R-2007--17 A RESOLUTION authorizing and directing the City Manager and City Clerk of the City of Yakima to execute a Participating Membership Agreement with the National Joint Powers Alliance (NJPA) and to take such actions as are necessary to register the City of Yakima as a participating public agency with NJPA. WHEREAS, the City of Yakima, desires to arrange for making cooperative purchases of certain goods and services with NJPA; and the City Council of the City of Yakima deems it to be in the best interests of the City that such an arrangement be carried out according to the provisions, terms and conditions of the attached agreement document; and, WHEREAS, pursuant to the provisions of RCW 39.34, the City of Yakima may enter into intergovernmental cooperative purchasing agreements with other public agencies in order to allow the parties of said agreements to cooperatively purchase or acquire supplies, equipment, and materials tinder contract and to utilize each other's contracts, as needs arise; and WHEREAS, NJPA is a governmental agency operating trader the legislative authority of Minnesota Statute 123A.21 that assists public agencies in reducing the cost of purchased goods through pooling the purchasing power of public agencies nationwide; this is accomplished through competitively solicited contracts for quality products through the national association's purchasing alliance; and WHEREAS, it is recommended to City Council that the City of Yakima register as • a participating public agency with the NJPA trader the terms and conditions set forth in the attached Participating Membership Agreement, which is incorporated herein by this reference; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1. The City Manager and City Clerk of the City of Yakima are hereby authorized and directed to take such action as are necessary to register the City of Yakima as a participating public agency with NJPA for the purpose mentioned above, a copy of which agreement, entitled "Participating Membership Agreement," is attached hereto and by reference made a part hereof. Witnesseth: That for a good and valuable consideration of the premises, mutual terms, covenants, provisions, and conditions hereafter set forth, it is agreed by and between the parties as follows: Whereas, the NJPA was created by the legislature (M.S. 123A.21) to assist in meeting specific needs of clients in participating Partnership Agencies which could be better provided cooperatively by NJPA than by the Partnership Agency themselves; and Whereas, the NJPA shall provide those programs and services which are determined to be priority needs of our Members and shall assist in meeting special needs which arise from fundamental constraints upon individual Government Agencies; and Whereas, the NJPA Board of Directors has established the ability for Partnership Agencies that desire to participate in NJPA contracts and procurement programs to become a Participating Member; and Whereas, the NJPA Board of Directors has determined that a Participating Member will have no financial or organizational liability to NJPA or it's organizational activities; and Now Therefore, it is hereby stipulated and agreed that this Govemment Agency desires to be a Participating Member of NJPA with contract purchasing benefits. BUSINESS OF THE CITY COUNCIL YAKIMA, WASHINGTON AGENDA STATEMENT Item No. f- ) 3 For Meeting Of February 6, 2007 ITEM TITLE: A Resolution authorizing a Participating Membership Agreement with the National Joint Powers Alliance for cooperative joint purchasing of computer equipment SUBMITTED BY: Dave Zabell, Assistant City Manager - 575-6040 CONTACT PERSON: Sue Ownby, Purchasing Manager - 576-6695 SUMMARY EXPLANATION: Staff respectfully requests approval of an agreement authorizing the City of Yakima and the National Joint Powers Alliance (NJPA), to arrange joint cooperative purchases of certain goods and services. Pursuant to Chapter 39.34 RCW Interlocal Cooperation Act, the Information Systems Division has requested this agreement be administered with NJPA in order to purchase computer equipment (keyboard, video and mouse switches and cables). NJPA is a governmental agency operating under the legislative authority of Minnesota Statute 123A.21, and allows participating agencies to piggyback their contracts, reducing the cost of purchased goods by leveraging their combined purchasing power. Execution of this agreement will also allow for future joint or cooperative purchases of goods and services between the City of Yakima and the NJPA.
