A RESOLUTION authorizing and directing the City Manager of the City of Yakima
("Yakima") to approve submittal of a Stormwater Grant Application with
the Washington State Department of Ecology naming Yakima as an agency
partnering with Yakima County ("County", the City of Moxee ("Moxee"),
the City of Sunnyside ("Sunnyside"), and the City of Union Gap ("Union
Gap") in such endeavor.
WHEREAS, pursuant to Chapter 39.34 of the Revised Code of Washington, entitled
"Interlocal Cooperation Act," Yakima has entered into an Interlocal Agreement for Development
and Implementation of Projects Related to Regional Stormwater Management Planning" with the
County, Moxee, Sunnyside and Union Gap; and
WHEREAS, the purpose and intent of entering into such Interlocal Agreement was to
allow Yakima and the partnering agencies to jointly submit for funding for stormwater planning
pursuant to the Washington State Department of Ecology ("Ecology") Stormwater Grants
Program; and
WHEREAS, under the Stormwater Grants Program, there are special partnership set-
aside grant provisions under which Ecology may make a special grant to a group of
municipalities who enter into a partnership through an interlocal agreement ("Special Partnership
Grant"); and
WHEREAS, pursuant to the Special Partnership Grant program, the partnering agencies
of Yakima, the County, Moxee, Sunnyside and Union Gap wish to continue their cooperative
approach to complying with state and federal standards for handling stoiniwater by securing a
Special Partnership Grant for their regional stormwater projects; and
WHEREAS, the City Council deems it to be in the best interestof the City of Yakima to
jointly pursue a Special Partnership Grant through Ecology's Stormwater Grants Program in
cooperation with the County, Moxee, Sunnyside and Union Gap, now, therefore;
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager of the City of Yakima is hereby authorized and directed to approve the
submittal of a Stormwater Grant Application with the Washington State Department of Ecology

naming the City of Yakima, Yakima County, the City of Moxee, the City of Sunnyside and the
City of Union Gap as partnering agencies.

SUMMARY - Please briefly summarize the project below and include how you will monitor success.
For the past four years, the cities of Yakima and Union Gap, and Yakima County have been working together, with support and
encouragement from Ecology's Central Regional Office in Yakima, to develop and implement a regional stormwater management
program (SMP). The intent was to use this as a model for the rest of the state to demonstrate how entities could work together to meet
their common NPDES Phase II and UIC regulatory compliance objectives.
The proposed draft stormwater management program followed the initial guidelines presented in Ecology's Model Municipal
Stormwater Program for Eastern Washington. Some BMPs were refined to address local conditions and annual and five-year budgets
were prepared Rate ordinances to develop SMP utilities for each entity were developed and reviewed with elected officials. Public
hearings were held on the programs during 2004, resistance was received from special interest groups, including the agricultural and
development community As a result, the stormwater issue and it's needed funding have become very high profile in the affected
community
In an effort to satisfy the public's desire to reduce the overall cost and size of the SMP, to develop a truly regional approach to
storniwater management, and to investigate alternative funding mechanisms, a Regional Stormwater Policy Group (RSPG) has
recently been formed, consisting of elected officials from Yakima County, and the cities of Yakima, Union Gap, Sunnyside and
Moxee. To solidify this group and to create a common financial commitment, an interlocal agreement has been developed and
approved by each of the five entities.
Our efforts to form one of the state's first regional stormwater management programs are at a critical stage. We have verbal
commitments from each of the five entities to develop a regional program. The problem that remains is funding. To date, the County
has been leading the effort and has been using/borrowing money from other funds to continue to support this regional stormwater
planning effort. The cities of Yakima and Union Gap have also been supporting this effort, but not to the same extent as Yakima
County The cities of Yakima, Union Gap, and Sunnyside were recently notified that they were eligible for a $75,000 financial
assistance grant through Ecology to develop an SMP. Unfortunately, the County was not eligible. Since the cities are relying upon the
County to lead this regional effort, the County's continued participation is critical. The County cannot continue to financially lead this
regional effort without funding assistance from Ecology.
The most recent regulatory requirements from Ecology (draft NPDES Phase tI Permit and draft UIC Rule) will require updates to
many of the earlier planning documents, including cost estimates and proposed funding. Without continued funding and leadership by
Yakima County, and all the currently interested jurisdictions, the regional approach will not succeed. We are prepared to take this
regional approach all the way with our public and elected officials, but Ecology assistance is needed to succeed and to get beyond this
current set of financial and deliberative hurdles. If we are not successful with this current regional planning effort, comprehensive,
effective, and efficient stormwater management in the Yakima River Basin will likely be set back for years. The development of a
regional program at this early stage of Phase II planning is extremely desirable

SUMMARY EXPLANATION:
(A and B) This Public Hearing concerns an ordinance deferring stormwater utility fees until
January of 2007. Last November, Council approved ordinance number 2004-73, which
established a stormwater utility. This ordinance stipulated that stormwater fees would begin in
January of 2006. Due to continued efforts to establish a regional stormwater management
plan with the County and adjacent cities, and expectant mid -year 2006 arrival of the National
Pollutant Discharge Elimination System (NPDES) Phase II eastern Washington general
permit, staff recommends that the City defer imposition of these fees until January 2007.

SUMMARY EXPLANATION:
This action would set November 1, 2005 as the date for a Public Hearing regarding legislation to defer
implementing Stormwater Utility fees until January 2007. Although Council approved the stormwater
utility ordinance last year, which would implement stormwater utility fees in January 2006, two general
concerns voiced by the public were: 1) the program and costs are not understood; and 2) a consolidated,
regional approach could reduce redundancy of effort and be more efficient. In response to this, a
regional stormwater policy group (RSPG) has been formed consisting of elected officials from Yakima,
Yakima County, Union Gap, Moxee and Sunnyside. One of the first tasks to be performed by the RSPG
will be to oversee a Value Engineering Study of the current draft of the stormwater management
program. Since this review of the proposed program will not happen until next year and the general
permit will not be issued until at least June of 2006, staff recommends deferring fees until January 2007.
