has received funding from YVCOG to run a temporary homeless shelter. This resolution extends the rules and regulations outlined by Council in its November 2017 resolution. I am not against a shelter for homeless, but I am against the establishment being in a residential area with small business. I am against lawlessness and enabling people to remain in a place of disparity Since Camp Hope moved in behind the church, we have had our cars broken into, car prowls, a person camping on our site moving wooden pallets and sleeping bag to make a make shift home, because he was turned away from camp hope Garbage and trespassing is constant. We have caught people urinating in public and jumping the fence behind the church We have had several come in to sleep on the back bench and hold up in our church bathrooms. Our elderly women are afraid to go to and from their cars for service, because there are several people hanging out outside of camp hope and around our cars. The bus stop in front of the property seems to be a place to hold up even when not waiting for a bus. We have called Camp Hope and no one called us back. This is a neighborhood that should not have to deal with 150+ people added in coming and going. To worry about your children and property is constant in this town and now it is even more so in this area I think we have forgotten that some of these homeless are criminals. Can Camp Hope guarantee that the ones staying in their facility are not sex offenders or violent. No this is not something they can assure the public. Is the staff at Camp Hope trained to deal with the lawlessness? How since there seems to be no presence of staff on the outside of Camp Hope and I have not witnessed any kind of patrols by Camp Hope? With the ongoing presence of Camp Hope, our property values will decrease in value No one will want to move into the neighborhood For example, look at the properties now on the end of north first, where the UGM is. Those properties have deteriorated and are run down due to the draw of the Mission Again a good idea only a few people right. Well now there are many vacant properties and the corridor to the City looks pitiful My question is why is Camp Hope not working with the UGM and is this just a place to draw the more lawless away from the City corridor in order to beautify Yakima? This is worrisome and the voice of this neighborhood was not heard are cared to be heard before this camp was placed here I am for helping those in need, it's the right thing. However, a facility that will hold 150+ people in a neighborhood area is not a sound decision What about the impact on the people and business that are in the area? What kind of study has been done? My concern is that once this is made permanent place they will want to increase the bed count form 150 now to maybe 200, next year After all, if I can live for free, eat for free, have free medical care, while I keep my SSI and Food stamps to support my other habits or sell, then why not live at Camp Hope My ex sister -in Law, Juanita Scott, overdosed at the tent City, she died My Nephew a recovering addict now in treatment, stated the homeless encampment was the best place to go to sell or buy drugs. The problem is bigger than being homeless, its about mental health, drug addiction and enablement of people to stay in those places. I am not saying we should not do something as a community, after all we use to have the farm labor camps and we have always had several missions in town I do think there should be a facility but not in a neighborhood on Englewood avenue, where you put children and other members of the community at risk. (509) 457-1515 - Fax: (509) 457-1027 Yakima City Council March 6, 2018 Page - 2 The Yakima Herald Republic is currently reporting that the City Council may vote so as to allow the Camp Hope homeless shelter to continue operating on a temporary basis through June 30, 2018 In that regard, the Herald Republic notes that the City's hearing examiner recently issued a decision that approves (subject to conditions, which have not yet been met) a permanent homeless shelter at the Englewood location. Please be advised, our clients intend to, and will, appeal the hearing examiner's decision later this week (prior to expiration of the appeal deadline) The purpose of this letter is not to argue merits of our clients' forthcoming appeal of the hearing examiner's decision. Rather, the purpose of this letter is to put the City Council on notice of the forthcoming appeal and to request that the City Council not rely upon the hearing examiner's decision given that an appeal thereof will soon be filed. The hearing examiner's decision is only a first -level, preliminary decision. When our clients' appeal is filed, the hearing examiner's decision will be placed in abeyance. It is far from certain that the hearing examiner's decision will be upheld on appeal, either in full or in part. The City Council, as the legislative body that will hear and decide the appeal, may ultimately reverse the hearing examiner's decision, may impose additional or different conditions, and/or may remand the matter downward for another public hearing, submission of additional evidence and issuance of a new decision by the hearing examiner Accordingly, it would simply not make sense for the City Council to rely upon the soon -to -be -appealed hearing examiner's decision at this point. Only a final decision (either not timely appealed or upheld after all appeals are exhausted) should be relied upon. Such a decision does not yet exist. Another purpose of this letter is to argue, more generally, that any extension of the "temporary" status of the Camp Home homeless shelter would be a poor policy choice by the City Council. As stated above, the location has been used thus far on an "emergency cold weather" basis This is critically important to understand. By operating thus far on an emergency cold weather basis, Transform Yakima Together has been allowed to ignore and sidestep the myriad improvements and alterations that are necessary in order to bring the location into compliance with the Municipal Code and to otherwise make it safe and secure (which improvements and alterations are summarized in the hearing examiner's decision) But the cold -weather season is over, or essentially over Accordingly, Transform Yakima Together should not be allowed to ignore and sidestep the necessary improvements and alterations any longer Approving the resolution in question would effectively negate any practical distinctions between emergency versus non -emergency status and temporary versus non -temporary status. This is no longer a cold -weather, emergency situation. Rather, it is simply a situation where Transform Yakima Together wants to continue operating — on a supposed "temporary" basis — for several additional months (or perhaps longer) and without completing (or even beginning) the necessary improvements and alterations. This should not be allowed.
