A RESOLUTION authorizing the City Manager to execute a Letter of Agreement between the
City of Yakima, the International Association of Firefighters Local 469
representing LEOFF employees, and the Yakima Public Safety Managers
Guild regarding long-term acting Battalion Chief assignments for the third
Battalion Chief position through 2006.
WHEREAS, it appears that there will be a vacancy in the Yakima Public Safety Managers
Guild of one Battalion Chief position; and
WHEREAS, the position will not be re -filled at least through the end of 2006; and
WHEREAS, the parties have agreed on the following provisions to apply to acting
Battalion Chief assignments for the third Battalion Chief position through 2006; and
WHEREAS, the City Council has determined that it is in the best interest of the City of
Yakima to resolve the issue of acting Battalion Chief assignments for the third Battalion Chief
position through 2006 in accordance with the terms and conditions of the attached Letter of
Agreement, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager of the City of Yakima is hereby authorized to execute the attached and
incorporated "Letter of Agreement Regarding Long -Term Acting Battalion Chief Assignments for
the Third Battalion Chief Position" between the City of Yakima, the International Association of
Firefighters Local 469 representing LEOFF employees, and the Yakima Public Safety Managers
Guild.

LETTER OF AGREEMENT
"FIRST RIGHT OF REFUSAL"
This agreement is made by and between the International Association of Firefighters
Local 469 representing LEOFF employees (Local 469), the Yakima Public Safety
Managers Guild (YPSMG), and the City of Yakima, Washington (City).
Whereas, all three parties mentioned above have been engaged in negotiations regarding
the Battalion Chiefs overtime.
Whereas, the City of Yakima and the Battalion Chiefs currently have a Collective
Bargaining Agreement called a "Memorandum of Understanding" that will be amended
pending the outcome of these negotiations.
Whereas, Local 469 has unilaterally dropped the Unfair Labor Practice posted November
2004 without reciprocal conditions by the City of Yakima prior to the terms of this
agreement.
Therefore in consideration of the conditions stated above, this agreement is written to
outline the procedure for filling Battalion Chief positions when a Battalion Chief takes
time off.
1. Local 469, the YPSMG, and the City agree that in the event of a vacancy created
by the shift Battalion Chief (BC herein) due to the use of Kelly Days, vacation time,
holiday time, union leave, administrative leave, or sick/disability leave, the Department
shall fill the position in the following manner:
a) If the on -duty shift has a qualified Captain available without compromising the
minimum staffing then an on -duty qualified Captain shall fill the vacant BC
position.
b) If on -duty shift personnel are unable to fill the BC vacancy with an on -duty
Captain then an off-duty BC shall be offered the opportunity to backfill the vacant
BC position.
c) If there are no off-duty BC's available to backfill the vacant position then a
qualified on -duty Captain of the shift with vacancy shall be "bumped — up" to the
acting BC position. An off-duty Captain shall then be hired to fill the vacancy
created by the on -duty Captain's vacancy.
d) If there are no qualified on -duty Captains available on the vacant BC shift then a
qualified off-duty Captain shall be offered the work.
e) The roster will be set by 2100 hours of the shift before the affected shift.

2. The YPSMG and the City agree to amend the current collective bargaining
agreement between them as follows:

3. Local 469 shall recognize the BC's as a sanctioned Collective Bargaining
Union called the "Yakima Public Safety Managers Guild".
This agreement will be in effect immediately upon signing by the IAFF, the
YPSMG, and the City.
All parties do hereby agree to abide by the terms and conditions set forth in this
agreement.

ITEM TITLE: Consideration of resolutions authorizing the City Manager to execute Letters

SUMMARY EXPLANATION:
The first proposed Letter of Agreement provides that the third Battalion Chief position, once
vacant, will not be re -filled through 2006 and sets forth provisions to apply to long-term Acting
Battalion Chief assignments to cover that position. The Agreement automatically terminates in
the event of budgetary elimination of the Battalion Chief positions. The second proposed
Letter of Agreement provides a procedure for filling Battalion Chief positions when a Battalion
Chief takes time off.
These proposed Letters of Agreement are a compilation of negotiations between the Battalion
Chief Guild, IAFF Local 469, Fire Administration, and City Management Considerable
concessions and cooperation from the collective bargaining units made these agreements
possil,le. Extensive benefits are derived from the agreements: fire fighter and public safety
standards are maintained, budgetary savings of approximately $120,000 (spreadsheet is
attached) are realized, and there are increased opportunities for professional development and
training of command officers
The Budget Strategy Team has worked diligently regarding the Battalion Chief budget
reduction and has submitted a letter of recommendation supporting the proposed Letters of
Agreements (attached).

Subject: Budget Recommendation re: Position of Fire Battalion Chief
The Budget Strategy Team (BST) of the City of Yakima recommends that the City
Council approve the management/union negotiated agreements regarding the position of
Fire Battalion Chief as outlined in the following two attachments: (1) the Letter of
Agreement — "First Right of Refusal" and (2) the Letter of Agreement — Long -Term
Acting Battalion Chief Assignments for the Third Battalion Chief Position. We further
recommend that the previous draft proposal by the BST to eliminate the three Battalion
Chief positions be removed from a Tier I item in the City's Contingency Budget
Reduction Plan (CBRP) but be retained as a potential budget reduction option in the
CBRP should further reductions be necessary in the future. Additionally, we recommend
that this position be re-evaluated for elimination when the above noted
management/union agreements expire.
It should be noted that the BST's intention in previously proposing the elimination of the
three Battalion Chief positions was to reduce both costs and layers of management within
the Fire Department. While we still believe these are desirable objectives, we recognize
that there may be other ways to achieve them. We appreciate the fire department
employees' and the unions' efforts in assisting the City in identifying cost reduction
options. While the elimination of the position of Fire Battalion Chief achieves greater
cost savings than does the unions' proposal, we believe the employees and the unions
have made significant progress in this effort and we accept their proposal in good faith
that their efforts will continue.
The BST further recommends that the City, the employees and the unions work together
to further reduce costs and management overhead and to increase efficiencies within the
Fire Department through continued cost reduction efforts and by expanding
management's scope of duties through regionalization.

ADDENDUM TO MEMORANDUM OF UNDERSTANDING
1. The purpose of this agreement is for clarification of a procedural process and is to serve
as an addendum to the MOU that refers to the long term acting assignment for Acting
Battalion Chief scheduled to expire December 31, 2006.
2. A Long - Term acting assignment may be exercised when a ranking suppression or staff
officer ("officer" herein) of the Yakima Fire Department is absent for a confirmed
amount of time from active duty. In the event the officer can determine a minimum of
one month of leave then the Long -Term acting assignment shall then be made available.
3. In light of the extended vacancy in the rank of Battalion Chief, the union shall permit fire
management to re -use the current list of acting Captains and Lieutenants, once the
rotation has been exhausted for purposes of long term acting assignments This
specifically means that once everyone on the list has received a temporary long-term
acting assignment and the list is exhausted, it is agreeable for fire management to start
over at the top of the list should the need for long-term temporary acting assignment
becomes necessary. It is mutually understood and agreed that this may result in an
employee receiving more than one long-term temporary acting assignment in a 12 -month

General Rules and Regulations of the Civil Service Commission for Fire Department
Employees of the City of Yakima.
5. The language stated herein shall expire in concert with the terms and conditions of the
MOU formerly mentioned.
