R-2006- 53 A RESOLUTION Accepting a petition requesting a boundary line adjustment between the City of Yakima and the City of Union Gap and directing that the petitions and Council Resolution be submitted to the City of Union Gap together with a request that Union Gap undertake the necessary action to effect this boundary line adjustment. WHEREAS, on March 29, 2006 William and Sally Douglas, owners of parcel number 191331-43006 and Printing Press Properties, LLC, owner of parcel number 191331-44004 submitted petitions requesting a boundary line adjustment of the city limits between the City of Union Gap and the City of Yakima that, would bring their respective properties into the City of Yakima; and WHEREAS, at its public meeting on April 4, 2006, the City Council detelinined by motion that the petition submitted by the affected property owners requesting a boundary line adjustment between the City of Yakima and the City of Union Gap should be affirmed and adopted; and WHEREAS, the legal description of the property to be affected is: All that part of the east half of the west half of the southeast quarter of Section 31, Township 13 North, Range 19 East, W.M., lying westerly of the city limits of Yakima, Washington; and WHEREAS, the requested boundary line adjustment between municipalities is allowed under the terms of RCW 35.13.340 now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The request for a boundary line adjustment is accepted and approved. Further the Council directs that the petitions and this Council Resolution be submitted to the City of Union Gap together with a request that Union Gap undertake the action(s) necessary to effect this boundary line adjustment. Additionally, the Council directs that any and all processes required for bringing the affected properties into conformance with the Yakima Urban Area Comprehensive Plan and the Yakima Urban Area Zoning Ordinance shall be undertaken. Page 1 of 1 RCW 35.13.340 Boundary line djustrne t Inclusion or exclusion of remaining porti n of parcel — When subject to reviewDefinition® The boundaries of a city shall be adjusted to include or exclude the remaining portion of a parcel of land located partially within and partially without *of the boundaries of that city upon the governing body of the city adopting a resolution approving such an adjustment that was requested in a petition signed by the owner of the parcel A boundary adjustment made pursuant to this section shall not be subject to potential review by the boundary review board of the county within which the parcel is located if the remaining portion of the parcel to be included or excluded from the city is located in the unincorporated area of the county and the adjustment is approved by resolution of the county legislative authority or in writing by a county official or employee of the county who is designated by ordinance of the county to make such approvals. Where part of a single parcel of land is located within the boundaries of one city, and the remainder of the parcel is located within the boundaries of a second city that is located immediately adjacent to the first city, the boundaries of the two cities may be adjusted so that all of the parcel is located within either of the cities, if the adjustment was requested in a petition signed by the property owner and is approved by both cities. Second Street Yakima, WA 98901 Dear Bill: RECEIVED MAR 2 4 2006 CITY COMMUNITYY F DEVELOPMENT We received your letter regarding the Longfibre Road Job Development Fund (JDF) project and wanted to respond to some of the questions and issues you raised prior to our meeting with Yakima's Economic Development committee on Friday. I agree that the JDF process will be competitive, and that this project may not one of Yakima's highest priorities. Per our conversation last week in Washington DC, I think it is best for Union Gap to take the lead on this project. The State has indicated that this is an acceptable change at this point, and having Union Gap be the applicant hopefully addresses Yakima's need to focus on a couple other critical projects. We still want Yakima to be a co -applicant on the Longfibre application, especially since a significant portion of the funding in this project will go towards improving the Yakima segment of Longfibre Road. In response to your question regarding the scope of improvements identified in the Longfibre project, let me assure you that significant funds are included to make interchange improvements at Washington Avenue and Longfibre Road. Specifically we have budgeted funds for right-of-way acquisition and turn lanes at this intersection. The overall design of this project will also meet your Title 12 development standards. SIED funding for a portion of this project has been reduced for a couple reasons. First, we discovered that sewer line extensions were not necessary in the vicinity of Valley Mall Boulevard. Union Gap has also learned that the demand for SIED funds is extremely high at the moment, and Dave McFadden is asking all potential applicants to pare back their requests or consider alternative funding resources. In light of this pressure on the SIED fund 1 do not believe it is realistic to suggest that