surplus to the City needs and abandon a section of DI D #39

SUMMARY EXPLANATION:
Set a Public Hearing for May 16, 2017, 6:30p .m., to declare a section of Drainage Improvement
District (DI D)#39 abandoned, from manholes 63 through 57 in the section of DI D pipe from
Castlevale to the southernmost point of Powerhouse Villas.
All property rights to DI Ds within city limits were ceded to the City by Yakima County when the
city accepted transfer of this conveyance system. There is little legal specificity as to how to
decommission DI D lines after they are essentially abandoned. As a result, the City is treating
them as a utility for purposes of abandonment and asking the City Council to hold a public hearing
declaring the property surplus. Based on information from the engineering firm PLSA, the DI D
line sought to be abandoned is no longer necessary as there is no drainage flow through this
portion of the pipe. No City services, such as storm water, are connected to this portion of the
DI D. The City has no need for this portion of the DI D system and the property owner is seeking
to decommission the pipeline.
