RESOLUTION NO. R 2006 - 73
A RESOLUTION authorizing a sole source procurement without calling for bids from
Solid Waste Systems whereby said entity shall install and refurbish a
used Curbtender refuse body on a new cab and chassis.
WHEREAS, Article VI, Section 6 of the City of Yakima Charter and the Yakima
Municipal Code Chapter 1.80 generally require that purchases over $25,000 be done by
competitive bidding, subject to certain exceptions; and
WHEREAS, the law recognizes a "sole source" exception from these competitive bid
requirements when, due to unique service requirements, it would be futile to utilize
competitive bidding; and
WHEREAS, installing a used Curbtender refuse body on a new cab and chassis is
in the best economic interests of the City of Yakima as it will save as much as $50,000
compared to purchasing a new body; and
WHEREAS, this project will require familiarity with the complicated intricacies of the
Curbtender body; and
WHEREAS, Solid Waste Systems is the exclusive Washington regional
representative for Wayne Engineering, the manufacturer of the Curbtender body and
owner of all proprietary information regarding the body and has offered to perform the
required work for a fee of $33,350.92 plus state sales tax; and
WHEREAS, as the exclusive regional representative, Solid Waste Systems has
access to factory discounted parts and specialized training directly from Wayne
Engineering; and
WHEREAS, it would be futile to utilize competitive bidding process for the purchase
of these services from any other entity than Solid Waste Systems, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager is hereby authorized to procure from Solid Waste Systems, as a
sole source procurement without calling for bids, installation and refurbishment services for
a used Curbtender refuse body on a new cab and chassis.

SUMMARY EXPLANATION: The City of Yakima Equipment Rental Division purchased a
used Curbtender refuse body for installation on a new cab and chassis. Specialized
proprietary knowledge and experience is required to install this body efficiently. Waiving of
the bid process and authorizing a sole source procurement is justified because going through
a bid process would result in no other qualified vendors and, therefore, the effort would be
futile.
