R-2004 — 94 A RESOLUTION granting a public fireworks display permit to Entertainment Fireworks WHEREAS, Entertainment Fireworks has applied to the City for a public fireworks display permit to conduct a public fireworks display at Yakima Speedway on July 4, 2004; and WHEREAS, Entertainment Fireworks has complied with the requirements of Sections 10.15.040 and 10.15.050 of the City of Yakima Municipal Code in that it has shown proof of adequate insurance, is the holder of a valid State Fire Marshal Permit for such display and the Code Administration Manager has investigated and approved the location of such display, now, therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Pursuant to the provisions of Section 10.15.040 of the City of Yakima Municipal Code, Entertainment Fireworks is hereby granted a permit for public fireworks display according to the terms and conditions found upon the attached and incorporated permit application. Cook, Director of Community and Economic Development CONTACT PERSON/TELEPHONE: Joe Caruso, Supervising Code Inspector (509) 575-6257 SUMMARY EXPLANATION: The Yakima Speedway submitted an application for a Public Fireworks Display for the Fourth of July on June 22, 2004. In order to have this application approved within the timeframe of the Yakima Municipal Code, Chapter 10.15, the City of Yakima attempted to contact the Yakima Speedway numerous times to obtain their application prior to the June 22nd regular Council meeting. Understanding the importance of this traditional display and the professional reputation of the pyrotechnic company, we are requesting ratification and approval of this application at the July 6, 2004 Council meeting. Evidence of liability insurance, state permit and site plan have been submitted and are on file in the office of Code Administration. Earlier in June, the City of Yakima attempted to contact the Speedway to advise them that the June 22 Council meeting would be the last opportunity for Council approval before July 4. We just received an application in the mail and a check for the application fee will be in tomorrow's mail. Although we discourage this practice, we have on rare occasion in the past brought such late applications to the Council to ratify after the fact. Understanding the importance of this traditional display and the professional reputation of the pyrotechnic company involved, we will administratively issue the required fireworks permit and bring it back to the Council on July 6 for ratification. A letter will be sent to the Speedway to notify them that in the future, applications must be received in time for Council consideration. WHEN IS PERMIT REQUIRED? • Displays are allowed until 10;00 p,m., displays after 10:00 p.rn, require additional approval from the City Council 111. SITE PLAN / INSPECTION A site. plan must be provided indicating the location of the fireworks: • The site plan will be reviewed by a City or Yakima fire inspector; • A city of Yakima fire inspector will wake a site inspection prior to the display. IV. AREA NOTIFICATION A permit is required for any person to make a public display or fireworks within the city limits of Yakima, Washington. L PERMIT APPLICATION • An application to make a fireworks display shall be made in writing to the Code Administration Manager or his designee. 1t is the responsibility or the applicant to notify the surrounding neighborhoods of the display as to the times and location and to supply Codes with notification flyer. V.
