Executive Session regarding pending litigation Council: Mayor Pro Tem Carmen Mendez, presiding, Council Members Maureen Adkison, HoUyCousmnm. Dulce Gutierrez and Bill Lover Absent: Mayor Kathy Coffey (excused) and Council Member Avina Gutierrez (excused) MOTION: D. Gutierrez moved and Adkison seconded to adjourn to Executive Session for up to 60 minutes to discuss pending litigation. The motion carried by unaninus vote, Coffey and A. Gutierrez absent. Executive Session was held and adjourned at 5:25 p.m. BUSINESS MEETING 1. Roll Call Council: Mayor Pro Tem Carmen Mendez, presiding, Council Members Maureen Adkison, HoUyCouoons. Dulce Gutierrez and Bill Lover Staif: City Manager Moore, City Attorney Cutter and City Clerk Claar Tee Absent: Mayor Kathy Coffey (excused) and Council Member Avina Gutierrez (excused) 2. Pledge of Allegiance Mayor Pro Tem Mendez led the Piedge of Allegiance. 3. Interpreter Services Mayor Pro Tem Mendez introduced Jorge Villasenor who announced interpreter services are available. 4. Open Discussion for the Good of the Order A. Proclamations SmaII Business Saturday proclamation Mayor Pro Tem Mendez proclaimed Saturday, November 25, 2017, as Small Business Saturday. Joe Mann, Thane Phelan and Vertynn Best, Chamber of Commerce CEO, accepted Page 1 of 5 214 the proclamation. B. Presentations / Recognitions / Introductions Prevention Club Awards, presentation by ESD #105 Gerry Galindo, Davis High School CCAN (Connecting Compassionate, Aspiring Navigators --a High School club focused on underage drug prevention) Club Advisor, along with Safe Yakima YOUTH Coalition and ESD 105 recognized students for their dedication to community efforts to decrease underage substance use. He recognized and introduced Davis High School students Gabby Galindo, Nya Galindo and Ciara Brown, who recognized Washington Middle School for "Investing in the Future Award," as well as other students not in attendance. ii. Downtown Association of Yakima 2017 Event Update Andrew Holt, Executive Director of the Downtown Association of Yakima, presented details on the performance of the Yakima Roots and Vines Festival, Downtown Summer Nights and the Yakima Blues Festival. Presentation from Mid -Columbia Fisheries Enhancement Group Margaret Neuman, Executive Director of Mid -Columbia Fisheries Enhancement Group, a non- profit organization dedicated to protecting and restoring wild salmonid populations and their habitats through restoration, protection, education, and community involvement throughout our region, presented the City Council with a certificate naming the City of Yakima the "2017 Landowner of the Year" related to cooperation in the Cowiche Creek Restoration project. iv. Recognition of City Clerk Sonya Claar Tee for 25 years of service to the City of Yakima Mayor Pro Tem Mendez stated she has an item to add that is not on the agenda. She and the City Council recognized City Clerk Sonya Claar Tee for her 25 years of dedication, high performance and tremendous service to the City of Yakima. Clerk Claar Tee thanked Council and the City Manager for the recognition. 5. Council Reports A. Accept Council Economic Development Committee minutes from October 26, 2017 MOTION: Cousens moved and Adkison seconded to accept the minutes. The motion carried by unanimous vote, Coffey and A. Gutierrez absent. 6. Consent Agenda Mayor Pro Tem Mendez referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from Council members present. Items 6K (previously item 11) and 6L (previously item 12) were added to the consent agenda. The City Clerk read the Consent Agenda items, including resolutions and ordinances, by title. (Items on the Consent Agenda are handled under one motion without further discussion—see motion directly below.) MOTION: Cousens moved and D. Gutierrez seconded to approve the consent agenda. The motion carried by unanimous vote, Coffey and A. Gutierrez absent. A. Approve payment of disbursements for the period October 1 – 31, 2017 Page 2 of 5 B. 3rd Quarter 2017 Accounts Receivable Status Report C. ���� ����� Project Completion and Contract Acceptance for Accelerated Construction & Excavating, LLC - E Viola (1-82) and S. 22nd St. Water Main Replacement (Standard Motion V -B -Accept the project and approve) D. Set December 12, 2017, as the date for a public hearing on the FainNay Annexation in the vicinity of S 64th Ave and Ahtanum Road E. Resolution authorizing a Grant Agreement with Washington State Department of Transportation (WSDOT) to provide furiding assistance for 20 new Fixed -Route Transit Bus Shelters RESOLUTION NO. R-2017-1 36, A RESOLUTION authorizing a grantagreement with Washington State Department of Transportation to fund the purchase and installation of 20 new Bus Shelters. F. Resolution authorizing a Grant Agreement with Washington State Department of Transportation (WSDOT) to fund the Yakima/Ellensburg Commuter Service and the Paratransit Services (Dial A Ride) in Yakima and Selah RESOLUTION NO. R-2017-137, A RESOLUTION aa grant agreement with Washington State Department of Transportation to fund Commuter bus service between Yakima and Ellensburg and to fund paratransit services (Dial A Ride) in Yakima and Selah. G. Resolution authorizing the City to accept a Municipal Stormwater Capacity Grant from the Department of Ecology RESOLUTION