R-2004-120 A RESOLUTION authorizing the City Manager to purchase ISCO integrated flow monitoring and rain gauge equipment from the Whitney Equipment Company for a purchase price not to exceed $120,000.00 (plus sales tax) as a sole source purchase without calling for bids, and further directing the City Manager to execute all appropriate and necessary documents to complete the purchase and transaction. WHEREAS, Article VI, section 6, of the City of Yakima Charter and the Yakima Municipal Code Chapter 1.80 generally require that purchases over $25,000 be done by competitive bidding, subject to certain exceptions; and WHEREAS, the law recognizes a "sole source" exception from these competitive bid requirements when, due to unique specifications and requirements and the fact there is only one source, it would be futile to utilize competitive bidding for such product; and WHEREAS, the City of Yakima Wastewater Division requires the purchase of flow monitoring modules, equipment and rain gauges to monitor infiltration and inflow into its sanitary sewer collection system to comply with discharge permit requirements and reporting; and WHEREAS, standardization of the flow monitoring equipment is in the best economic interest of the City of Yakima, since it would not be practical to have several different brands of flow modules; and WHEREAS, for operational reasons, the equipment must have certain features, including the following: • The flow modules must use an integrated system for downloading data for enhanced and easy file management. • The flow modules and associated equipment must have the capability to be stacked to build a compact integrated system. • The integrated system must have wireless capability for downloading data. • The flow module must be capable of variable rate data storage. • The flow module must have inexpensive and long-lasting batteries. • Calibration of the flow modules must not be affected by temperature changes or drift. • The flow modules should not require field velocity profiling. • The flow modules must be able to withstand severe environments. • The flow monitoring equipment must be compatible with existing ISCO pretreatment sampling equipment. WHEREAS, beginning the summer of 2002 the Wastewater Division has conducted extensive research on available flow monitors and concluded that only the ISCO flow modules and related equipment satisfy all of the said criteria; and WHEREAS, Whitney Equipment Company is the only vendor in the Northwest that is authorized to sell ISCO flow monitoring equipment and can provide 20 flow modules, associated equipment and four rain gauges for approximately $120,000.00; and WHEREAS, the City Council finds it would be futile to call for bids regarding the needed monitoring equipment since only the flow monitoring and rain gauge equipment manufactured by ISCO will satisfy the stated requirements and criteria and such is only available through the Whitney Equipment Company; and WHEREAS, the City Council finds that it is in the best interest of the City to authorize the purchase of said equipment from Whitney Equipment Company as a sole source purchase without calling for bids, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager is hereby authorized and directed to purchase ISCO integrated flow monitoring and rain gauge equipment from the Whitney Equipment Company as a sole source purchase without calling for bids for a purchase price not to exceed $120,000.00 (plus sales taxes). The City Manager is further authorized and directed to execute all appropriate and necessary documents to complete the purchase and transaction. George, Mayor City Clerk The ISCO flow modules are the only flow modules that can perform all of the following criteria that the City of Yakima Wastewater Division requires: 1. They are modular allowing four units to be stacked on a single battery unit providing redundancy of level, velocity, and electronics. This ensures that minimal downtime and the modular design allows for maximum flexibility for configuring for future site requirements. 2. They are capable of variable rate data storage. Frequency of readings can be changed based on flow rate, level, velocity, total flow or input voltage. This allows critical data to be collected at key times. 3. The typical battery life of the module is about 15 months when taking 15 minute readings. This is the longest battery life of any make or model in use with similar batteries (6 volt lantern). The module also stores and provides a read out of battery voltage. 4. The velocity sensor contains a factory -calibrated microprocessor that means the user only has to enter the actual water level, which eliminates complicated field calibration. Temperature and sensor drift are also virtually eliminated. 5. Field velocity profiling is not required for accurate and dependable operation because the area velocity sensor measures the average velocity directly in the flow stream. 6. The Nema 6P enclosure ensures that periodic water submergence will not damage the meters electronics. Approximately 20 Flow Modules with associated equipment and 4 Rain Gauges will need to be purchased immediately (with a purchase price not to exceed $120,000 plus sales tax) to begin monitoring the City of Yakima's sewer collection system. The flow modules are needed to track flows to facilitate the flow monitoring and Collection System Modeling Project as well as to comply with regulations for correcting Infiltration and Inflow issues and to ultimately comply with EPA's Capacity Management Operations and Maintenance (CMOM) regulations required for Sanitary Sewer Collection Systems. Sole sourcing is proper because bidding to the desired requirements would result in only one responsive and responsible submittal. An integral pressure transducer measures liquid depth to determine flow area. Flow rate is then calculated by multiplying the area of the flow stream by its average velocity. The area velocity method gives you greater accuracy where weirs and flumes are not practical, and where submerged, full pipe, surcharged and reverse flow conditions may occur. You don't have to estimate the slope and roughness of the channel, and silt correction allows you to compensate for debris that accumulates on the bottom of the channel. The pressure transducer's venting system automatically compensates for changes in atmospheric pressure to maintain accuracy. This would be a sole source purchase and formal bid requirements would be waived, since Whitney Equipment Company is the only authorized vendor in the Northwest Region that sells ISCO Flow Modules, associated flow monitoring equipment that can be stacked to build compact integrated systems. This allows multiple flow streams to be monitored at the same time and reduces confined space entry by having wireless capability to download data.
