R-2005-107 A RESOLUTION of the City of Yakima, Washington, authorizing and directing the City of Yakima Community Review Board and the City of Yakima Division of Code Administration to identify and implement more effective means of controlling unlawful litter in the City of Yakima, including the use of educational materials, community outreach efforts, coordination of volunteer assistance, and notices of possible violation to persons who cause or allow unlawful litter to accumulate on property within the City of Yakima. WHEREAS, the City of Yakima Community Review Board ("CRB") has been duly created by law under Yakima Municipal Code ("YMC") Chapter 11.10, Neighborhood Conservation, as authorized by Ch. 35.80 RCW, Unfit Dwellings, Buildings, and Structures; WHEREAS, the CRB has been an effective and efficient means of addressing dwellings and premises within the City of Yakima that are unfit for human habitation, whether due to dilapidation, disrepair, structural defects, defects increasing the hazards of fire, accidents, or other calamities, inadequate ventilation and uncleanliness, inadequate light or sanitary facilities, inadequate drainage, over -crowding, or due to other conditions, including litter, which are inimical to the health and welfare of the residents of the City of Yakima; WHEREAS, the CRB has performed its role in a visible and pro -active manner, whereby not only have violations of Ch. 11.10 YMC been corrected, but also other persons throughout the community have been able to observe the CRB as an open and public body working to reduce the incidence of unfit dwellings and premises, thus leading to a deterrent effect for such problems City-wide; and WHEREAS, the City of Yakima continues to experience unacceptable rates of litter throughout the City of Yakima, some of which instances never result in formal CRB proceedings due to a variety of limitations; 1 WHEREAS, the CRB and the City •of Yakima Division of Code Administration have the opportunity, through educational material, community outreach efforts, coordination of volunteer assistance, and notices of possible violation to persons who cause or allow unlawful litter to accumulate on property within the City of Yakima, to have a larger impact throughout the City on the prevalence of litter; WHEREAS, the Yakima City Council finds and determines that it is in the public interest to adopt the resolution set forth herein; NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Yakima, Washington: The City of Yakima Community Review Board and the City of Yakima Division of Code Administration are hereby authorized and directed to identify and implement more effective means of controlling unlawful litter in the City of Yakima, including the use of educational materials, community outreach efforts, coordination of volunteer assistance, and notices of possible violation to persons who cause or allow unlawful litter to accumulate on property within the City of Yakima. This Resolution shall be effective after its adoption and for a period of one year from the date of its adoption, set forth below. Chris Waarvick, Director of Public Works CONTACT PERSON/TELEPHONE: Doug Maples, Code Adm. & Planning Manager Nancy Fortier, Refuse & Recycling Manager Joe Caruso, Supervising Code Inspector (509) 575-6257 SUMMARY EXPLANATION: The Litter Committee has proposed the following method to identify and implement more effective control of unlawful litter in the City of Yakima. o Volunteers will notify violators of litter problems through the use of door hangers and personal contact. o Door hangers will be logged and information sent to the Code Administration Office. o Volunteers will follow up on logged litter problems and will work with Code Enforcement Personnel when hired (proposed 2006 Refuse Division Policy Issue). o Unresolved litter problems will be brought before the Community Review Board (CRB) for abatement resolution. o The reason for a Resolution vs. Ordinance is that the CRB will expand their existing policies rather than add any additional enforcement. The following resolution will allow the Community Review Board and the Code Administration Division to merge all resources applicable by law, to have a larger impact on litter control.
