For Meeting of: June 20, 2017 ITEM TITLE: Ordinance amending the City of Yakima Municipal Code, Section 1.42.025: Membership—Appointment—Terms to change the term of a Planning Commission member from a 6 year term to a 4 year term SUBMITTED BY: Sara Watkins, Senior Assistant City Attorney SUMMARY EXPLANATION: At the June 6, 2017 regular City Council meeting, the City Council voted to bring forward an ordinance that reduces the term of a Planning Commission member from six years (the current term) to four years. WHEREAS, Yakima Municipal Code section 1.42.025 provides for six year terms for Planning Commission members; and WHEREAS, RCW 35.63.030 provides that planning commission members may serve either a six year or a four year term, to be determined by the city council; and WHEREAS, the City Council of the City of Yakima finds it is in the best interest of the City and its residents to reduce the term of a City of Yakima Planning Commission member from six years to four years; now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Section 1.42.025 of the City of Yakima Municipal Code shall be amended to read as follows: 1.42.025 Membership—Appointment—Terms A. The city planning commission shall consist of seven members appointed by the mayor and confirmed by the city council. The term of office for the first appointive members appointed to the city planning commission shall be designated from one to six years in such a manner as to provide the fewest possible terms will expire in any one year. Thereafter the term of office for each appointive member shall be Lour years. B. Vacancies occurring otherwise than through the expiration of terms shall be filled for the unexpired term. Members may be removed, after public hearing, by the mayor, with the approval of the city council, for inefficiency, neglect of duty or malfeasance in office. C. The members of the city planning commission shall be selected without respect to political affiliation and they shall serve without compensation. D. No person shall serve more than two consecutive terms, provided a person appointed to fill unexpired terms of less than two years is eligible to serve two successive four-year terms; and provided further, a person who is ineligible to serve for having served two consecutive terms may again serve after two years have elapsed from the end of the second such term. Section 2. This ordinance shall be in full force and effect 30 days after its passage, approval, and publication as provided by law and by the City Charter.
