For Meeting of: January 16, 2018 ITEM TITLE: Resolution declaring an emergency due to an impending landslide SUBMITTED BY: Pat Reid, Deputy Fire Chief SUMMARY EXPLANATION: Adoption of this resolution places the City of Yakima and its personnel and resources in a heightened state of preparedness to support, if necessary, Yakima County and the City of Union Gap with the land movement issue on Rattlesnake Ridge. Additionally, in a worst case scenario, the City of Yakima would be better poised for response and mitigation activities - should the slide represent a threat to the City and its residents. R -2018- A RESOLUTION declaring an emergency in the City of Yakima, Washington due to an impending landslide WHEREAS, the City of Yakima has been notified by the Yakima Valley Office of Emergency Management of a large land movement on Rattlesnake Ridge in Yakima County near Union Gap, Washington (referred to in this Resolution as the "Rattlesnake Hills landslide" or the "landslide"); WHEREAS, the size and complexity of the landslide, both presently and potentially, could exceed the emergency response capabilities of the City of Union Gap and Yakima County; WHEREAS, the City of Yakima has the potential to be impacted by the indirect consequences of the landslide; and WHEREAS, the City of Yakima is willing to assist the City of Union Gap and Yakima County regarding the landslide, as requested by the City of Union Gap and Yakima County; and WHEREAS, the ongoing and future impacts of the landslide could result in the City of Yakima committing significant resources in response to the emergency; and WHEREAS, there is an emergency present that necessitates the activation of the Yakima County Comprehensive Emergency Management Plan, and use of statutory emergency powers granted pursuant to RCW 38.52.070 to protect life and property of residents, and to support the ongoing emergency response efforts, as requested, and to mitigate potential damages; and WHEREAS, pursuant to applicable law, including without limitation Chapter 6.06 of the Yakima Municipal Code, state law and general police powers vested in the City through applicable law, the City Council believes it is in the best interests of the City to declare an emergency; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: 1. The City Council of the City of Yakima declares and proclaims an emergency relating to the landslide. 2. The City Manager is authorized to request any state or federal assistance needed to meet the demands of the emergency, as the City of Yakima may be in need of economic assistance from available state and federal sources for expenses associated with response to the landslide. 3. This declaration of an emergency shall be in effect for sixty days after the date below, unless rescinded sooner or extended by the City Council.
