SUMMARY EXPLANATION:
A Public Hearing declaring approximately 2,000 square feet of property, triangular in shape,
located at the corner of Fechter Road and Castlevale Road as surplus to the City needs. This
property was deeded to the City on May 7, 2015 by D.E.P. Properties, Inc, for irrigation facilities
and irrigation purposes to use at the Catalyss development to install pumps for a city operated
irrigation system. Catalyss, LLC has determined they want to own and operate the irrigation
system. The City no longer has need for this property, however Catalyss does.
This resolution declares the property surplus and authorizes the City Manager to sell the property
to Catalyss, LLC.

RESOLUTION NO. R -2017-
A RESOLUTION declaring certain property originally obtained for irrigation facility purposes
to be surplus and authorizing sale.
WHEREAS, approximately 2,000 square feet of property, triangular in shape, located at
the corner of Fechter Road and Castlevale Road was deeded to the City on or about May 7,
2015, for irrigation facilities and irrigation purposes; and
WHEREAS, it was determined by the Water/Irrigation manager, David Brown, that the
property is no longer needed for irrigation purposes of any kind; and
WHEREAS, the City continues to maintain the property through mowing and weed
control, among other maintenance activities, even though it has no use to the City, costing the
City money in upkeep and maintenance charges; and
WHEREAS, the City had real estate agent Russ Roberts value the property for
purposes of this surplus and sale; and
WHEREAS, Mr. Roberts visited the property, found that it was very small and cannot be
built upon, with roads and driveways surrounding the property; and
WHEREAS, Mr. Roberts found that there are no sales comparisons for properties as
small as this piece of property, and determined the only way to value the property was through a
price per square foot evaluation; and
WHEREAS, Mr. Roberts valued the property at $0.40 per square foot, and a total value
of $800.00; and
WHEREAS, Catalyss, L.L.C. is developing property adjacent to the property subject to
this surplus resolution, and has proposed to purchase this property to aid in developing the
infrastructure of the property; and
WHEREAS, a public hearing was held on January 17, 2017 regarding the surplus and
sale of the property after proper notice was provided; and
WHEREAS, the City Council has evaluated the proposal to surplus the property and sell
it to Catalyss, L.L.C., finding that it is in the best interest of the City and the residents of the City
to do so; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
Section 1. Declaration of Surplus and Authorization of Sale. The fair market value
of the 2,000 square foot triangular piece of land is $0.40 per square foot. The fee interest in the
property is surplussed. The City Manager is authorized to negotiate and sell the fee interest in
the property to Catalyss, L.L.C. in a commercially reasonable manner for a price that equals or
exceeds its fair market value. The City Manager is further authorized to execute any sale,
transfer or related documents in a form as approved by the City Attorney.

Section 2. Effective Date. This resolution shall take effect immediately, as provided by
ADOPTED BY THE CITY COUNCIL this 17th day of January, 2017.

Dear Mark and David:
I have looked this over and drove by the location of the small parcel of land commonly described
as Trac A. Indeed it is very small and pretty much useless. It is so small it can't be built on or
have really anything done with it. With the roads and/or driveways all around it make it even
more odd and difficult to evaluate. There are no sales comps for properties this small, there is
no way to do an income approach or sales approach and the only thing you could possibly do is
a price per square foot. Even this approach would take a specific user who wants or needs it.
With that said; it appears the parcel is about 2000sf. It might be worth 0.25-.050sf or $500-
1000. Considering all factors I would recommend $800 as a fair price for this property
