SUMMARY EXPLANATION:
On March 8, 2017, the City of Yakima Planning Commission held an open record public hearing
to consider a text amendment to modify the definition of "dwelling, multiple -family" within the
City's Urban Area Zoning Ordinance to allow alternate forms of housing such as tiny
homes/efficiency units as multi -family residential development, which is clustered around a
common open space or a community building within the City of Yakima.
In accordance with YMC 16.10.080, on March 21, 2017, the City of Yakima Planning
Commission forwarded its recommendation to the Yakima City Council regarding the proposed
text amendment. Now therefore in accordance with YMC 16.10.090, the Yakima City Council is
requested to consider the Planning Commission's recommendation on this matter during a public
hearing.

AN ORDINANCE amending the definition of Dwelling, multiple -family within Yakima
Municipal Code Title 15 Urban Area Zoning Ordinance Ch.15.02
Definitions to permit new housing types such as tiny homes and
efficiency units within the City of Yakima.
WHEREAS, the Planning Commission of the City of Yakima has considered an
amendment to Title 15 Urban Area Zoning Ordinance Ch.15.02 Definitions of the Yakima
Municipal Code which would allow new housing types such as tiny homes and efficiency units
within the City of Yakima as multiple -family housing; and
WHEREAS, the Planning Commission has held a public meeting on the proposed
amendments on February 22, 2017; and
WHEREAS, the Planning Commission held an open record public hearing on March 8,
2017, pursuant to notice and has received and considered all evidence and testimony
presented; and
WHEREAS, the Planning Commission, having conducted such public hearing, found,
determined, and recommended that the City Council approve such amendment; and
WHEREAS, the City Council held a public hearing on April 18, 2017 pursuant to notice
to consider such amendments as recommended by the Planning Commission; and
WHEREAS, the City Council of the City of Yakima, having considered the record herein
and the recommendation from the Planning Commission, hereby finds and determines that
approval of such amendment is in the best interests of residents of the City of Yakima and will
promote the general health, safety and welfare; therefore
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The definition of "dwelling, multiple -family" located in Chapter 15.02
Definitions of the Yakima Municipal Code is hereby amended to read as follows:
"Dwelling, multiple -family" means a structure or structures, or portion thereof, designed for
occupancy by three or more families living independently of each other and containing three or
more attached dwelling units on a lot. Multiple -family and detached single-family dwellings that
are clustering around a common amenity such as open space, recreation facilities or common
community building, and have a common driveway access on a single lot of record are also
considered multiple -family development.
Section 2. Adoption of Planning Commission Findings. The findings within
the March 8, 2017, Yakima Planning Commission's Recommendation, regarding this proposed
text amendment is hereby adopted by the Yakima City Council as its findings in support thereof
pursuant to YMC § 15.23.020, and are incorporated herein by this reference as if fully set forth
herein.
Section 3. Validity. If any section, subsection, paragraph, sentence, clause or
phrase of this ordinance is declared invalid or unconstitutional for any reason, such decision
shall not affect the validity of the remaining portions of this ordinance.
Section 4. Ratification. Any act consistent with the authority, and prior to the
effective date of this ordinance is hereby ratified and affirmed.
Section 5. Authorization to File. The City Clerk is hereby authorized and directed to
file a certified copy of this ordinance with the Yakima County Auditor.
Section 6. Effective Date. This ordinance shall be in full force and effect 30 days
after its passage, approval, and publication as provided by law and by the City Charter.

The City of Yakima last amended its Title 15 Urban Area Zoning Ordinance on December 6,
2016; _ ♦
Proposals to amend the City of Yakima's Urban Area Zoning Ordinance, follow the City's
established process in YMC § 15.23.020(B) and YMC Title 16; and
WHEREAS
Pursuant to RCW 36.70A.130(l) the City is required to take legislative action to review and
revise its development regulations in accordance with the Growth Management Act; and
WHEREAS
Under the provisions of YMC 1.42 the Yakima Planning Commission is responsible for the
review of amendments to the City's Yakima Urban Area Zoning Ordinance, and for
recommending the approval, modification, or denial of each amendment; and
WHEREAS
On February 22, 2017, the Yakima Planning Commission held a study session to review the
proposed text amendment and held an open record public hearing on March 8, 2017; and

presentation regarding the proposed text amendment to YMC Title 15, took public testimony,
and recommended approval of the proposed amendment and accompanying ordinance; and

