A RESOLUTION authorizing and directing the City Manager to pay $7,500 to the
Central Washington Fair Association to pay for the professional
services of Landerman-Moore Associates related to evaluation and
analysis of zoning of the Central Washington State Fairgrounds and
potential annexation of the Fairgrounds to the City Of Yakima.
WHEREAS, the Central Washington Fair Association has retained Landerman-
Moore Associates to provide professional services related to evaluation and analysis of
zoning of the Central Washington State Fairgrounds and potential annexation of the
Fairgrounds to the City Of Yakima consistent with the attached January 13, 2005
memorandum from Landerman-Moore Associates; and
WHEREAS, in a January 10, 2005 letter, the Central Washington Fair
Association estimated that an additional $22,500 was necessary for Landerman-Moore
Associates to complete said project; and
WHEREAS, in the January 10 letter, the Central Washington State Fair
Association represented that Yakima County had agreed to pay $7,500 of said $22,500,
and requested that the City of Yakima also contribute $7,500 to the Association to pay
for the professional services of Landerman-Moore Associates to complete said project;
and
WHEREAS, the City Council deems it to be in the best interest of the City to
authorize the payment of $7,500 to the Central Washington Fair Association to pay for
the professional services of Landerman-Moore Associates related to evaluation and
-analysis of zoning of the Central Washington State Fairgrounds and potential
annexation of the Fairgrounds to the City Of Yakima, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager is hereby authorized and directed to pay $7,500 to the Central
Washington Fair Association to pay for the professional services of Landerman-Moore
Associates related to evaluation and analysis of zoning of the Central Washington State
Fairgrounds and potential annexation of the Fairgrounds to the City Of Yakima.

Legal Expenses / Annexation
Dick,
As you are aware, we have been aggressively reviewing the annexation of the fairgrounds to
the City of Yakima. In that effort, we have hired the guide and services of Norm Landerman-
Moore. In previous meetings, you have had the opportunity to meet Mr. Moore, and I am sure
you will agree that he presents himself as the very knowledgeable individual.
We have certainly been impressed with the cooperative effort on the parts of the City of Yakima
and the County of Yakima on working towards annexation.
To complete the project, we would like to request a financial partnership between the three (3)
parties, for the expense of using the services of Norm Landerman-Moore. We estimate the
expense to the completion of this project to be approximately $22,500.00. The County of
Yakima has agreed to contribute $7,500.00 towards these services and the Fair Association is
willing to match the $7,500.00 expenditure. We respectfully request a contribution in the same
amount from the City of Yakima, so that we will be able to complete this project successfully.
To date our expenditures have been approximately 2/3 of the funds collected, so in an effort to
keep this project moving forward, we would certainly appreciate the City of Yakima granting our
request.
I believe this is a great example of inner -agency partnership and is a positive factor in helping
create a prosperous future for our community.

MEMORANDUM
With reference to your request this morning regarding additional services and status
of fees and expenses, the following applies.
• Fees for services related to Annexation and Zoning were established on
the basis of time and expenses. This was due to a discovery process
required to address a number of unknown issues and conditions.
• The projected cost for services originally discussed, as understood by the
general objectives set forth by the Committee, was $25,000 to $26,000.
this amount included reimbursable expenses.
• To date, LMA has invoiced a total amount of $19,564.01. Yakima County
has agreed to pay $7,500 and the CWSF has paid, or is in the process of
paying, the balance, $12,064.01.
• Projected fccs and expenses to continue services for Annexation and
Zoning efforts, considering what has been accomplished, what we know
and the perceived work to be done, should be budgeted at $10,000 to
$15,000. The general scope of the work, as previously established,
would remain as follows:
1. Research and evaluate comparative fairground zoning
ordinances.
2. Evaluate existing zoning of the Central Washington State
Fairgrounds, local codes relevant to land use regulations,
GMA provisions and other statutes and procedures pertaining
to annexation and zoning issues.
3. Prepare analysis and draft annexation procedures, zoning
language and prepare other documentation associated with a
determination to annex the subject properties to the City of
Yakima and establish effective land use controls.
4. Participate in meetings, conference calls, reviews and
presentations involving the Central Washington State Fair
Association, Yakima County and City of Yakima.
5. Organize, prepare and transmit all relevant findings,
evaluations and documents, and provide consultation as may
be required.
I have included our current Hourly Rates & Billing Policy. I hope this will assist in
consideration of LMA continuing to assist the Central Washington State Fair
Association in this important matter.

Whereas: for the purposes of facilitating the Annexation & Zoning of the Central
Washington State Fairgrounds and all parcels pertaining thereto inclusive
of Yakima County and Central Washington State Fair Association
properties, as herein identified:

Whereas: The proposed annexation and zoning is viewed as being in the public
interest in terms of effective land use, economic development principles
and purveyance of public services within the Yakima Urban Growth Area,
and
Whereas: The Central Washington State Fair Association, which holds title to the
land through a lease with Yakima County, and with the concurrence of
Yakima County, has determined to establish this Memorandum of
Understanding (M.O.U.) with the City of Yakima. The purpose of which
is to establish concurrence of basic principles, obligations and
responsibilities pertaining to the intent to annex said properties; establish a

zoning ordinance which effectively protects historic and existing uses; and
regulates future uses of the property in terms of maintaining highest and
best use values of the Central Washington State Fairgrounds in perpetuity.
Now, therefore, it is understood and agreed:
1. That Yakima County, in association and concurrence with the Central
Washington State Fair Association, shall issue a Letter of Intent to Annex said
parcels to become a part of the jurisdiction of the City of Yakima.
2. That the annexation and/or pending zoning ordinance does not infer the
transfer of governing authority of the Central Washington State Fairgrounds
by Yakima County to the City of Yakima.
3. That a zone ordinance, herein referenced as the 'F' Zone, as attached hereto,
shall be reviewed and adopted by the City of Yakima in context and intent of
the language recited and as specifically pertaining to permitted uses,
conditional uses and land use classifications as therein described.
4. That diligence shall be exercised by all parties to ensure an expeditious
annexation process and passage of the 'F' Zone Ordinance in a timely manner.
5. That the parties signatory hereto shall exercise diligence in providing factual
information to the general public as to the purpose, benefits and outcomes of
this pending annexation and zoning procedure.

expense, or as provided within a specific professional services agreement.

relevant to a requested assignment or stated within the terms of a services contract.
Invoices transmitted for services rendered are due and payable upon receipt unless an agreed
payment schedule has been established. Invoices not paid within thirty (30) calendar days of
date of invoice are subject to a dehnquent payment charge equal to 5% of the total
outstanding invoice.

Associates to Provide Evaluation and Analysis of Zoning and Annexation

SUMMARY EXPLANATION: Over the last six months, Yakima County, the City of Yakima
and the Central WA State Fair have been working with Landerman-Moore Associates to finalize
the annexation process and zoning for the balance of the Central WA State Fair property, which
exists as an unincorporated island within the city limits. The Central WA State Fair and Yakima
County have asked the City of Yakima to share equally in the cost of Mr. Landerman's contract
in a cooperative effort to complete and work towards this annexation. In that regard,
Greg Stewart, President and General Manager of Central WA State Fair, is requesting a
contribution of $7500 from the City of Yakima to complete this project. The partnership
between Yakima County and Central WA State Fair, together with the City of Yakima, has been
positive and an example of good interagency cooperation to create a more prosperous future for
this valley.
