R-2004- 61 A RESOLUTION authorizing the sale of surplus property consisting of a vehicle to Weber's Towing. WHEREAS, on November 28, 2003, a City of Yakima employee was in a two - vehicle accident with Natasha Attaway, and Natasha Attaway subsequently filed a damage claim with the City of Yakima on December 11, 2003, relating to the accident and to the damage to her vehicle, a 1996 Plymouth Neon; WHEREAS, the, 1996 Plymouth Neon VIN 1P3ES62Y7TD518187 was damaged and undrivable, and on or about January 23, 2004, the City of Yakima paid the claimant for the vehicle and took possession of the salvage; WHEREAS, the City of Yakima has no immediate or foreseeable use for the 1996 Plymouth Neon, which is surplus to the needs of the City; WHEREAS, Weber's Towing has made an offer to retain the vehicle plus One Thousand Dollars ($1,000.00) for the damaged 1996 Plymouth Neon in exchange for the towing and storage charges which total $3,712.84; WHEREAS, the City Council finds that it would be in the best interest of the City to transfer title of the 1996 Plymouth Neon to Weber's Towing, pay Weber's Towing One Thousand Dollars ($1,000.00) and allow Weber's Towing to retain the surplus vehicle in payment of the towing and storage charges; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Council hereby declares the above referenced damaged 1996 Plymouth Neon to be surplus to the needs of the City of Yakima, and the City Manager, through Craig Nance of Zaremba Claims Service, is hereby authorized and directed to transfer title and sell said 1996 Plymouth Neon, VIN 1P3ES62Y7TD518187, to Weber's Towing in Yakima, Washington, for the sum of One Thousand Dollars ($1,000.00), and without any warranty. At that time the charges were: Towing Storage (60 days @ $31.00) $155.00 1 860.00 $2,015.00 The salvage was worth $500.00 to $600.00. In negotiations with Weber's Towing, we were able to reach an agreement of surrendering the salvage ($500.00 to $600.00) and paying $1,000,00 for the storage instead of the full bill.. Harvey, Assistant City Attorney, 575-6030 SUMMARY EXPLANATION: On November 28, 2003, a City of Yakima police officer driving a city Police vehicle was in a two -vehicle accident. On December 11, 2003, the owner of the other vehicle that was hit filed a damage claim with the City of Yakima Clerk relating to the incident and to the damage to her car, a 1996 Plymouth Neon. The 1996 Plymouth Neon was damaged in the accident and is not drivable. On approximately January 23, 2004, the City of Yakima paid the claimant for the vehicle, and took possession of the salvage. The City has no need for the damaged vehicle. Weber's Towing has made an offer to the City to retain the vehicle and accept a payment of $1,000.00 in exchange for the towing and storage costs of $3,712.84.
