A RESOLUTION authorizing an application for a grant in the total amount of
$78,464 from the United States Department of Justice, Bureau of
Justice Administration, Edward Byrne Memorial Justice
Assistance Grant Program, and designating and authorizing the
City Manager to act as the official representative of the City of
Yakima and to take such additional steps, including but not limited
to execution of all documents and contracts necessary to complete
said grant transaction.
WHEREAS, the U.S. Department of Justice, Bureau of Justice Administration,
Edward Byrne Memorial Justice Assistance Grant Program, has grant funds available to
local governments to support efforts to reduce crime and improve public safety; and
WHEREAS, the Yakima Police Department has been notified that $78,464 in
grant funds have been allocated to the City of Yakima and Yakima County and are
available upon submission of a completed grant application and satisfaction of certain
conditions; and
WHEREAS, one of the grant approval conditions is that the City and County
execute an Interlocal Agreement whereby the City shall transfer $28,247 of the grant
monies to the County to support law enforcement activities of the Yakima County
Sheriff's Department; and
WHEREAS, the City Council of the City of Yakima considered this matter at an
open public meeting in which citizens were provided an opportunity to comment and
deems it to be in the best interest of the City to authorize submission of an application to
the Justice Assistance Grant Program for said available funds and execution of all
necessary documents and contracts to complete said grant transaction, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
1. The City Manager or his designee is hereby authorized to submit a
completed grant application to the United States Department of Justice,
Bureau of Justice Administration, Edward Byrne Memorial Justice
Assistance Grant Program, to obtain a grant to fund local efforts to reduce
crime and improve public safety.
2. The City Manager or his designee is further authorized and directed to
accept the grant on behalf of the City of Yakima, and to take all steps and
execute all documents and contracts necessary to complete this grant
transaction, including but not limited to execution of the attached Interlocal
Agreement with Yakima County whereby Yakima County shall receive a
portion of the grant proceeds for local law enforcement efforts.

INTERLOCAL AGREEMENT
BETWEEN CITY OF YAKIMA AND YAKIMA COUNTY
2005 BYRNE JUSTICE ASSISTANCE GRANT (JAG) PROGRAM AWARD
This Agreement is made and entered into this '4 day of ,n , 2005, by
and between CITY of YAKIMA, acting by and through its governing body, the City Council,
hereinafter referred to as the CITY, and, YAKIMA COUNTY acting by and through its
governing body, the Board of Commissioners, hereinafter referred to as the COUNTY, both of
Yakima County, State of Washington, witnesseth:
WHEREAS, this Agreement is made under the authority of the Interlocal Cooperation Act, as
amended, and codified in Chapter 39.34 of the Revised Code of Washington provided for
interlocal cooperation between governmental agencies; and
WHEREAS, each governing body, in performing governmental functions or in paying for the
performance of governmental functions hereunder, shall make that performance or those
payments from current revenues legally available to that party; and
WHEREAS, each governing body finds that the performance of this Agreement is in the best
interests of both parties, that the undertaking will benefit the public, and that the division of costs
fairly compensates the performing party for the services or functions under this agreement; and
WHEREAS, the CITY agrees to provide the COUNTY $28,443.00 from the JAG award to
support the Yakima County Sheriff's Department; and
WHEREAS, the CITY and the COUNTY believe it to be in their best interests to reallocate the
JAG funds.
NOW THEREFORE, the CITY and the COUNTY agree as follows:
Section 1.
The CITY agrees to pay the COUNTY a total of $28,443.00 of JAG funds to the County for the
purchase of computers, car radios, and light bars for utilization in law enforcement vehicles of
the Yakima County Sheriffs Depai tment.
Section 2.
The COUNTY agrees to use $28,443.00 for the purchase of computers, car radios, and light bars
for utilization in law enforcement vehicles of the Yakima County Sheriff's Department. GMS

Section 3.
Each party to this Agreement will be responsible for its own actions in providing services under
this Agreement and shall not be liable for any civil liability that may arise from the furnishing of
the services by the other party.
Section 4.
The parties to this Agreement do not intend for any third party to obtain a right by virtue of this
Agreement.
Section 5.
By entering into this Agreement, the parties do not intend to create any obligations express or
implied other than those set out herein; further, this Agreement shall not create any rights in any
party not a signatory hereto.
Section 6
A copy of this Agreement shall be filed with the Yakima County Office.

Resolution Authorizing Law Enforcement Grant Application with the

SUMMARY EXPLANATION:
The City has been invited to apply for a grant from the U.S. Department of Justice, Bureau
of Justice Assistance under the Edward Byrne Memorial Justice Assistance Grant
program. The purpose of the program is to reduce crime and improve public safety. The
grant will be requested in the amount of $78,464. The City of Yakima and Yakima County
will share the funds per a Memorandum of Understanding as required by the Department
of Justice. The attached resolution authorizes the grant application and the City Manager
to act as the official representative to accept the grant.
The grant will be used to support law enforcement efforts by procuring equipment,
technology and other material directly related to basic law enforcement functions as well
as providing some staffing and equipment needs of the Yakima Police Athletic League.
The Justice Assistance Grant Program requires that the City execute an interlocal
agreement with Yakima County, whereby the Yakima Sheriffs Department shall receive
$28,247, of the $78,464 grant award.
