A RESOLUTION authorizing the City Manager to purchase BIOXIDE and associated
equipment from USFilter (A Siemens Business) as a sole source
purchase without calling for bids, and further directing the City
Manager to execute all appropriate and necessary documents to
complete the purchase and transaction.
WHEREAS, Article VI, section 6, of the City of Yakima Charter and the Yakima
Municipal Code Chapter 1.80 generally require that purchases over $25,000 be done by
competitive bidding, subject to certain exceptions; and
WHEREAS, the law recognizes a "sole source" exception from these competitive
bid requirements when, due to unique specifications and requirements and the fact
there is only one source, it would be futile to utilize competitive bidding for such
product; and
WHEREAS, the City of Yakima Wastewater Division requires the purchase of
equipment and BIOXIDE for corrosion and odor control at the Wastewater Treatment
Plant (WWTP) and sanitary sewer collection system; and
WHEREAS, capital costs are not expected to exceed $15,000 with chemical cost
estimated at $55,000 per year.
WHEREAS, BIOXIDE (nitrate salt) will control corrosion and odors by
chemically oxidizing sulfide and other sulfur compounds in the collection system thus
reducing odors in the collection system and WWTP; and
WHEREAS, there are several chemicals that can be used to treat sulfide odor in
collection systems such as sodium hydroxide , peroxide, sodium hypochlorite , and
ferrous chloride; and
WHEREAS, ferrous chloride is the least hazardous and expensive of these
chemicals; and
WHEREAS, BIOXIDE is safer to handle, and comparable in price to the ferrous
iron and would not have an adverse impact on the future Ultra Violet disinfection
system; and
WHEREAS, BIOXIDE has been successful at other facilities; and
WHEREAS, Siemens is the sole source provider of BIOXIDE for the removal of
dissolved Hydrogen sulfide and reduction of sewage BOD in sewers, as described in
US Patent #Re.36,651 and #Re.37,181; and
WHEREAS, USFilter is a Siemens business and is authorized to sell BIOXIDE; and
WHEREAS, the City Council finds it would be futile to call for bids regarding
the needed odor control BIOXIDE and equipment since only BIOXIDE will satisfy the
stated requirements and criteria and such is only available through USFilter; and
WHEREAS, the City Council finds that it is in the best interest of the City to
authorize the purchase of said chemical and equipment from USFilter as a sole source
purchase without calling for bids, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager is hereby authorized and directed to purchase BIOXIDE and
the equipment to disperse it to' the collection system for corrosion and odor control
from USFilter (A Siemens Business) as a sole source purchase without calling for bids,
and further directing the City Manager to execute all appropriate and necessary
documents to complete the purchase and transaction.

SUMMARY EXPLANATION:
Staff respectfully requests City Council consideration of a resolution authorizing sole source
procurement from USFilter. This would be a sole source purchase and formal bid
requirements would be waived, since USFilter (A Siemens Business) is the only authorized
dealer that sells BIOXIDE, along with the associated equipment for application. (See
attached Sole Source Letter from Siemens)

STAFF RECOMMENDATION: Adopt a resolution to authorize the City Manager to

source purchase without calling for bids, and further directing the City Manager to execute

When applied to a wastewater collection system BIOXIDE successfully controls corrosion
and odors by biochemically oxidizing sulfide and other sulfur compounds. Benefits can be
achieved in both the collection system and Wastewater Treatment Plant (WWTP). Capital
costs are not expected to exceed $15,000 with chemical costs estimated at $55,000 per year.
BIOXIDE is less hazardous and safer to use than other chemicals such as ferrous chloride,
peroxide, sodium hydroxide, and sodium hypochlorite. It is also comparable in price to the
least expensive chemical, ferrous chloride, and would not have an adverse impact on the
future Ultra Violet disinfection system at the Wastewater Treatment Plant .
Sole sourcing is proper because bidding to the desired requirements would result in only
one responsive and responsible submittal.
