Roll Call Council: Mayor Kathy Coffeypresiding, Assistant Mayor Carmen Mendez, Council Members Maureen Adkison, Holly Cousens, Avina Guterrez (arrived at 7:15 p.m. for item 11 and departed at 7:25 p.m.), Dulce Gutierrez and Bill Lover Staff: City Manager Moore, City Attorney Cutter and City Clerk Claar Tee 2. Pledge ofAllegiance Mayor Coffey led the Piedge ofAllegiance. 3. Interpreter Services Mayor Coffey introduced Jorge Vi||ooenorwho announced interpreter services are available. 4. Open Discussion for the Good of the Order A. Proclamations World Aids Day proclamation Mayor Coffey proclaimed December 1, 2017, as "World AIDS Day" and Jon Penfold accepted it. B. Presentations / Recognitions /Introductions Introduction of new Assistant City Manager Ana Cortez -Steiner City Manager Moore introduced Ana Cortez -Steiner as the new Assistant City Manager for the City of Yakima. ii Recognition of Randy Beehler, Communications & Public Affairs Director, for 25 years of service Mayor Coffey announced they have an item to add under Good of the Order. She stated the City Council would like to recognize Randy Beehler, Communications & Public Affairs Director, Administration of Oaths of Office to Judge Woodard and Judge OIwelI City Clerk Clear Tee administered the Oaths of Office to Judge Woodard and Judge Olwell. Page 1 of 6 221 5. Council Reports Council Member Lover stated he would like to take care of some outstanding business on the Nominating Committee. MOTION: Lover moved and Cousens seconded to appoint Luis Lopez to the Planning Commission to serve the remainder ofaterm ending June 2818. The motion failed by a 4-2 vote, Coffey, D. Gutierrez, Adkison, and Cousens voting no, A. Gutierrez absent. MOTION: Coffey moved and Cousens seconded to move this item to the December 12, 2017 meeting. The motion carried by unanimous vote, A. Gutierrez absent. 6. Consent Agenda Mayor Coffey referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from Council members present. There were no changes. The City Clerk read the Consent Agenda items, including resolutions and ordinances, by title. (Items on the Consent Agenda are handled under one motion without further discussion—see motion directly below.) MOTION: Mendez moved and Adkison seconded to approve the consent agenda. The motion carried by unanimous vote, A. Gutierrez absent. A. Approval of the minutes from the November 7 and 21, 2017, City Council Business meeting and November 16, 2017, City Council Briefing B. Project Completion and Contract Acceptance for Stephens & Sons Construction, Inc. - Pject 2399 Washington Fruit Community Center Phase 3 (Standard Motion V -B -Accept the Project and Approve) C. 3rd Quarter 2017 Treasury Report O. Resolution authorizing certain uncollectable parking citations to be written off RESOLUTION NO. R-2017-145, A RESOLUTION authorizing the write-off of certain uncollectable parking citations and penalties for the City of Yakima. E. Resolution authorizing certain uncollectable central accounts receivables to be written -off RESOLUTION NO. R'2017'146. A RESOLUTION authorizing the write-off of certain uncollectable central accounts receivables for the City of Yakima. F. Resolution authorizing the write-off of certain uncollectable utility accounts receivable RESOLUTION NO. R-2017-147, A RESOLUTION authorizing the write-off of certain uncollectable accorts receivable by the utility funds of the City of Yakima. G. R-2017-148, A RESOLUTION fixing time for a public hearing before the Page 2 of 6 222 right-of-way in the vicinity of North 18th Ave and Roosevelt Ave. H. Resolution authorizing an agreement with M -B Companies, Inc. to provide required Snow Removal Equipment for the Yakima Air Terminal -McAllister Field RESOLUTION NO. R-2017-149, A RESOLUTION authorizing the execution of an agreement with M -B Companies, Inc. to provide required Snow Removal Equipment for the Yakima Air Terminal -McAllister Field. I. Resolution authorizing 911 Support Services Interlocal Agreement with the City of Yakima and Yakima County RESOLUTION NO. R-2017-150, A RESOLUTION authorizing execution of the "911 Support Services Agreement" with Yakima County for the provision of 911 services. J. Resolution accepting the City of Yakima's 2018 assessment from the Yakima Valley Conference of Governments, and authorizing payment of the annual dues RESOLUTION NO. R 2017-151, A RESOLUTION accepting the 2018 Yakima Valley Conference of Governments Budget and authorizing the City of Yakima's 2018 assessment. 7. Public Comment Kelly Penfold, City resident, requested more sidewalks in the City. James Turner, City resident, requested speed humps in the vicinity of the 1700 block of Cornell Avenue. Kristin Callahan, City resident, spoke on several topics including spending less and making Yakima beautiful. Tom Clayton, City resident, recognized Public Works Director Scott Schafer for his outstanding work and presented him with a certificate of excellence. Tom McCormick, City resident, expressed his condolences for Lucille Deccio and thanked Council for their work. He presented Council with chocolate bars. PUBLIC HEARINGS 8. Second public hearing on the 2018 Preliminary Budget for the City of Yakima Financial Services Manager Lewis briefed Council on the second hearing for the preliminary budget. Mayor Coffey opened the public hearing and, with no one coming forward to speak, closed the hearing. Ms. Lewis noted the budget will be brought back at the December 12, 2017 Council meeting for adoption. 