R-2006-113 A RESOLUTION authorizing the execution of a Temporary Use Agreement with the Sports Center, LLC, permitting the ninety day temporary use of two parking spaces within the City's downtown parking lot No. 2, adjacent to the Millennium Plaza, subject to the terms and conditions set forth in said Agreement. WHEREAS, the Sports Center, LLC is a local downtown restaurant and lounge newly refurbished and doing business within the City of Yakima; and WHEREAS, the Sports Center has historically utilized a refuse container located across 2nd Street from the Sports Center, and directly behind Yakima Federal Savings and Loan; and WHEREAS, the Sports Center is now providing full meal service, thereby resulting in a much greater quantity of food -related refuse than was the case under the Sports Centers operation prior to renovation, thereby resulting in odor problems for the personnel working at Yakima Federal Savings and Loan; and WHEREAS, the present location of the Sports Center's refuse container is extremely inefficient and inconvenient for the Sports Center's current level of use; and WHEREAS, the City has the opportunity to assist the Sports Center and Yakima Federal Savings and Loan with the problems confronting them by providing a temporary location for the Sports Center's refuse container that is closer to the Sports Center, and farther away from Yakima Federal Savings and Loan; and WHEREAS, during the ninety days the City allows the Sports Center to utilize two parking spaces within the City's public parking lot number two for the location of a refuse container, the Sports Center will have an opportunity to complete arrangements for a more favorable and useful site to locate its refuse container; and WHEREAS, The Sports Center will pay the standard monthly temporary permit fee for each of the two parking spaces it will occupy during the ninety day temporary use period; and WHEREAS, it will benefit the City, the adjacent businesses and the citizens of Yakima to permit the Sport Center to relocate its refuse container away from other businesses and closer to its establishment while permanent arrangements for a refuse container are completed, Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager of the City of Yakima is hereby authorized and directed to execute the attached and incorporated Temporary Use Agreement to permit the Sports Center, LLC to (jc)res/Sports Center -Temp Use Agreement temporarily occupy two parking spaces in Yakima City Parking Lot Number 2, for the purpose of locating a refuse container thereon for no more than ninety days, under the terms and conditions of said Agreement. Discussion of Dumpster Location for Sports Center Bill Cook explained that Chris Malland, the new owner of the Sports Center Restaurant, is seeking resolution to a problem with their dumpster location. The dumpster for the Sports Center is currently located nearly a block away, behind Yakima Federal Savings and Loan. This situation is inconvenient for the employees of the Sports Center, and has created an aesthetic problem for the bank. Andy Miller, of Urban Place, gave a power point presentation related to dumpster issues/recommendations in downtown locations. Urban Place is prepared to study this specific request and prepare a recommendation for YDA. Bill Cook stressed that the Sports Center needs an immediate short-term solution to enable them to utilize space in the parking lot directly behind their building for a dumpster. Jamie Stickel reminded the Board that YDA does not control the lots, but instead serves in an advisory role to the City Council. It was the consensus of the YDA Board members present to endorse the request to temporarily allow the relocation of the dumpster to Parking Lot '2' until Urban Place is prepared to make a recommendation to the City Council for a permanent solution. Bill Cook will present the request for the temporary solution to City Council for consideration at their meeting on July 18, 2006. BUSINESS OF THE CITY COUNCIL YAKIMA, WASHINGTON AGENDA STATEMENT ITEM NO. 473 S3 FOR MEETING OF: JuIV 18, 2006 ITEM TITLE: Consideration of resolution authorizing approval of the issuance of a temporary permit to the Sports Center Restaurant for the use of two parking spaces in the City's downtown parking lot #2 (Millennium Plaza lot), with conditions, for a period not to exceed 90 days. SUBMITTED BY: illiam Cook, Director of Community & Economic Development CONTACT PERSON/TELEPHONE: SUMMARY EXPLANATION: Yakima Federal Savings and Loan has brought to our attention a concern they have with the current location of a dumpster located in a City alley along the south property line of their downtown Yakima Avenue office. This dumpster, owned and maintained by Yakima Waste Systems, collects food related refuse from the Yakima Sports Center located at 214 East Yakima Avenue. It appears that many years ago, perhaps at the time the City parking lot #2 was built (Millennium Plaza parking lot), the service alley behind the commercial properties on the south side of the 200 block of East Yakima Avenue was converted to a parking lot driveway. R-2006-113 As a result of this change, commercial dumpsters for three of the four buildings on this block are now located in the alley west of South Second Street, right outside the south public entrance to Yakima Federal Savings and Loan. The fourth building, the Olive Garden, built a notch into their building to provide a dumpster enclosure. There is some history to the Olive Garden's attempt to locate their dumpster in the City's parking lot #2, not unlike the request you are considering today. It would appear that for many years, the food service activities at the Yakima Sports Center did not generate the volume of food related refuse to create the problem we have today. However, the new Yakima Sports Center, with its' success has brought a significant increase in the use of their commercial dumpster and grease recycling storage. As a result, customers entering the Savings and Loan from Yakima Federal's parking lot are likely to be overwhelmed with the visual and aromatic. This issue was discussed with the Yakima Downtown Association on Thursday, July 13, 2006 and together with help from Urban Place Consultants, a recommendation was discussed for a 90 -day temporary solution while a more permanent fix is developed. The recommendation is a temporary use agreement to allow the Yakima Sports Center to erect a temporary enclosure on two parking spaces behind their building in the Millennium Plaza parking lot and to maintain the surface of the parking lot in its current condition and keep it clean throughout the duration of the lease.
