A RESOLUTION declaring an emergency regarding the intersection control equipment
at 40th Avenue and Lincoln Avenue, and authorizing the City Manager
to execute all necessary documents with Northwest Signal Supply and
any other necessary parties to repair and/or replace the intersection
control equipment, video detection and cabinet at the intersection of
40th Avenue and Lincoln Avenue without calling for bids.
WHEREAS, Article VI, Section 6, of the City of Yakima Charter and Chapter 1.80 of
the City of Yakima Municipal Code require that the purchase of supplies, materials and
services costing more than $25,000 be accomplished by a call for bid; and
WHEREAS, both Article VI, Section 6, of the City of Yakima Charter and YMC
1.80.040 recognize an exception from these competitive bidding requirements in the event
an emergency is declared by resolution of the City Council; and
WHEREAS, the intersection control equipment, video detection and cabinet at the
intersection of 40th Avenue and Lincoln Avenue were recently damaged by a vehicle and
require immediate replacement and/or repairs; and
WHEREAS, it is essential to the safety and welfare of the citizens of Yakima that
immediate action be taken to repair and/or replace said intersection control equipment; and
WHEREAS, Northwest Signal Supply is the only vendor licensed in this region to
supply the necessary equipment to repair and/or replace the intersection control equipment,
video detection and cabinet at the intersection of 40th Avenue and Lincoln Avenue; and
WHEREAS, the City Council finds it to be in the best interest of the City to declare
an emergency to exist due to the aforementioned conditions and to authorize the execution
of all necessary documents with any needed outside parties for the repair and/or
replacement of the intersection control equipment, video detection and cabinet for the
intersection of 40th Avenue and Lincoln Avenue without calling for bids, now therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
An emergency is hereby declared, and the City Manager is hereby authorized to
execute all necessary documents with Northwest Signal Supply and any other necessary
parties to repair and/or replace the intersection control equipment, video detection and
cabinet at the intersection of 40th Avenue and Lincoln Avenue without calling for bids.

SUMMARY EXPLANATION:
The intersection control equipment at the intersection of 40th Avenue and Lincoln
Avenue was damaged beyond repair on June 4, 2004, by a private vehicle as the
result of a collision. The City of Yakima does not have replacement equipment to
install at this location. Currently the intersection is operating under a very limited
capacity due to damage to the controller, cabinet, video detection and pedestrian
related equipment. Immediate replacement of the intersection control equipment
is critical to public safety and welfare. Accordingly, the City Council is
respectfully requested to approve the attached resolution declaring an emergency
and authorizing the immediate purchase and/or repair of intersection control
equipment for the intersection of 40th Avenue and Lincoln Avenue without calling
for bids.
