R-2005- 89 A RESOLUTION initiating street vacation proceedings regarding a portion of the north - south public right-of-way that was formerly South 80th Avenue lying west of the current South 80th Avenue and south of Tieton Drive; directing the Hearing Examiner to conduct a public hearing concerning said proposed street vacation; fixing a time for the public hearing; and providing for notice of the public hearing in accordance with applicable law. WHEREAS, pursuant to RCW 35.79.010, the legislative authority of the City of Yakima may initiate street vacation proceedings by resolution; and WHEREAS, the City has received a petition from adjoining property owners to vacate a portion of the north -south public right-of-way that was formerly South 80th Avenue lying west of the current South 80th Avenue and south of Tieton Drive; and WHEREAS, the Yakima City Council wishes to initiate said proceedings for the vacation of a street or alleyway (or portion thereof) within the City of Yakima, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: 1. Based upon the petition of adjoining property owners attached as Exhibit A and incorporated herein by this reference, a street vacation proceeding is hereby initiated regarding the portion of the north -south public right-of-way that was formerly South 80th Avenue Tying south of Tieton Drive, as shown on the map attached as Exhibit B and incorporated herein by this reference. A legal description of the subject area sought to be vacated is attached as Exhibit C and incorporated herein by this reference. 2. The City of Yakima Hearing Examiner is hereby directed to conduct a public hearing regarding said vacation. 3. The date and time for the public hearing is hereby set for 9 a.m., Thursday, July 14, 2005, in the Yakima City Council Chambers. 4. Notice of the public hearing shall be provided in accordance with RCW 35.79.020, YMC 1.43.080 and other (if any) applicable law. Mr. Loveless and two adjoining property owners have petitioned for the vacation of a portion of the north -south right-of-way that was formerly South 80th Avenue lying south of Tieton Dnve. All street improvements were removed from the subject property when Yakima County redesigned South 80th Avenue. Attached for City Council consideration is a resolution initiating street vacation proceedings regarding a portion of the north -south right-of-way that was formerly South 80th Avenue lying south of Tieton Drive and setting date of July 14, 2005 for public hearing before Hearing Examiner.
