A RESOLUTION authorizing a sole source procurement without calling for bids from Northwest
Manufacturing and Distribution, Inc. Hereby said entity shall install a Thermo -
Lay model UD 425-120 hot asphalt and sanding machine on a new City of
Yakima provided cab and chassis.
WHEREAS, Article VI, Section 6 of the City of Yakima Charter and the Yakima Municipal
Code Chapter 1.80 generally require that purchases over $25,000 be done by competitive bidding,
subject to certain exceptions; and
WHEREAS, the law recognizes a "sole source" exception from these competitive bid
requirements when, due to unique service requirements, it would be futile to utilize competitive
bidding; and
WHEREAS, the City of Yakima has compelling interest in standardization since this vehicle
is a duplicate of a unit currently owned by the City of Yakima and in reliable service since 1997.
WHEREAS, the Thermo -Lay machine has several proprietary features, that competing
manufacturers cannot duplicate, that are essential to the efficient operation of the Streets Division;
and
WHEREAS, Northwest Manufacturing and Distribution, Inc. is the equipment manufacturer
selling directly without a dealer network; and
WHEREAS, Northwest Manufacturing and Distribution Inc. is geographically located in the
northwest region and thereby able to adequately provide emergency technical support and spare
parts in a timely manner; and
WHEREAS, it would be futile to utilize competitive bidding process for the purchase of these
services from any other entity than Northwest Manufacturing and Distribution, Inc., now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager is hereby authorized to procure from Northwest Manufacturing and
Distribution, Inc., as a sole source procurement without calling for bids, manufacture and installation
of a new Thermo -Lay model UD 425-120 hot asphalt and sanding machine on a new cab and
chassis.

The Thermo -Lay uses maintenance free solenoid hydraulic valves which allow the switches to be
located at the rear of the machine and in the cab as well. The solenoid hydraulic valves also have
manual overrides in case of a loss of electricity. The automatic shifting 2 speed motor provides
outstanding delivery and can unload the entire 5 cubic yards in less than 5 minutes. Moving the
roller lift from the left rear of the machine to the area between the cab and body, not only
transferred a substantial weight off of the rear axle, but also freed up valuable space at the rear
which gives the delivery chute a complete 180 degree movement at the rear. With an optional chute
extension, delivery can be made to either drivers or passengers curbside, for repair of new curb
construction. For rakes, brooms and shovels, a rear mounted tool rack holds 4 tools. An 8 gallon
auxillary water container is also rear mounted, for supplying additional water to the roller compactor.

The Thermo -Lay asphalt hopper is heated by heat transfer oil. The heat transfer oil is heated by
a 350,000 BTU propane burner during working hours and then kept to a desired temperature at
night by a 9 KW electric heater. The Intelli-Temp timed heating system allows the operator to select
a daytime temperature, daytime start time, nighttime temperature, and nighttime start time.
The Intelli-Temp system automatically lowers the heat transfer oil temperature to the desired
nighttime heat using the electric heater and the automatically adjusts to the desired daytime
temperature using the propane burner and electric heater at the desired, pre-set time. Weekends
may be controlled as nighttime temperature or shut down completely, with automatic early
Monday morning start-up.
The Thermo -Lay Hot Asphalt and Sanding Machine was designed to take all of necessary components
needed for asphalt repair and integrate them into a single truck, operated by a two man crew. The 1978
model had a hopper heated by cut-back tack oil. The current Thermo -Lay has evolved into a unique
state-of-the-art machine. This machine carries 5 cubic yards of either hot -mix or cold mix, can carry
120 gallons of tack oil, includes a hydraulic operated jack hammer, carries a gasoline driven vibratory
roller compactor, and includes all the necessary traffic lighting and signaling. These features are found
on a short, single 120" cab -to -axle truck chassis with a 12,000# front axle, 21,000# air suspension rear
axle, to form a legal payload of 6 tons.

Safety and ease of operation have always been a top priority in the design of the Thermo -Lay. Safety
features include automatic extinguishing of the propane burner when any fluid pump is activated, making
it impossible to spray any fluid on the propane burner. The new hopper cleaning system coats the entire
inside surface of the hopper with the flip of switch at ground level, eliminating the need for the operator
to climb up upon the hopper prior to loading the heated asphalt. The new roller lift has an alarm that
continiously sounds while the lift is being raised or lowered and the amber strobe mounted on the lift
warns operators and passing traffic that the lift is being loaded or unloaded. The arrowboard and light
bar are raised 36" vertically, allowing the operators to set both warning and signaling from inside the
cab, before stepping out of the truck. Unlike any other heated asphalt machine, the Thermo -Lay has a
built-in 34 gallon propane tank that cannot come loose, fall off the truck, become stolen, or be subjected
to damage during a side impact collision. Plus, the propane tank can easily be monitored and filled from
ground level.

SUMMARY EXPLANATION: The purchase of a 2007 model patch truck has been budgeted.
The patch truck consists of two elements. First, is the cab and chassis that will be ordered
using a state purchasing contract. Second, is the hot asphalt and sanding machine body
"body" mounted on the aforementioned cab and chassis. Increases in service demands (size
of City and increased emphasis on street maintenance) have made it necessary to add this
capacity to the Street Division fleet. Authorization to proceed only with a sole source
purchasing agreement for the hot asphalt and sanding body is being requested in this action.
The attached resolution describes the rationale behind the sole source request indicating that
the formal bidding process would be futile because only one manufacturer/vendor meets the
City of Yakima's legitimate needs and specifications. The proposed equipment has proven to
be reliable, relatively trouble free, and is very familiar to the operating and maintenance staffs.
