A RESOLUTION authorizing and directing the City Manager to execute an agreement
for drainage improvements to Roosevelt Avenue.
WHEREAS, the City desires to improve the drainage on Roosevelt Avenue to prevent
flooding of adjacent properties; and
WHEREAS, the City Council deems it to be in the best interest of the City to authorize the
City Manager to execute an agreement to accomplish needed improvements; now, therefore
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager of the City of Yakima is hereby authorized and directed to execute an
agreement for drainage improvements to Roosevelt Avenue. The agreement shall be in a final
form acceptable to the City Attorney.

CONTRACT
THIS AGREEMENT, made and entered into in triplicate, this Lfo day of Are: 1 , 2006, by and between the City
of Yakima, hereinafter called the Owner, and Ken Leingang Excavating, Inc., a Washington Corporation, hereinafter
called the Contractor
WITNESSETH.
That in consideration of the terms and conditions contained herein and attached and made a part of this agreement,
the parties hereto covenant and agree as follows:
I. The Contractor shall do all work and furnish all tools, materials, labor and equipment for THE BID
AMOUNT OF• $ 16,295.00, for Roosevelt Avenue Drainage Improvements, Project No. 2168, all in accordance with,
and as described in the attached plans and specifications and the 2006 Standard Specifications for Road, Bridge, and
Municipal Construction which are by this reference incorporated herein and made a part hereof, and shall perform any
alterations in or additions to the work provided under this contract and every part thereof.
Work shall start within ten (10) days after the Notice to Proceed and shall be completed in Five (5) working days. The
first chargeable working day shall be the 11th working day after the date on which the City issues the Notice to
Proceed.
If said work is not completed within the time specified, the Contractor agrees to pay to the Owner the sum specified in
the Standard Specifications for each and every day said work remains uncompleted after expiration of the specified
time, as liquidated damages.
The Contractors shall provide and bear the expense of all equipment, work and labor of any sort whatsoever that may
be required for the transfer of materials and for constructing and completing the work provided for in this contract and
every part thereof, except such as are mentioned in the specifications to be furnished by the City of Yakima.
II. The City of Yakima hereby promises and agrees with the Contractor to employ, and does employ the
Contractor to provide the materials and to do and cause to be done the above described work and to complete and
finish the same according to the attached plans and specifications and the terms and conditions herein contained and
hereby contracts to pay for the same according to the attached specifications and the schedule of unit or itemized
prices hereto attached, at the time and in the manner and upon the conditions provided for in this contract.
III. The Contractor for himself, and for his heirs, executors, administrators, successors, and assigns, does
hereby agree to the full performance of all the covenants herein contained upon the part of the Contractor.
IV It is further provided that no liability shall attach to the City of Yakima by reason of entering into this
contract, except as expressly provided herein.
IN WITNESS WHEREOF the parties hereto have caused this agreement to be executed the day and year first herein
above written.

RE: Request for bid for Drainage Improvements on Roosevelt Ave.
Perspective Bidder:
The City of Yakima is seeking bids to make minor drainage improvements in the vicinity
of Roosevelt Avenue and 34th Avenue. The work shall be completed by May 19, 2006.
This bid request is being sent to the following three contractors: Durand's Inc., Herke
Rock and Construction, and Ken Leingang Excavating, Inc.
The work on Roosevelt Avenue consists of purchasing and installing a new catch basin
type 1, purchasing and installing 12 -inch diameter PVC pipe from the new catch basin to
an existing catch basin (approx. 10 feet), replacing the curb and gutter removed to install
the new pipe and catch basin, and repairing the adjacent asphalt concrete pavement.
The work to be done on 34th Avenue is to construct an underground infiltration basin 40
feet long by 10 feet wide by five feet deep, which includes a 36 -inch diameter perforated
pipe. This work will require approximately 140 cubic yards of structure excavation
including haul; 40 linear feet of shoring; 38 linear feet of perforated pipe, 36 -inch
diameter; 120 tons of gravel backfill for drywell; connecting the new underground
infiltration basin to an existing drywell with 12 -inch diameter PVC pipe; and repairing
the roadway by placing 9 inches of crushed surfacing base course (approx. 24 ton) and 3
inches of commercial HMA (approx. 9 ton). These quantities are not guaranteed to be
accurate, and are listed only for the convenience of the contractor in submitting his bid.
The projects shall be completed within five (5) working days.
Please submit your lump sum bid, including tax, to the City's Engineering Division prior
to 2:00 pm on Monday, April 17, 2006, at which time the bids will be opened. The
project will be awarded to the low bidder.

NOTES
1. As acceptable alternatives to the rebar shown in the PRECAST BASE
SECTION, fibers (placed according to the Standard Specifications), or
wire mesh having a minimum area of 0.12 square inches per foot shall
be used with the minimum required rebar shown in the ALTERNATIVE
PRECAST BASE SECTION. Wire mesh shall not be placed in the
knockouts.
2. The knockout diameter shall not be greater than 20". Knockouts shall
have a wall thickness of 2" minimum to 2.5" maximum. Provide a 1.5"
minimum gap between the knockout wall and the outside of the pipe.
After the pipe is installed, fill the gap with joint mortar in accordance
with Standard Specification 9-04.3.
3. The maximum depth from the finished grade to the pipe invert shall be 5'.
4. The frame and grate may be installed with the flange up or down. The
frame may be cast into the adjustment section.
5. The precast base section may have a rounded floor, and the walls may
be sloped at a rate of 1:24 or steeper.
6. The opening shall be measured at the top of the precast base section.
7. All pickup holes shall be grouted full after the basin has been placed.

Attached is a resolution authorizing the City Manager to execute an agreement for drainage
improvements to Roosevelt Avenue. The existing drainage on Roosevelt Avenue, between
34th Avenue and 35th Avenue consists of one catch basin that drains to a drywell. Due to the
steep grade of Roosevelt Avenue in this area, the catch basin only captures a portion of the
stormwater runoff from the road. The runoff that bypasses the catch basin runs down the
Ponderosa Retirement Home driveway and floods their basement.
The work will include installing another catch basin, enlarging the existing drywell, and
constructing a wide asphalt berm to channel the water to the new catch basin.
