A RESOLUTION authorizing and directing the City Manager and the City
Clerk of the City of Yakima to execute a quit claim
deed to G.C. II, LLC, a Washington limited liability
company, as part of a property exchange in the vicinity
of Ranchrite Road and E. Nob Hill Blvd. in the City of
Yakima, Washington.
WHEREAS, the City of Yakima ("City") and G.C. II, LLC, a
Washington limited liability company ("G.C. II"), have arranged for an
exchange of real property interests in the vicinity of Ranchrite Road and
E. Nob Hill Blvd. in the City of Yakima, Washington; and
WHEREAS, said exchange provides the City of Yakima with useful
and beneficial right of way dedicated to the City by G.C. II, which right of
way fronts on E. Nob Hill Blvd., in exchange for the conveyance to G.C. II
of a strip of land adjacent to property owned by G. C. II, provided,
however that the City shall reserve an easement for sewer main
purposes; and
WHEREAS, the Yakima City Council finds and determines that it is
in the public interest to effectuate said exchange by the conveyance
described herein and in that certain quit claim deed attached hereto and
incorporated herein by this reference, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
YAKIMA:
The City Manager and the City Clerk of the City of Yakima are
hereby authorized and directed to execute a quit claim deed in favor of
G.C. II, LLC, in the form attached hereto and by reference made a part
hereof.

THE GRANTOR, City of Yakima, a Washington municipal corporation, for valuable
consideration, conveys and quit claims to G.C. II, LLC, a Washington limited liability company
(the grantee), the following described real estate, situate in Yakima County, Washington,
together with all after acquired title of the grantor therein:
That portion of Lot 9, The Fairchild Acre Tracts as recorded in Volume "A"
of Plats, Page 115, records of Yakima County Washington described as
follows: The West 8 feet of the South 125 feet; and the West 10 feet of the
North 100 feet, except for the right-of-way for Nob Hill Boulevard;
TOGETHER WITH
That portion of Section 30, Township 13 North, Range 19 East W. M.,
beginning at the Southwest corner of said Lot 9; thence West 10 feet; thence
North parallel to the West Line of said Lot 9 to the South right -of way line

of Nob Hill Boulevard; thence Southeasterly along said right-of-way line to
the Westerly line of Said Lot 9; thence South along said West line to the
point of beginning.
Excluding therefrom an easement for the operation and maintenance of the existing
sewer main, or as the same may be improved from time to time, over and across the
described premises.
The real property conveyance described herein is given and accepted in
mutual acknowledge between grantor and grantee as to the "AS IS" condition
of said property with no warranties given by grantor as to the condition of said
property either express or implied.
Grantor hereby reserves an easement for the operation and maintenance of the
existing sewer main, or as the same may be improved from time to time, over
and across the described premises.

SUMMARY EXPLANATION:
Gary Carnevali, d/b/a G.C. 11, LLC, owns two parcels of land located at the southeast
corner of the intersection of S 1st Street and Nob Hill Boulevard. A 20 -foot strip of city
owned property, which had been deeded to the City in the 1930's and 40's, separates
these two parcels. Last year Mr. Carnevali deeded to the City a strip of property for the
expansion of Nob Hill Boulevard in exchange for this 20 -foot strip. There is a sewer
line located within this strip of property and an easement is being retained for its
continued operation and maintenance.
You are now being requested to approve the resolution that will permit the City
Manager and the City Clerk to sign the Quit Claim Deed transferring this property.
