For Meeting of: April 4, 2017 ITEM TITLE: Resolution authorizing the emergency purchase of stormwater infrastructure and installation services not to exceed $200,000, required prior to the repair and reopening of 66th Avenue between Scenic and Englewood Avenues SUBMITTED BY: Scott Schafer, Director of Public Works Mike Price, Wastewater/Stormwater Division Manager 249-6815 SUMMARY EXPLANATION: Severe road damage caused by stormwater runoff required the City to close 66th Avenue between Scenic Avenue and Englewood Avenue since February 22, 2017. This is the only road in the City that is closed due to unsafe driving conditions. The Stormwater Division is requesting permission from City Council to forego the formal bid process for the stormwater structure purchase and installation. The formal bid process would delay the project completion and road reopening until July at the earliest date. Foregoing the formal bid process will allow the City's Streets Division to begin rebuilding the affected section of 66th Avenue as soon as the stormwater infrastructure installation was completed and begin repaving as soon as asphalt became available. The asphalt plant is expected to open on April 10th. Funding is identified and budgeted in the Stormwater Capital fund (441)for improved conveyance and infiltration of stormwater. R-2017- A RESOLUTION ratifying the declaration by the City Manager of an emergency and authorizing the City Manager to execute all applicable contracts for the installation of the stormwater infrastructure required for the repair and reopening of 66th Avenue between Scenic Avenue and Englewood Avenue. WHEREAS, Article VI, section 6 of the City of Yakima Charter and the Yakima Municipal Code Chapter 1.80 provide that the City Council may declare an emergency dispensing with the necessity for bidding for services, material, and equipment and supplies costing more than $25,000; and WHEREAS, road damage has required the closure of 66th Avenue between Scenic Avenue and Englewood Avenue since February 22, 2017 which has created detours and stormwater-related safety concerns including property damage during rain events; and WHEREAS, the proper repair, resurfacing, and reopening of the roadway requires prior installation of stormwater drainage infrastructure; and WHEREAS, repairing the site requires site evaluation and careful design of the stormwater infrastructure, which took place through March due to an unforeseen flood emergency in another portion of Yakima which took resources and staff from Public Works away from this project to work on the immediate emergency flooding issues; and WHEREAS, the design was recently completed and it is imperative to complete the stormwater infrastructure to address the immediate safety concerns associated with future rain events, which must be done prior to road resurfacing in April; and WHEREAS, the Stormwater Division does not have the labor resources to perform the stormwater infrastructure installation prior to the road resurfacing that is scheduled for the April 2017; and WHEREAS, the asphalt plants are scheduled to open in the third week of April, allowing Public Works to address the roadway concerns and issues surrounding detour routes; and WHEREAS, the formal bid process would take approximately three months after the design plans were completed, which would continue to put property and the public at risk during rain events for property damage; and WHEREAS, an emergency exists because this roadway area needs to be repaired from damage, which first requires construction of stormwater infrastructure, and the damage presents a real, immediate threat to the proper performance of the roadway and stormwater systems and failure to repair the roadway and construct the stormwater infrastructure will likely result in material loss or damage to property during future rain events and as a result of the road closure, if immediate action is not take; and WHEREAS, the City Council deems it to be in the best interest of the City and its residents to ratify the City Manager's declaration of an emergency and authorize the execution of all necessary documents for contracts for the labor and materials for the installation of the stormwater infrastructure required to repair and reopen 66th Avenue between Scenic Avenue and Englewood Avenue, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The emergency is hereby ratified, the City Council resolves that there is an emergency, and the City Manager's execution of all appropriate documents for the labor and materials for the installation of stormwater infrastructure required to repair and reopen 66th Avenue between Scenic Avenue and Englewood Avenue without calling for bids, is hereby ratified and approved.
