R-2003- 19 A RESOLUTION declaring an emergency and authorizing the City Manager to execute all necessary documents with Northwest Signal and any other necessary outside parties to repair and/or replace the controller and cabinet at the intersection of South First Street and Nob Hill Boulevard without calling for bids and at a cost not to exceed $50,000.00. WHEREAS, Article VI, Section 6 of the City of Yakima Charter and Chapter 1.80 of the City of Yakima Municipal Code require that the purchase of supplies, materials and services costing more than $25,000.00 be accomplished by a call for bid, and WHEREAS, the law recognizes an emergency exception from these competitive bidding requirements in the event of an emergency; and WHEREAS, said Charter provision and YMC § 1.80.040 allow the City Council to declare an emergency in certain situations and thereby dispense with the need to follow a competitive bid process; and WHEREAS, the signal controller and cabinet at the intersection of South First Street and Nob Hill Boulevard were recently destroyed by a vehicle, and WHEREAS, while immediate and temporary repairs have been made to said signal controller and cabinet, these repairs have required the utilization of all available spare parts and equipment; and WHEREAS, in the event that another controller and cabinet are damaged at another location, the City may not be able to repair that controller and cabinet due to a lack of sufficient replacement parts and equipment; and WHEREAS, Northwest Signal Supply is the only vendor licensed in this region to supply the necessary equipment to repair and/or replace the controller and cabinet at the intersection of South First Street and Nob Hill Boulevard; and WHEREAS, it is essential to the safety and welfare of the citizens of Yakima that immediate action be taken to repair and/or replace said controller and cabinet; and WHEREAS, the City Council finds it to be in the best interest of the City to declare an emergency to exist due to the aforementioned conditions and to authorize the (Ik) streets enter controller 1' nob hill 1.03.pm execution of all necessary documents with any needed outside parties for the repair and/or replacement of the controller and cabinet for the intersection of South First Street and Nob Hill Boulevard without calling for bids, now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: An emergency is hereby declared and the City Manager is hereby authorized to execute all necessary documents with Northwest Signal and any other necessary outside parties to repair and/or replace the controller and cabinet at the intersection of South First Street and Nob Hill Boulevard without calling for bids and at a cost not to exceed $50,000.00. (Ik) sheets emer controller 1° nob hill l-03.pm y Place, Mayor AMENDED BUSINESS OF THE CITY COUNCIL YAKIMA, WASHINGTON AGENDA STATEMENT Item No. *12 For Meeting of February 4, 2003 ITEM TITLE: Consideration of Resolution for Emergency Signal Repairs at First Street and Nob Hill Boulevard SUBMITTED BY: Dick Zais, City Manager Chris Waarvick, Director of Public Works CONTACT PERSON/TELEPHONE: Shelley Willson/576-6430 SUMMARY EXPLANATION: Staff respectfully requests City Council approval of the attached resolution declaring an emergency condition and waiving the formal bid process in order to purchase a signal controller and cabinet for the intersection of South First Street and Nob Hill Boulevard. The signal controller and cabinet were damaged beyond repair on December 30, 2002 by a private vehicle as the result of a collision. Currently, a spare controller that allows the intersection to remain functional until the replacement controller is received operates that intersection. The City of Yakima does not have an additional spare. Therefore, timeliness of this item is critical. The replacement controller and cabinet may be purchased from Northwest Signal for $35,000. Also it may be necessary for additional work to be completed by an electrical contractor during the installation of the controller and -cabinet. The resolution includes $15, 000 for these services.
