A RESOLUTION authorizing the removal of three Sweetgum trees located in
the City right-of-way at Chestnut and 2nd Street, Yakima,
Washington.
WHEREAS, three Sweetgum trees are currently located in the City right-
of-way at Chestnut and 2nd Street, Yakima, Washington; and
WHEREAS, Mercy Enterprises has requested authorization to remove
three Sweetgum trees since the trees in question block the business owner's
signage; and
WHEREAS, the City Arborist has reviewed the situation, and the
Sweetgum trees do not meet the City's criteria of being dead, diseased or dying;
and
WHEREAS, if permitted to remove said Sweetgum trees, costs for
removal will be at Mercy Enterprises' expense; and
WHEREAS, if permitted to remove said Sweetgum trees, costs for
Leprechaun Ash replacement trees will also be at Mercy Enterprises' expense;
and
WHEREAS, the Leprechaun Ash is a type/species approved in advance
by the City's Parks and Recreation Manager; and
WHEREAS, the City Council deems it to be in the best interest of the City
to grant permission to Mercy Enterprises to remove, at their sole expense, the
three Sweetgum trees and to plant replacement Leprechaun Ash trees, also at
their sole expense, in the City right-of-way at Chestnut and 2nd Street, Yakima,
Washington, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
YAKIMA:
Mercy Enterprises, a business owner of property adjacent to City right-of-
way located at Chestnut and 2nd Street, Yakima, Washington, is hereby granted
permission to remove, at their sole expense, three Sweetgum trees situated at
said location with the condition that they plant at their sole expense three
Leprechaun Ash replacement trees at Chestnut and 2nd Street.
ADOPTED BY THE CITY COUNCIL THIS 15th , of October 2002.

SUMMARY EXPLANATION:
Mercy Enterprises has contacted the City to request permission to remove three Sweetgum
trees located near their business at Chestnut and 2na Street. The request is necessary
because it obstructs and blocks their signage.
If Council approves the request, removal of the trees would be at the business owner's
expense. Suitable replacement trees would be Leprechaun Ash. Replacement costs would
be at Mercy Enterprises' expense as well.

STAFF RECOMMENDATION: Staff respectfully requests Council to adopt the resolution
authorizing removal of three Sweegum trees located in City Right -of -Way on Chestnut and
2"d Street and replacement thereof with Leprachun Ash, all of which is at Mercy Enterprises'
expense.