NO. R-2017-138, A RESOLUTION authoriztng the City to accepta Municipal Stormwater Capacity Grant from the Department of Ecology. H. Resolution authorizing the Fire Chief to enter into a grant agreement with Washington State Military Department and the U.S. Department of Homeland Security to provide funds to enhance the City of Yakima Emergency Management Program RESOLUTION NO. R-2017-139, A RESOLUTION authorizing the Fire Chief, who serves as the City's Emergency Manager, to enter into a grant agreement with Washington State Military Department and the U.S. Department of Homeland Security to provide funds to enhance the City of Yakima Emergency Management Program 1. Resolution authorizing the transfer of a right-of-way use permit from Yakima Regional to SHC Medical Center dba Astria Regional Medical Center RESOLUTION NO. R-2017440' A RESOLUTION authorizing the transfer of a right-of-way use permit from Yakima Regional to SHC Medical Center—Yakima, dba Astria Regional Medical Center, to allow the continued use of a previously permitted right-of-way use permit. J. Resolution authorizing contract renewal with the Yakima Humane Society for animal control services in 2018 RESOLUTION NO. R-2017-141, A RESOLUTION authorizing and directing the City Manager of the City of Yakima to execute an Animal Control Agreement with the Yakima Humane Society for the year 2018 Page 3 of 5 216 K. Resolution authorizing an Interlocal Agreement with Union Gap, WA for the City of Yakima to provide Fire Protection Services RESOLUTION NO. R-2017-142, A RESOLUTION authorizing an interlocal agreement with the City of Union Gap for fire protection and emergency medical services. L. Resolution authorizing a Memorandum of Understanding with International Association of Firefighters Local 469 providing for employment terms of the firefighters coming from Union Gap RESOLUTION NO. R-2017-143, RESOLUTION authorizing the City Manager to execute a Memorandum of Understanding with International Association of Firefighters Local 469 providing for employment terms of the firefighters coming from Union Gap 7. Public Comment John Baule, City resident, spoke on behalf of the Plaza Committee, stating he read some documents at the Yakima Valley Museum from August 29, 1966, where the City Council and Planning Commission were looking forward to growth in downtown Yakima including a plaza at Yakima Avenue and 3rd Street. Now, 61 years later, he stated 242 private donors have donated more than $7 million towards the public/private plaza. He is grateful for their amazing generosity. Duvi Baez, City resident, made allegations about staff at the Office of Neighborhood Development Services. City Manager Moore will be looking into this issue. PUBLIC HEARINGS 8. First public hearing on the 2018 Preliminary Budget for the City of Yakima Tara Lewis, Financial Services Manager, briefed Council on the 2018 Preliminary Budget. Mayor Pro Tem Mendez opened the public hearing and, with no one coming forward to speak, closed the hearing. She stated no action is necessary at today's meeting and this issue will be back for a final public hearing on the December 5, 2017 agenda. 9. Closed record public hearing and Resolution to consider the Yakima Planning Commission's recommendation regarding the preliminary plat of Saddlebrook Loop located at 7411 Summitview Ave Associate Planner Eric Crowell briefed Council on the resolution. Mayor Pro Tem Mendez opened the public hearing and, with no one coming forward to speak, closed the hearing. The City Clerk read the resolution by title only. MOTION: Cousens moved and Adkison seconded to adopt the resolution. The motion carried by unanimous vote, Coffey and A. Gutierrez absent. RESOLUTION NO. R-2017-144, A RESOLUTION approving the Preliminary Long Plat of Saddlebrook Loop, a 23 -lot subdivision, located at 7411 Summitview Ave. 10. Open record public hearing and Ordinance regarding text amendments to YMC Title 14, Subdivision Ordinance to allow administrative approval of final long plats Planning Manager Joseph Calhoun briefed Council on the ordinance. Mayor Pro Tem Mendez opened the public hearing. Page 4 of 5 Bit! Hordan, City business owner, spoke in support of the ordinance and stated Joe Watsh of Central Washington Home Builders is also in support. Mayor Pro Tem Mendez closed the hearing. The City Clerk read the ordinance by title only. MOTION: Cousens moved and Adkison seconded to pass the ordinance. The motion carried by unanimous vote, Coffey and A. Gutierrez absent. ORDINANCE NO. 2017-030, AN ORDINANCE amending the City of Yakima Municipal Code, Section 14.20: Subdivision—Procedure and Section 14.05: General Provisions, to allow the Community Development Director, rather than the City Council, to approve final subdivision plats. CITY MANAGER UPDATE 11. Naches Parkway Evaluation and Discussion Mayor Pro Tem Mendez reported Council Member A. Gutierrez askethat this item be postponed until the next meeting since she was unable to attend. It was Council consensus to postpone this item to the next meeting. 12. Other Business None. 13. Adjournment MOTION: Adkison moved and D. Gutierrez seconded to adjourn to a City Council Briefing on November 30, 2017, at 5 p.m. at City Hall in the 2nd floor conference room. The motion carried by unanimous vote, Coffey and A. Gutierrez absent.
