ITEM TITLE: Ordinance establishing an annual vehicle license fee; and fixing a
time when the same shall become effective

SUMMARY EXPLANATION:
On January 10, 2017, the City Council created the City of Yakima Transportation Benefit District
(TBD) with boundaries coterminous with the boundaries of the City of Yakima, and assumed the
rights, powers, immunities, functions, and obligations of a transportation benefit district, all in
accordance with Chapter 36.73 RCW.
I n order to fund the TBD it is necessary to establish an annual vehicle license fee in the amount
of nineteen dollars ($19.00) for the purpose of preserving, maintaining, operating, construction, or
reconstructing the transportation infrastructure and funding transportation improvements that have
been identified in the approved project list.

ORDINANCE NO. 2017 -
AN ORDINANCE of the City of Yakima, Washington establishing an annual vehicle license
fee; and fixing a time when the same shall become effective.
WHEREAS, on January 10, 2017, the City Council created the City of Yakima TBD with
boundaries coterminous with the boundaries of the City of Yakima, all in accordance with
Chapter 36.73 RCW; and
WHEREAS, on January 10, 2017 the City Council assumed the rights, powers,
immunities, functions, and obligations of a transportation benefit district; and
WHEREAS, the City Council finds it to be in the best interest of the city to establish an
annual vehicle license fee in the amount of nineteen dollars ($19.00) for the purpose of
preserving, maintaining, operating, construction, or reconstructing the transportation
infrastructure and funding transportation improvements that have been identified in the
approved project list; Now, Therefore;
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. An annual vehicle license fee of nineteen dollars ($19.00) is hereby
established consistent with the Revised Code of Washington (RCW) section 36.73.065, as
written or hereafter amended, to be collected by the Washington Department of Licensing on
qualifying vehicles as set forth in RCW 82.80.140, as written or hereafter amended.
Section 2. The annual vehicle license fee shall take effect for notices mailed in 2017
for vehicle license renewals due on or after January 1, 2018, or as soon thereafter as the
Washington Department of Licensing is reasonably able to incorporate collection of the
nineteen dollar fee; but in no event shall the vehicle license fee be collected sooner than one
hundred and eighty (180) days after approval of this ordinance, pursuant to RCW 36.73.065
and RCW 82.80.140. The vehicle license fee shall be collected during the term of the
existence of the District and shall cease to be collected upon dissolution.
Section 3. The City Council directs the City Clerk to notify the Washington
Department of Licensing of the vehicle license fee established in Section 1 of this Ordinance
and to request that they take all steps necessary to implement collection of this fee in
accordance with RCW 82.80.140.
Section 4. If any portion or section of this Ordinance should be held to be
unconstitutional, invalid, or unenforceable for any reason, such finding shall not affect the
constitutionality, validity, or enforceability of any other portion or section of this Ordinance.
Section 5. This ordinance shall become effective and shall be in full force and effect
30 days after its passage and publication in accordance with law.

Violence has increased significantly recently and we don't feei safe enough and fear for our families safety.
Recently our car tabs were increased, and our local utilities were also increased, however, without any results of
how our monies are used. Continued increase of violence should be addressed with as much urgency as the
newly increased czar tabs proposed by our local government. Current examples of our tax money being used do
not stress the more serious issues like public safety as they are assigned to projects like the multi-million dollar
Plaza project and efforts to attract more tourists via road and business improvements on First Street.
We believe it is the responsibility-of the City to invest in our neighborhoods in a financial balance that should fit
the needs of the city as well as its individual communities within. Many of us believe the SAFETY issue should be
a priority that concerns all of Yakima and its residents.

Good afternoon Mayor and Council Members:
I come before you again to ask you not to tax the City of Yakima residents with the $19
TBD (Transportation Benefit District). Most of you know that I am what some call a
"bleeding heart liberal" and I am not afraid of the boogeyman "taxes", but many of us in
this so-called progressive state know that we have one of the most regressive tax systems
in the United States. While I am a proponent of fixing our infrastructure, I cannot in clear
conscious advocate for such on the backs of the most disenfranchised in our City.
testified before you some months ago pleading on behalf of my community, my friends,
my neighbors, known and unknown to let you know how this will impact the most
disenfranchised in our City. As federal programs are being cut for our community
members most in need, I urge you again not to place the tax burden on my neighbors and
our community.
I would appreciate a clear and cogent answer as to how almost $11 million on North 1st
Street Revitalization (Phase 2) is going to keep our neighbors and the families that have
been devastated by violent deaths that we met this past Saturday, safe in their homes on
8th Street, 6th Street, Yakima Avenue and every other street that has faced horror and
death.
For example, my neighbor who lives on limited SSI of less than $800. Do you know what
$19 means to her? For the many people, some of whom I've helped through crime victims
services that have little to no resources, who are victims of crime and who are doing what
they can to survive and stay safe and alive, who cannot feel secure even in their own
homes. Do you know what $19 means to them? For the single parents who are barely
keeping their homes and children together, who may struggle from paycheck to paycheck,
do you know what $19 means to them? For the single people who have no support and
do not have any other means, do you know what $19 means to them? And so on and so
forth . . .
This $19 can literally mean life or death for some in our community. Imagine if you will
the person who will receive their car tab who can barely pay the amount currently due,
piling on $19. This person may have to make a choice of paying the tab, purchasing food
or their gas for the week, etc. Let's then say that person is stopped by police for expired
tabs, that person now receives a ticket, which further burdens an overwhelming situation,
and has legal costs and fees, and so forth. Council please stop and think about what you
are doing. There must be another avenue to find the funds for infrastructure. I urge you
to step outside of your box and think about what many residents will face with another
tax. Please vote no.