this program could fund the $1.7 million Longfibre project. Dave can speak to this issue on Friday. IG\A. Y YG would also prefer to eliminate any temporary barriers, but we need to get a firmer grasp on how a traffic signal at Valley Mall Boulevard would be funded. The SIED planning grant focused on Longfibre Road should help illuminate equitable funding options for this traffic signal so I ask for your patience on this issue until we can hold discussions with private property owners along this street. We also want to have more discussions with Yakima's council members on this issue to ensure that all parties are involved in the resolution of this issue. Making improvements to Longfibre Road between Washington Avenue and Valley Mali Boulevard makes sense for Union Gap and Yakima. Safety at the Washington intersection is already problematic, and the existing Longfibre roadway in Yakima is in poor condition. A boundary adjustment made pursuant to this section shall not be subject to potential review by the boundary review board of the county within which the parcel is located if the remaining portion of the parcel to be included or excluded from the city is located in the unincorporated area of the county and the adjustment is approved by resolution of the county legislative authority or in writing by a county official or employee of the county who is designated by ordinance of the county to make such approvals. Where part of a single parcel of land is located within the boundaries of one city, and the remainder of the parcel is located within the boundaries of a second city that is located immediately adjacent to the first city, the boundaries of the two cities may be adjusted so that all of the parcel is located within either of the cities, if the adjustment was requested in a petition signed by the property owner and is approved by both cities. Approval by a city may be through either resolution of its city council, or in writing by an official or employee of the city who has been designated by ordinance of the city to make such approvals. Such an adjustment is not subject to potential review by the boundary review board of the county in which the parcel is located. Second Street Yakima, WA 98901 Dear Bill: RECEIVED MAR 2 4 2006 CITY OF YAKIMA COMMUNITY DEVELOPMENT We received your letter regarding the Longfibre Road Job Development Fund (JDF) project and wanted to respond to some of the questions and issues you raised prior to our meeting with Yakima's Economic Development committee on Friday. I agree that the JDF process will be competitive, and that this project may not one of Yakima's highest priorities. Per our conversation last week in Washington DC, I think it is best for Union Gap to take the lead on this project. The State has indicated that this is an acceptable change at this point, and having Union Gap be the applicant hopefully addresses Yakima's need to focus on a couple other critical projects. We still want Yakima to be a co -applicant on the Longfibre application, especially since a significant portion of the funding in this project will go towards improving the Yakima segment of Longfibre Road. In response to your question regarding the scope of improvements identified in the Longfibre project, let me assure you that significant funds are included to make interchange improvements at Washington Avenue and Longfibre Road. Specifically we have budgeted funds for right-of-way acquisition and turn lanes at this intersection. The overall design of this project will also meet your Title 12 development standards. SIED funding for a portion of this project has been reduced for a couple reasons. First, we discovered that sewer line extensions were not necessary in the vicinity of Valley Mail Boulevard. Union Gap has also learned that the demand for SIED funds is extremely high at the moment, and Dave McFadden is asking all potential applicants to pare back their requests or consider alternative funding resources. In Tight of this pressure on the SIED fund 1 do not believe it is realistic to suggest that this program could fund the $1.7 million Longfibre project. Dave can speak to this issue on Friday. In earlier discussions with Yakima's Economic Development committee a barricade was suggested as a means to control traffic temporarily along the 'Kill i :ink March 22, 2006 Page2of2 Longfibre roadway until the entire roadway project was completed. We would also prefer to eliminate any temporary barriers, but we need to get a firmer grasp on how a traffic signal at Valley Mail Boulevard would be funded. The VIOL planning grant focused on Longfibre Road should help illuminate equitable funding options for this traffic signal so I ask for your patience on this issue until we can hold discussions with private property owners along this street. We also want to have more discussions with Yakima's council members on this issue to ensure that all parties are involved in the resolution of this issue. Making improvements to Longfibre Road between Washington Avenue and Valley Mall Boulevard makes Sense for Union Gap -and Yakima. Safety at ti ie Washington intersection is already problematic, and the existing Longfibre roadway in Yakima is in poor condition.
