R-2005-62 A RESOLUTION authorizing the City Manager to execute a Letter of Agreement between the City of Yakima, the International Association of Firefighters Local 469 representing LEOFF employees, and the Yakima Public Safety Managers Guild regarding the procedure for filling Battalion Chief positions when a Battalion Chief takes time off. WHEREAS, the City has engaged in negotiations with the International Association of Firefighters Local 469 representing LEOFF employees and the Yakima Public Safety Managers Guild regarding the procedure for filling Battalion Chief positions when a Battalion Chief takes time off, and WHEREAS, the parties have expressed a desire to agree to the procedure outlined in the attached Letter of Agreement; and WHEREAS, the City Council has determined that it is in the best interest of the City of Yakima to resolve the issue of how to fill Battalion Chief positions when a Battalion Chief takes time off in accordance with the attached Letter of Agreement, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager of the City of Yakima is hereby authorized to execute the attached and incorporated "Letter of Agreement `First Right of Refusal' between the City of Yakima, the International Association of Firefighters Local 469 representing LEOFF employees, and the Yakima Public Safety Managers Guild. ATTEST: City Clerk Paul P.George, Mayor LETTER OF AGREEMENT REGARDING LONG-TERM ACTING BATTALION CHIEF ASSIGNMENTS FOR THE THIRD BATTALION CHIEF POSITION This agreement is made by and between the International Association of Firefighters Local 469 representing LEOFF employees (IAFF), the Yakima Public Safety Managers Guild (YPSMG), and the City of Yakima, Washington (City), and is intended to set forth provisions to apply to long-term Acting Battalion Chief assignments for the third Battalion Chief position through 2006. All parties agree to the following: 1. The third Battalion Chief position, once vacant, will not be re -filled for the term of this agreement. 2. A Battalion Chief promotional exam will be administered as soon as practicable. 3. Qualified Acting Battalion Chiefs will be selected and assigned by the Fire Chief to fill in the third Battalion Chief position during the term of this agreement. 4. The term of each acting assignment for the third Battalion Chief position will be at the discretion of the Fire Chief but for a maximum period of one year. 5. The Acting Battalion Chiefs time off will be considered as one (1) of the five (5) bargaining unit members allowed off pursuant to Article 22.5 (a) of the LEOFF Collective Bargaining Agreement between the City and IAFF. 6. This agreement will be effective immediately upon signing by the IAFF, the YPSMG, and the City, and will terminate on December 31, 2006, unless terminated earlier pursuant to section 7, below. 7. This agreement will immediately terminate in the event of the budgetary elimination of the Battalion Chief positions. SUBMITTED BY: Yakima Fire Department, Dennis Mayo, Fire Chief CONTACT PERSON/TELEPHONE: Steve Scott, Deputy Chief, 575-6165 SUMMARY EXPLANATION: The first proposed Letter of Agreement provides that the third Battalion Chief position, once vacant, will not be re -filled through 2006 and sets forth provisions to apply to long-term Acting Battalion Chief assignments to cover that position. The Agreement automatically terminates in the event of budgetary elimination of the Battalion Chief positions. The second proposed Letter of Agreement provides a procedure for filling Battalion Chief positions when a Battalion Chief takes time off. These proposed Letters of Agreement are a compilation of negotiations between the Battalion Chief Guild, IAFF Local 469, Fire Administration, and City Management. Considerable concessions and cooperation from the collective bargaining units made these agreements possible. Extensive benefits are derived from the agreements: fire fighter and public safety standards are maintained, budgetary savings of approximately $120,000 (spreadsheet is attached) are realized, and there are increased opportunities for professional development and training of command officers. The Budget Strategy Team has worked diligently regarding the Battalion Chief budget reduction and has submitted a letter of recommendation supporting the proposed Letters of Agreements (attached). Potential Savings by only filling BC position with overtime hiring if staffing drops below minimum. Overtime impacts may be a wash transfer from 032122522.10 to 032122522.20.
