HomeMy WebLinkAboutNorth Yakima Conservation District - MOU re Cowiche Creek Fish Passage ProjectMEMORANDUM OF AGREEMENT BETWEEN THE CITY OF YAKIMA AND NORTH YAKIMA CONSERVATION DISTRICT RELATING TO FUNDING OF THE COWICHE CREEK FISH PASSAGE PROJECT I. INTRODUCTION This Memorandum of Agreement (MOA) is entered into by the City of Yakima (City) and North Yakima Conservation District (District). II. PURPOSE AND SCOPE A. Purpose 1. For NYCD and the city to participate as project partners in a fish habitat enhancement project on Cowiche Creek. The project will remove the fish passage barrier created by the exposed Naches Cowiche Canal Association siphon and exposed city waterline. B. Scope The scope of this MOA with regards to the City will be restricted to providing funds to aid in the construction and completion of the project. NYCD shall construct and complete the project. This MOA will begin on or about May 1, 2017, and will continue until the funds have been expended but not later than January 1, 2018. NYCD shall complete the project even if the cost exceeds the amount provided by the City. III. ROLES OF THE CITY OF YAKIMA AND NORTH YAKIMA CONSERVATION DISTRICT A. The City shall reserve and prioritize financial compensation to the District in the amount of $25,000. Project expenses over $25,000 will be incurred by the District and other funding sources. B. The District shall construct and implement the project as designed and found in the engineering drawings and specifications attached hereto and incorporated herein. C. The District shall provide the city with monthly invoices, as well as copies of receipts/invoices from vendors, contractors, etc. for construction costs related to the replacement the city waterline as part of the overall project. D. The North Yakima Conservation District will provide monthly progress reports to the Water/Irrigation Division Manager for the water line replacement portion of the project, through the date of completion. IV. GOALS A. Provide monetary funding to allow for the completion of the fish passage project that includes modification of the City of Yakima's waterline that crosses Cowiche Creek. B. The City of Yakima and North Yakima Conservation District to perform this task in a cooperative fashion as part of an overall strategy to improve infrastructure and improve fish habitat in the Cowiche Creek watershed. V. PROVISOS A. Nothing in this MOA is intended to create any rights in any party not a party to this neither MOA nor third party beneficiaries. B. Nothing in this MOA creates a resource obligation outside that stated within the agreement.
