A RESOLUTION ratifying the declaration of an emergency and authorizing the City
Manager to pay Western Peterbilt, Inc. for emergency repairs to a
fire damaged refuse truck without calling for bids.
WHEREAS, Article VI, Section 6 of the City of Yakima Charter and the City of
Yakima Municipal Code, Chapter 1.80 provide that the City Council may declare an
emergency dispensing with the necessity for bidding for services, material, and
equipment and supplies costing more than $25,000; and
WHEREAS, the City of Yakima incurred substantial damage to one of the Refuse
Division's automated sideloading refuse trucks from a fire; and
WHEREAS, the damage to the sideloading refuse truck presented a real,
immediate threat to the proper performance of essential Refuse Division functions; and
WHEREAS, it was essential to the welfare of the citizens of Yakima that
immediate action be taken to repair said truck; and
WHEREAS, the emergency repairs are now completed and the cost of the
services exceeds $25,000; and
WHEREAS, the City Council finds that an emergency existed requiring the City
to obtain immediate repair services for the sideloading truck without calling for bids;
now therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The declaration of an emergency requiring immediate repair services to the fire
damaged refuse truck is hereby ratified and the City Manager is hereby authorized to
pay Western Peterbilt, Inc. for those repair services without calling for bids. The City
Manager is further authorized to execute all necessary documents to effect said repair
transaction with Western Peterbilt, Inc.

SUMMARY EXPLANATION:
In January 2005, an automated sideloading refuse truck was involved in a fire in the
Equipment Rental Division repair shop. The fire was contained by the facility's fire
suppression system and extinguished by the City of Yakima Fire Department.
Damage to the vehicle was extensive but limited to the batteries, wiring, hydraulic
hoses, hydraulic system components, and smoke damage to paint on the body. An
emergency condition was declared because the truck needed to be returned to
service as soon as possible. The vendor who provided the truck was immediately
contacted to begin the work as many factory specific components were required. Due
to the extent and complexity of the repairs, it was impossible to provide a repair
estimate. As a frame of reference, replacement cost of this vehicle would exceed
$200,000. Repairs are complete and the truck is back in service. Repair costs were
$36,224.50.