9. Closed record public hearing and Ordinance to consider the Yakima Planning Commission's recommendation regarding a non -project rezone submitted by Jay Sentz for property at 4201 Summitview Ave Joseph Calhoun, Planning Manager, briefed Council on the rezone. Mayor Coffey opened the public hearing. Will Halpin, City resident, stated he and 53 other neighbors are against the rezone. Bill Hordan, City resident, spoke in favor of the rezone. With no one else coming forward to speak, Page 3 of 6 223 Mayor Coffey closed the hearing. The City Clerk read the ordinance by title only. MOTION: Mendez moved and Adkison seconded to pass the ordinance. The motion carried by a 4-2 vote, D. Gutierrez and Lover voting no, A. Gutierrez absent. ORDINANCE NO. 2017-031, AN ORDINANCE rezoning parcel 181322-24445 from Single Family Residential (R-1) to Small Convenience Center (SCC) and amending the Zoning Map of the City of Yakima. DEPARTMENT ITEMS 10. Ordinance amending the 2017 Budget and making appropriations from unappropriated balances for expenditure during 2017 (First Reading) Tara Lewis, Financial Services Manager, briefed Council on the budget amendment. The City Clerk read the ordinance by title only. Ms. Lewis stated this will be brought back for a second reading and approval at the December 12, 2017 meeting. CITY MANAGER UPDATE 11. Ordinance amending Chapter 5.50 of the City of Yakima Municipal Code eliminating the current cap on utility tax Tara Lewis, Financial Services Manager, briefed Council on the ordinance noting this only affects large businesses paying over $200,000 a month in utility services. The City Clerk read the ordinance by title only. MOTION: D. Gutierrez moved and Cousens seconded to pass the ordinance. The motion carried by a 6-1 vote, Lover voting no. ORDINANCE NO. 2017-032, AN ORDINANCE relating to business regulations and utility taxes; amending Sections 5.50.050 and 5.50.055 of Chapter 5.50 of the City of Yakima Municipal Code eliminating the outside utility tax "caps" on companies in the business of selling or furnishing natural gas, electric light or power, cellular telephone services and telephone services and eliminating the cap on brokered natural gas use tax. 12. Ordinance establishing an annual vehicle license fee; and fixing a time when the same shall become effective Bronson Faul, Senior Assistant City Attorney, briefed Council on the vehicle license fee. Joey Anderson, City resident, spoke against the ordinance. The City Clerk read the ordinance by title only. After Council discussion, MOTION: D. Gutierrez moved and Adkison seconded to pass the ordinance. The motion carried by 4-2 vote, Lover and Cousens voting no., A. Gutierrez absent. ORDINANCE NO. 2017-033, ORDINANCE of the City of Yakima, Washington establishing an annual vehicle license fee; and fixing a time when the same shall become effective. 13. Ordinance to consider the purpose, administrative, and operational components to establish a Page 4of6 x�� ����u� permanent Community 1 nteg ration Committee Sara Watkins, Senior Assistant City Attorneybriefed Council on the ordinance noting there is an alternate urdinanoe, which has membership at a four-year term instead of a two-year term to be consistent with other committees. Council Member Lover stated he would like to see the members be from each district. Aileen Kane, spoke in support of the ordinance. The City Clerk read the ordinance by title only. After Council discussion, MOTION: D. Gutierrez moved and Cousens seconded to pass the alternate ordinance with the four-year term. MOTION: Lover moved and Adkison seconded to amend the motion to have the seven members be from each district. The motion to amend failed by a 3-3 vote, D. Gutierrez, Mendez and Coffey and voting no, A. Gutierrez absent. The motion to pass the alternate ordinance with a four-year term carried by unanimous vote, A. Gutierrez absent. ORDINANCE NO. 2D17-034/\NORDINANCE adding Section 1.34:Community Integration Committee, to the City of Yakima Municipal Code. 14. Downtown Parking Meters Danny Agsalog,OirectorofFinanceandBudge.bhefedCounc|onthedowntownparNng meter issue. Joe Mann, City resident, does not disagree that there should be some form of charge for parking; however, he believes this issue should be discussed with the Downtown Association of Yakima before moving forward, Andrew Ho|t, Executive Director of the Downtown Association of Yakima, requested the Association be included in the conversation on this issue. Mayor Coffey stated she would like to engage the Downtown Association of Yakima on this topic and is not ready to take action on this issue at this time. 15. Naches Parkway Evaluation and Discussion Due to the absence of Council Member A. Gutierrez and her involvement on this issue, it was Council consensus to move this item to the next meeting. 16. Other Business 17. Adjournment MOTION: Mendez moved and Cousens seconded to adjourn to a Special Council Business Meeting on December 7, 2017, at 8 a.m. at the City Training Facility - 421 E. Chestnut Avenue. The rrtion carried by unanimous vote.
