A RESOLUTION initiating street vacation proceedings and fixing a time for a public
hearing before the Hearing Examiner on January 7, 2005 to vacate a portion of Pierce
Street and South 18th Avenue.
WHEREAS, pursuant to RCW 35.79.010, the legislative authority of the City of Yakima
may initiate street vacation proceedings by resolution; and
WHEREAS, the Yakima City Council wishes to initiate said proceedings for the vacation
of a street or alleyway (or portion thereof) within the City of Yakima, as more
specifically identified and described on the attached Exhibit A, which is incorporated by
this reference as if fully set forth herein; and
WHEREAS, notice of a hearing on said vacation is to be disseminated as provided by
law, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
Proceedings for the vacation of the above -referenced street or alleyway (or
portion thereof) shall be hereby initiated. The City shall give notice of a hearing on said
vacation as provided by law, to include not less than twenty days' notice of the place and
time fixed for the hearing by a written notice posted in three of the most public places in
the City of Yakima and a like notice in a conspicuous place on the street or alleyway
sought to be vacated, and shall also give not less than fifteen days' notice of the same by
mail to all owners or reputed owners of all lots, tracts, or parcels of land or other property
abutting upon the street or alleyway sought herein to be vacated, as shown on the rolls of
the county treasurer, directed to the address thereon shown. The above -referenced
vacation is hereby referred to the Hearing Examiner for public hearing pursuant to
section 1.43.080 of the City of Yakima Municipal Code. The Hearing Examiner is
directed to make written recommendation to the City Council regarding said vacation.
The Hearing Examiner Public Hearing shall be held on January 7, 2005 at 1:30 p.m. in
the City Council Chambers of City Hall, which date and time are not more than sixty (60)
days nor less than twenty (20) days after the passage of this resolution.
It is further resolved that the City shall in all other respects give notice of the hearing in
the form and manner prescribed by RCW 35.79.020 and Section 1.43.080 of the City of
Yakima Municipal Code.

SUMMARY EXPLANATION:
The Hearing Examiner for the City of Yakima has recommended that City Council
initiate the vacation of that portion of Pierce Street lying westerly of N. 16th
Avenue to South 18th Avenue and that portion of South 18th Avenue lying
northerly of Perry Street and southerly of Pierce Avenue. On November 19,
2004, the Hearing Examiner approved an application by D. H. Construction &
Development, Inc. for the alteration of a plat, except for vacation of City street
rights of way therein. You are being asked to set the date for this open record
public hearing before the Hearing Examiner on January 7, 2005.