FINDINGS OF FACT
1. The Planning Commission held a study session on the proposed text amendment on

Yakima Planning Commission (YPC) consideration and public hearing of an amendment
to the City of Yakima's Municipal Code Title 15 Urban Area Zoning Ordinance to
accommodate alternate forms of housing as multi -family development.
STAFF RECOMMENDATION:
The City of Yakima Planning Division recommends that the YPC hold the required public
hearing, take public input, revise the draft amendment as necessary, and forward the
Planning Commission's recommendation to the Yakima City Council for further
consideration.
PURPOSE AND DESCRIPTION OF PROPOSED AMENDMENT:
The purpose of the proposed amendment is to modify the definition of "dwelling,
multiple -family" within the City's Urban Area Zoning Ordinance to allow alternate forms
of housing such as tiny homes/efficiency units as multi -family residential development,
which is clustered around a common open space or a community building within the City
of Yakima.

Goal 3. 1: Provide for a broad distribution of housing in Yakima that meets the
affordability and neighborhood design needs of the public.
Policy 3.1.1.1: Development shall be at an overall density of 12 dwellings units per acre
or more. Recommended zones: Two -Family Residential (R-2) and Multi -Family
Residential (R-3), Professional Business District (B-11), and Central Business District
Policy 3.1.1.2: Permitted housing types include townhouses, condominium, multi -family
and manufactured housing.
Policy 3.1.2.2: Residential PD allows new development to provide a mixture of housing
sizes and prices and to provide incentives for developers to include affordable units in
higher cost developments
Goal 5.11: Encourage diverse and affordable housing choices.
Policy 5.1.3: Encourage affordable housing development.
Policy 5.1.4: Encourage a range of affordable homeownership options.
Policy 5.1.5: Encourage the provision of fair share housing opportunities to all economic
segments and mixed uses for infill developments.
Policy 5.1.7: Encourage good faith efforts that the City of Yakima and other local
governments not impose regulations that may constitute barriers to affordable housing
availability, and appropriate compatible residential densities.
Policy 5.1.8: Support programs to improve existing housing stock.
Goal 5.3: Adopt or revise the City's development standards to increase housing
opportunities.
Policy 5.3.11: Review of existing zoning regulations and consideration of innovative
standards that will encourage construction of affordable housing and encourage the
participation of neighborhood associations and the development community in this
process.
Policy 5.3.1: Facilitate small lot sizes, condominiums, clustering and other options that
increase the supply of affordable homeownership options.
Policy 5.3.3: Assist, when allowable, the conversion of accessory buildings into housing
units as a means to increase the supply of affordable housing units and to help existing
homeowners remain in their homes.

Re: Consideration of Amendments to the Definition of Multi -Family Residential
Over the past three to four years, there has been a growing movement throughout
the State of Washington to allow alternate forms of housing such as tiny
homes/efficiency units. As a result, some communities have permitted tiny
homes/efficiency units in both their Single and MultVFamily zoning districts, both

family development. The main issue is that multi -family dwellings have to be
attached units under the City's current definition.

1) Allow tiny homes/efficiency units as multi -family development in the Two
Family Residential zoning district as a Type (2) or (3) Review dependent upon
the density of the development;
2) Allow the use as a Type (1) Review in the Multi -Family zoning district;
3) Prohibit the use in the Suburban Residential and Single -Family zoning

4) Ensure that multi -family developments composed of this alternative housing
type contain the required amenities to ensure that they are operated similar to
that of an apartment complex, and not as indeperdent single-family homes; and
5) Minimize amendments to other definitions within the Urban Area Zoning
Ordinance.

WHEREAS, the Planning Commission of the City of Yakima has considered
amendment to Title 15 Urban Area Zoning Ordinance Ch.15.02 Definitions of the Yaki
Municipal Code which would allow new housing types such as tiny homes and efficiency unii

WHEREAS, the Planning Commission has held a public meeting on the • ••• -•

WHEREAS, the Planning Commission held an open record public hearing on March 8,
2017, pursuant to notice and has received and considered all evidence and testimony
presented; an•
WHEREAS, the City Council of the City of Yakima, having considered the record herein

,--pproval of such amendment is in the best interests of residents of the City of Yakima and will
promote the general health, safety and welfare; therefore
