A RESOLUTION fixing March 8, 2007 as the date for a public hearing before
the Hearing Examiner concerning a petition to vacate a portion
of North 35th Avenue in the vicinity of River Road.
WHEREAS, pursuant to RCW 58.17.212, a petition has been filed with the City
Clerk, requesting the vacation of a public right-of-way located within the City of Yakima,
a true copy of which petition is attached and incorporated into this resolution as Exhibit
"A"; and -
WHEREAS, said petition has been signed by the owners of more than two-thirds
(2/3) of the property abutting upon the public right-of-way (or portion thereof) which is
requested to be vacated, as required by statute, Now, Therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The above -referenced -petition for vacation, attached hereto -and incorporated
herein as Exhibit "A", is hereby referred to the Hearing Examiner for public hearing
pursuant to section 1.43.080 of the City of Yakima Municipal Code. The Hearing
Examiner is directed to make written recommendation to the City Council regarding said
petition. The public hearing before the Hearing Examiner shall be held on Thursday,
March 8, 2007 at 9:00 a.m. in the City Council Chambers of City Hall, which date and
time are not more than sixty (60) bays -nor less than -twenty- (20) days after the -passage
of this resolution.
It is further resolved that the City Clerk give notice of the public hearing before the
Hearing Examiner in the form and manner prescribed by RCW 58.17.080, RCW
58.17.090 and Section 1.43.080 of the City of Yakima Municipal Code.

ITEM TITLE: Consideration of Resolution setting March 8, 2007 as the date for an
open record public hearing before the Hearing Examiner to consider a right-of-way
vacation request by Chesterley Meadows Cottages, LLC (Petition No. 06-19) to vacate
a portion of North 35th Avenue in the vicinity of River Road. The hearing will be held on
Thursday, March 8, 2007 at 9:00 a.m. in the City Council Chambers at City Hall.

SUMMARY EXPLANATION: Set March 8, 2007, as the date for a public hearing
before the Hearing Examiner to consider a request for a right-of-way vacation by
Chesterley Meadows Cottages, LLC. The applicant has submitted an application for
Class (2) approval to construct a 36 -unit senior housing complex adjacent to the
existing Chesterley Meadows assisted care facility. The proposal includes a request to
vacate the existing right-of-way on North 35th Avenue and relocate the street along the
perimeter of the site to create a commons area. Attached for City Council consideration
is a resolution initiating street vacation proceedings and setting March 8, 2007 as the
date for a public hearing before the Hearing Examiner.
