R-2004-157 A RESOLUTION authorizing the City Manager and the City Clerk of Yakima to execute a Quit Claim Deed transferring a portion of the City -owned Yakima Valley Transportation Company (YVT) right-of-way to Kenneth and Barbara Keller. WHEREAS, On November 18, 1985, the City of Yakima acquired the right, title, and interest of the Yakima Valley Transportation Company in and to the Yakima Valley Transportation Company's railway transportation corridors; and WHEREAS, The section of the YVT corridor at issue herein no longer connects with any other portion of the YVT corridor; and WHEREAS, The Kellers have agreed to trade to the City the south 30 feet of their property in exchange for the City's interests in the subject portion of the YVT corridor; and WHEREAS, The City Council deems it to be in the best interest of the City that the City's interest described herein and in the assocaited quit claim deed be conveyed now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager and the City Clerk are hereby authorized and directed to execute a quit claim deed in favor of Kenneth E. Keller and Barbara A. Keller, a copy of which is attached hereto and by reference made a part hereof, conditioned upon receipt and acceptance of an appropriate conveyance from the Kellers of their above-described interest. Cook, Director of Community Economic Development CONTACT PERSON / TELEPHONE: Bruce Benson, Supervising Planner, 575-6042 SUMMARY EXPLANATION: In November of 2003 Mr. & Mrs. Keller approached the City of Yakima with an offer to purchase the City owned YVT corridor that bisected their property. At that time it was determined by Council that the City would not agree to a sale but would instead entertain an even trade of that portion of its YVT corridor, which divides the Keller's property, in exchange for the south 30 feet of the Keller's property. The City's purpose in this trade is to permit the Keller's to improve the development potential of their property while in return the City acquires a portion of a substitute corridor that can be utilized for future utility extensions and a possible pathway between Randall and West Valley Community Parks. The subdivision issues that are involved with this trade have been approved and only await the filing of the respective deeds to take effect. You are, therefore, being asked to adopt the resolution authorizing the City Manager and City Clerk to sign the Quit Claim Deed transferring this property from the City to the Kellers.
