A RESOLUTION authorizing sole source procurement without calling for bids from
RTC Manufacturing, Inc. whereby said entity shall provide CPRIII
Pager Programmable Time Switch for solar school zone safety flasher
systems.
WHEREAS, Article VI, Section 6 of the City of Yakima Charter and the Yakima
Municipal Code Chapter 1.80 generally require that purchases over $25,000 be done by
competitive bidding, subject to certain exceptions; and
WHEREAS, the law recognized a "sole source" exception from these competitive bid
requirements when, due to unique service requirements, it would be futile to utilize
competitive bidding; and
WHEREAS, standardization of the expansion to the existing CPRIII Pager
Programmable Time Switch System solar powered school zone safety flasher system is in
the best economic and public safety interest of the City of Yakima, since it would not be
practical to have a mixed system of safety flashers; and
WHEREAS, the vendor has exclusive rights and responsibility for the sale, service
and repair of the CPR Pager Programmable Time Switch System in the State of
Washington,
WHEREAS, it would be futile to utilize competitive bidding process for the
purchase of the CPRIII Pager Programmable Time Switch System solar powered school
zone safety flasher system, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager is hereby authorized to procure from RTC Manufacturing, Inc., as
a sole source procurement without calling for bids, CPRIII Pager Programmable Time
Switch for solar school zone safety flasher systems.
ADOPTED BY THE CITY COUNCIL this 20th day of July, 2004.

SUMMARY EXPLANATION:
Staff respectfully requests City Council consideration of a resolution authorizing a sole source
procurement with RTC Manufacturing, Inc. for the purchase of solar powered school zone safety
flashers.
As a result of this sole source purchase agreement, the City of Yakima would expand the existing
school zone flasher system to ten additional school crossing locations, funded by a grant from the
Washington Traffic Safety Commission.
RTC Manufacturing has exclusive rights and responsibility for the sale, service and repair of the
CRP III Pager Programmable Time Switch System, now in use by the City of Yakima.
Competitive bidding would therefore be futile. Sole sourcing is proper because bidding to the
desired requirements would result in only one responsive and responsible submittal.
