For Meeting of: November 21, 2017 Resolution authorizing the transfer of a right-of-way use permit from Yakima Regional to SHC Medical Center dba Astria Regional Medical Center Colleda Monick, Assistant Planner Joe Caruso, Code Administration Manager Joan Davenport, Al CP, Community Development Director SUMMARY EXPLANATION: SHC Medical Center Yakima dba Astria Regional Medical Center (RL17-0066) is requesting approval for a transfer of ownership on a previously permitted right-of-way use permit to allow the continued use of the right of way for the placement of directional display signs. The property is located in the Professional Business District (B-1) zoning district. Right -of -Way Use permits are processed under the provisions of Chapter 8.20, which requires review by the code administration manager and final approval by the City Council. Pursuant to YMC Section 8.20.100, the privilege to use public right-of-way shall be a personal privilege of the person to whom the permit is issued, and no such permit shall be transferable without the consent of the Yakima City Council. The permit also requires liability insurance as prescribed in Section 8.20.060, which will be provided to the Office of Code Administration prior to issuance of any permit. Approved permits are valid for a period of one year, renewable annually. This allows the City an opportunity to review any public health/safety/welfare issues that may need to be addressed in subsequent years. R -2017 - authorizing the transfer of a right-of-way use permit from Yakima Regional to SHC Medical Center—Yakima, dba Astria Regional Medical Center, to allow the continued use of a previously permitted right-of-way use permit. WHEREAS, pursuant to Chapter 8.20 YMC, permits for construction of certain improvements within rights-of-way within the City's commercial districts is allowed; and WHEREAS, pursuant to YMC § 8.20.100, the privilege to use public right-of-way granted by any permit issued pursuant to this chapter shall be a personal privilege of the person to whom the permit is issued, and no such permit shall be transferrable without the consent of the Yakima City Council first being obtained; and WHEREAS, SHC Medical Center – Yakima dba Astria Regional Medical Center, has submitted an application for a right-of-way use permit transfer to allow the continued use of the previously permitted right-of-way use for signs at 110 S 9th Ave. within the Professional Business, (B-1) zoning district; and WHEREAS, the application was deemed complete on November 6, 2017; and WHEREAS, city staff has recommended approval of the transfer of the right-of-way use permit, with the requirement that the new holder provide the required insurance information; and WHEREAS, the City Council, having considered such application and the recommendation of city staff, hereby finds and determines that approval of the requested right- of-way use permit transfer is authorized pursuant to Chapter 8.20 YMC, is in the best interest of residents of the City of Yakima and will promote the general health, safety and welfare; now, therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager, or his designee, is hereby authorized to transfer the right-of-way use permit from the previous property owner to SHC Medical Center --Yakima transfer in accordance with the provisions of Chapter 8.20 YMC and the application (RL 170066) at 110 South 9th Avenue in Yakima. No physical change will occur to any of the existing signs including size and location. The property is located within the Professional Business, (B-1) zoning district. APPLICABLE LAW 1. YMC § 15.08.080 allows projecting signs over the right of way, as follows: a. No more than one third of the height of any projecting sign shall exceed the height of the building to which it is attached. b. All signs projecting over the right-of-way shall conform to the following standards: Clearance Above Grade Less than 8 feet 8 feet to 9 feet 9 feet to 10 feet Over 10 feet Maximum Projection Not Permitted 1 foot 2 feet 2/3 the distance from building to curb line or a maximum of 10 feet 2. YMC § 15.08.060, Table 8-2 Maximum Sign Area lists the B-1 standard for sign area as "24 sq ft. for signs set back 15 ft. or less from required right-of-way." 3. YMC § 8.20.100, the privilege to use public right-of-way granted by any permit issued pursuant to this chapter shall be a personal privilege of the person to whom the permit is issued, and no such permit shall be transferable without the consent of the Yakima City Council first being obtained. FINDINGS No change to the existing permitted signs is requested of this Right -of -Way Use permit, other than a transfer of the permit's benefits to the new property owner. The original Right -of -Way use permit was issued in 1994 and included the following; "area to be occupied by (1) main entrance display and (8) other various directional displays, in the 15' grass strip between curb edge and sidewalk. All displays will be approximately 2' or more away from curb edge. These directional signs are intended to clearly identify designated parking or entrances to hospital patients and visitors and eliminate congestion or confusion." CONCLUSIONS 1. The proposed signs meet all standards for size and projection over the right-of-way. 2. The original request was approved in November 1994; and no change to that permit is being requested at this time except for a transfer of ownership to the new property owner. 3. Per YMC § 8.20.100, transfer of a Right -of -Way use permit requires council approval. 4. Upon approval of the transfer SHC Medical Center—Yakima, dba Astria Regional Medical Center, shall provide proof of insurance as required under YMC 8.20.060. DECISION According to the findings listed above, the City of Yakima Planning Division recommends approval of this right-of-way use permit.
