R-2004- 33 A RESOLUTION ratifying a Memorandum of Understanding between the City of Yakima and the Yakima Police Patrolmen's Association regarding shift schedules and shift differential pay. WHEREAS, the City's last collective bargaining agreement with the Yakima Police Patrolmen's Association (YPPA) expired on December 31, 2003; and WHEREAS, pursuant to the requirements of state law, the City and the YPPA have been engaged in negotiations and are now engaged in mediation for a new collective bargaining agreement to be effective January 1, 2004; and WHEREAS, the City of Yakima, through its Police Department, desires an immediate change to shift schedules to avoid gaps in the provision of police services; and WHEREAS, the YPPA has expressed a willingness to settle the issues of shift schedules and shift differential pay in accordance with the attached Memorandum of Understanding; and WHEREAS, on February 6, 2004, the City Manager of the City of Yakima and the President of the YPPA executed the attached Memorandum of Understanding regarding shift schedules and shift differential pay; and WHEREAS, the City Council has determined that it is in the best interest of the City of Yakima to resolve the issues of shift schedules and differential pay prior to completion of the final collective bargaining agreement in accordance with the terms and conditions of the attached Memorandum of Understanding, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The attached and incorporated "Memorandum of Understanding Between the City of Yakima and the Yakima Police Patrolmen's Association" is hereby ratified and authorized. For all other bargaining unit employees, the Employer reserves the right to implement, from time to time, eight (8), nine (9), and/or ten (10) hour shift plans, per past practices. If the Employer decides to modify these plans, from time to time, the Employer will provide notice of such change in accordance with Article 30 to the affected employee(s) except in the event of an emergency. In the event of an emergency, the Employer will provide as much notice as practicable. For all other bargaining unit employees, and in the event the Employer intends to implement changes in shift plans for duty assignments of more than three (3) months in duration, the Employer agrees to review the impacts of such long term shift changes with the Association prior to their implementation. 3.The parties' Collective Bargaining Agreement Section 13(b) shall be amended as follows: Work performed in excess of the regularly scheduled work day or work week shall be considered overtime and such time shall be compensated at the rate of time and one half (1 1/2), provided that Neighborhood Resources Officers, Community Service Officers, and Narcotics Units shall be compensated at the overtime rate only when hours are worked in excess of the regularly scheduled work week. For an ' bar_aininc unit member workin a 10 hour and 40 minute shift the regular work period for that member shall be 28 days and the regular hours of work during that 28 -day period shall not exceed 171 hours. For any bargaining unit member working a 9 hour shift, the regular work period for that member shall be 14 days and the regular hours of work during that 14 -day period shall not exceed 86 hours. 4. The parties' Collective Bargaining Agreement Article 23 shall contain a new section as follows: Section 8 -- Shift Differential Pay. All general squad patrol division officers (those not assigned a specialty) who work 10 hour and 40 minute shifts shall receive shift differential pay as set out in the following schedule. Only those people assigned as a general squad patrol officer on the division shift roster are eligible for this differential pay. Shifts starting between 0500 and 0859: No differential pay Shifts starting between 0900 and 1459: Shifts starting between 1500 and 1859: Shifts starting between 1900 and 0459: 1% of current base pay 1.75% of current base pay 2.25% of current base pay 5. This agreement shall be effective upon signing and upon ratification by the Yakima City Council and the YPPA. The terms of this agreement shall be incorporated into the new collective bargaining agreement. Within one week of the signing of this agreement, shift bidding for the balance of 2004 shall commence and the new schedule will take effect as soon as feasible. SUBMITTED BY: Chief Sam Granato, Police Department CONTACT PERSON/TELEPHONE: Chief Sam Granato - 575-6211 SUMMARY EXPLANATION: The Police Department and the Yakima Police Patrolman's Association (YPPA) are currently negotiating a new contract for 2004 & 2005. Part of those negotiations includes a change in shift hours and schedules, the addition of shift differential pay, and the upgrade of one police officers position to a sergeant. These changes will enable the Department to have officers working static shifts and hours, with the same sergeant, for a period of one year. This allows a squad of officers to work with the same sergeant each day instead of having officers working for multiple supervisors throughout the week. This will greatly increase the ability of the officers and the sergeants to build teams, improve performance, and form a cohesive structure that will improve supervision and overall field effectiveness. The cost of the shift differential pay and the position upgrade is approximately $52,000 a year. This cost will be a component of the final YPPA contract settlement, which is still under negotiations. It is unknown when final contract settlement will occur; it is therefore preferable to move forward and adopt this resolution and Memorandum of Understanding at this time so the shift plan may be immediately placed into effect.
